Description
JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations 1701 Directors Blvd, Suite 600 Austin, TX 78744 2. Description of Action: The proposed action is for a 12-month, firm-fixed-price delivery order to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government-Wide Acquisition Contract (GWAC) for warranties for the LM 4 degausser and the DF 4 mutilator machines, as well as an annual certification for the degausser machine, from Data Security, Inc., 300 South 7th Street, Lincoln, Nebraska. 3. Description of the Supplies or Services: The proposed action is to provide hardware warranties for the LM-4 degausser and the DF-4 mutilator machines to ensure continued performance for the destruction of electronic media at the Department of Veterans Affairs (VA), Office of Information and Technology, Service Delivery and Engineering, Enterprise Operations, Austin Information Technology Center (AITC). In order for the AITC to comply with the American Health Insurance Portability and Accountability Act of 1996 regulations, all hard drives and media disks that will be taken out of use must first be degaussed, and then destroyed, in accordance with the National Security Agency (NSA) Central Security Service (CSS) and Department of Defense (DoD) regulations. Hard drive destruction involves physical bending, mangling, and breaking of the drive units so that no sensitive information can be retrieved. "The LM-4 degausser machine is used to magnetically destroy any hard disk media to remove sensitive information. By generating magnetic fields in multiple directions, the degausser completely sanitizes hard disk media. The LM-4 is listed in the "NSA/CSS Evaluated Products List - Degausser," as having been evaluated and certified as meeting the performance requirements for the destruction of magnetic storage devices that retain any classified or sensitive data. "The DF-4 mutilator machine is used to destroy hard disk media. The rotating rams inside the DF-4 bend and puncture the media, causing the hard drive to shatter, and is the most secure method of preventing information retrieval. The DF-4 meets DoD compliance guidelines for the physical destruction of media, as set forth in DoD's National Industrial Security Program (NISP) Operating Manual (DoD 5220.22-M), established in 1993 by Executive Order 12829. In order to remain in compliance with Federal regulations for media sanitization and destruction, AITC requires both the LM-4 degausser machine and the DF-4 mutilator machine to be re-tested periodically according to manufacturer's recommendations. Data Security, Inc., the manufacturer of the LM-4 and DF-4 machines, recommends testing once per year after the first two years of operation. The total estimated value of the proposed action is (REDACTED), inclusive of options. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. Data Security, Inc., is the manufacturer of the LM-4 degausser and the DF-4 mutilator machines in operation at the AITC, and they have resellers of the services on NASA SEWP. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government's requirements. It was determined however that limited competition is viable among authorized resellers for this brand name item. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: The Government's technical experts conducted market research to identify providers of the required software, by performing an internet search on the General Services Administration (GSA) website, the FedBizOpps website, and by contacting the manufacturer of both machines, Data Security, Inc. Market research showed that Data Security, Inc., has authorized resellers on NASA SEWP. "RFI 177725 - A request for information (RFI) was posted on May 5, 2014, on NASA SEWP IV, RFI 177725 to Group B (service-disabled, Veteran-owned small businesses, SDVOSBs). No responses were received. "RFI 178717 - A new RFI was then posted to Groups B and C with the "NSA/CSS Evaluated Products List - Degausser" certification requirement. "RFI 179436 - Due to the unavailability of the SEWP website, the RFI was extended under RFI 179436 until Friday, June 20, 2014. One capabilities statement and informal pricing was received from the below contractor: ContractorNASA SEWP GroupSocioeconomic Status Merlin InternationalGroup CVeteran-owned small business (VOSB) ? SEWP is a dynamic catalog where items can be added based on customer requests, therefore, as long as the required item or service is within scope of the NASA SEWP contracts, items and services can be added to the catalog on a daily basis. Based on this fact and the market research, this acquisition will be solicited from the SDVOSBs in Group B, and the small businesses in Group C. 9. Other Facts: None
