Description
Statement of Work Fill in all Contract Line Item Numbers' (CLINs) unit Price and Total Price. Travel CLIN is not to exceed $5,000.00. SIgn and fill-in blocks 30a, 30b and 30c. This solicitation is 100% Small Business Set-Aside STATEMENT OF WORK (SOW) Validation Study of Elliptical Machine as an Alternative to the Defense Logistics Agency (DLA) Police's 1.5 Mile Run 1. Background DLA currently uses pushups and a 1.5-mile run to provide a measure of assigned police officers' level of fitness and preparedness to successfully accomplish occupational tasks. Due to medical reasons, members are often waived from the 1.5 mile run portion of the assessment. Individuals waived from the run are required to participate in a timed 2 minute walk as an alternative to the 1.5 mile run. Tests on an elliptical trainer may or may not be a suitable alternative to the 1.5 mile run. 2. Contract Type And Period Of Performance The work specified in the task descriptions shown below will be performed under a Fixed Price contract. 3. Scope of Work This Statement of Work (SOW) sets forth the requirement for a validation study of the PRECOR model EFX 556i and Life Fitness model 95X elliptical trainers as an alternative for the 1.5-mile run for the DLA Police Physical Agility Test (PAT). In addition, to provide standards and procedures for its use that is equivalent to the current 1.5-mile run PAT test standards for agency police officers. A. The Contactor shall provide discipline-specific technical expertise as detailed in the task. The Contractor shall provide personnel experienced with the PAT requirements of a Federal Police Force. The Contractor shall have experience conducting validation studies of physical fitness testing methods and prescribing new/alternative test methods for assessing police fitness. B. Contractor shall research and provide analysis of the elliptical trainer as an alternative means of measuring police fitness and provide standards for administering tests to police officers intent on utilizing the elliptical trainer as an alternative to participating in the 1.5-mile run. Contractor will provide regular updates via email and/or telecom/teleconferences regarding completion of Task 1. The cost of any travel attributable to the government shall be limited to the existing government per diem rates. C. Intellectual Property 1) Any work products, discoveries exclusive rights to any variety of intangible assets resulting from this contract are the property of DLA and shall not be disseminated without the permission of the Contracting Officer's Representative (COR). Upon contract termination, the contractor will transfer all remaining data/work products and discoveries to the COR. 2) The contractor shall keep the COR appraised of all issues concerning the execution of the contract. The contractor will provide weekly email or telephone updates concerning the status and completion of the tasks related to this contract, summarizing all contractual activities, identifying problems requiring the Government's intervention. 4. Task Descriptions The Contractor to DLA Installation Support Security & Emergency Services will require the following tasks. The Contracting Officer's Representative (COR) will be the primary interface with the contractor. Task 1: Determination. Contractor shall make a determination whether or not the PRECOR model EFX 556i and Life Fitness model 95X elliptical trainer machines are a viable alternative to and substitute for the 1.5-mile run for the DLA Police PAT. Task 2: Standards and Procedures. If the contractor determinations that any or both the PRECOR EFX 556i and Life Fitness 95X model elliptical trainer machines are a viable alternative to substitute the DLA Police PAT's 1.5-mile run, the contractor shall provide standards and procedures for administering tests to police officers and a means to determine a pass/fail result for each test conducted. 5. Deliverables/Delivery Schedule Tasks and related due dates shall be modified based on mutual agreement of the government and the contractor. Deliverables are as follows: A. Determination. Contractor shall make a written determination, defensible in federal court or employment hearings, as to whether the PRECOR model EFX 556i and Life Fitness model 95X elliptical trainers may be used by a DLA police officer as a comparable substitute for the 1.5-mile run for the DLA Police PAT (see Enclosure). If Task 1 is completed with the determination that either the PRECOR model EFX 556i and/or the Life Fitness model 95X elliptical trainers are comparable substitutes for the 1.5-mile run for the DLA Police PAT, then Task 2 becomes effective. B. Standards and Procedures. Contractor shall create a standard test and written procedures so that a determination of suitability may be made for any DLA police officer who opts to use either the PRECOR model EFX 556i or Life Fitness model 95X elliptical trainer in lieu of participating in the 1.5-mile run as required by the DLA Police PAT. The determination of suitability should be either Pass or Fail. D. Presentations. Contractor must be willing and able to defend his determination of the standards and requirements necessary for a DLA police officer to use the PRECOR model EFX 556i or Life Fitness model 95X elliptical trainer as a comparable alternative to the 1.5-mile run as required by the DLA Police PAT. If it is necessary for this defense to be made in a federal court of law or employment hearing, Contractor shall present his arguments for the rationale of his decisions in said court of law or employment hearing. 6. Place of Performance All work under this contract shall be performed almost exclusively at government or contractor facilities designated by the Staff Director, Security and Emergency Services. The exceptions to the foregoing are meetings that take place at commercial venues as agreed to by the COR. Period of Performance The delivery date for the determinations (Task 1) is 30 days after the date of this contract. The delivery date for the standards and procedures (Task 2) is 30 days after the completion and delivery of Task 1. 7. Security Clearance Requirements Contractor personnel supporting this contract need not have Secret clearances. Specific security requirements will be provided in a DoD Form 254 (Department of Defense Contract Security Classification Specification) that will be issued at the time of contract award. 8. Government Furnished Equipment/Government Furnished Information (GFE/GFI) The government will furnish Government ID badges, work space, office automation equipment, telephone, access to fax, email, and printers, and any other requirements to support personnel assigned to support these tasks, as required. The government will also provide access to people, plans, and other information required to accomplish contract tasks. Federal Acquisition Regulation (FAR) Clause 52.245-1, Government Property, is incorporated by reference. That clause and Part 45.5 of the FAR shall govern the use and accountability of government furnished property, subject to the following: A. The Government reserves the right of access to the Government furnished property. Contractor liability for joint use property will be restricted to validated damage, theft, or negligence resulting from Contractor performance. B. Unless otherwise authorized by the Government, equipment (i.e., computers, furniture, etc.) cannot be purchased as "other direct costs" under this contract. If Government authorization is obtained for equipment purchases, the equipment becomes the property of the Government and shall be transferred at the completion of the task. C. The Government furnished property shall be surrendered to the issuing office at the end of his/her employment with the Contractor or upon expiration of this contract, whichever occurs first. 9. Restrictions on Employee Activity The distinct and separate nature of the Government-Contractor relationship must be maintained during the performance of this contract. The Contractor shall restrict its activities as follows: A. Contractor employees shall conduct only business covered by this contract while on Government premises. B. Contractor employees, while performing contract tasks, shall not solicit new business from the Government. C. Contractor business cards, letterhead, stationary, email signatures and any other identifying products shall not in any way imply employment or legal affiliation with the U.S. Government, Department of Defense, Defense Logistics Agency or any other Government component. D. Neither the Contractor nor any Contractor employees shall use Government stationary or any form of representation of Government affiliation. E. Neither the Contractor nor Contractor employees shall in any way represent either orally or in writing, that they are employees or agents of the Government or have any authority to act on the Government's behalf, either orally or in writing. 10. Other Performance Requirements A. Contractor Interfaces. The Contractor shall be required as part of the performance of this effort to work with other Contractors working for the Government. Such other Contractors shall not direct this Contractor in any manner. B. Classified Documents. Requests for classified documents must be submitted to the contracting officer for approval. C. Disclosure of Information. Information made available to the Contractor by the Government for the performance or administration of this effort shall be used only for those purposes and shall not be used in any other way without the written agreement of the Contracting Officer. The Contractor agrees to assume responsibility for protecting the confidentiality of Government records, which are not public information. Each Contractor or employee of the Contractor to whom information may be made available or disclosed shall be notified in writing by the Contractor that such information shall be disclosed only for a purpose and to the extent authorized herein. D. Limited Use of Data. Performance of this effort may require the Contractor to access and use data and information proprietary to a Government agency or Government Contractor which is of such a nature that its dissemination or use, other than in performance of this effort, would be adverse to the interests of the Government and/or others. Contractor and/or Contractor employees shall not divulge or release data or information developed or obtained in performance of this effort until made public by the Government, except to authorize Government personnel or upon written approval from the Contracting Officer. The Contractor shall not use, disclose, or reproduce proprietary data that bears a restrictive legend, other than as required in the performance of this effort. Nothing herein shall preclude the use of any data independently acquired by the Contractor without such limitations or prohibit an agreement at no cost to the Government between the Contractor and the data owner which provides for greater rights to the Contractor. E. Contractor Employees. Contractor employees shall present a neat appearance and be easily recognized as Contractor employees by wearing Identification cards issued by DLA at all times while on Government premises. When Contractor employees attend meetings, answer phones, and work in other situations where their status is not obvious to third parties, they must identify themselves as such to avoid creating the impression that they are government employees. F. Physical Security. The Contractor shall be responsible for the safeguarding of all government property provided for Contractor use. All government facilities, equipment and materials must be secured during non-duty hours. G. Non-Personal Services. This contract is a "non-personal services contract" as defined in FAR 37.101. It is, therefore, understood and agreed that the contractor and/or the contractor's employees: 1) Shall perform the services specified herein as independent contractors, not as employees of the Government. 2) Shall, pursuant to the Government's right and obligation to inspect, accept, or reject the work, comply with such general direction of the Contracting Officer, or the duly authorized representative of the Contracting Officer as is necessary to ensure accomplishment of the contract requirements. H. Confidentiality. This project and all materials provided to the Contractor by the Government and results, conclusions and recommendations obtained thereof should be considered confidential in nature and treated with the same level of care that the Contractor treats its own confidential business information. The information shall not be disclosed, copied, modified, used (except in the completion of this project) or otherwise disseminated to any other person or entity at any time to include, but not limited to inclusion in any database external to the Government without the Government's express consent. 11. Citizenship. Each employee shall be a citizen of the United States of America, or an alien who has been lawfully admitted for permanent residence, or who presents evidence from the Immigration and Naturalization Service that employment will not affect his immigration status. 12. Identification Badges Contractor employees (including those of sub-contractors) will not be required to obtain an identification card to work on this contract. If contractor employees must come on a DLA installation, a visitor's pass shall be obtained. 13. Travel For these services, travel is not anticipated; however, if travel becomes necessary, travel incurred for transportation and per diem (lodging, meals and incidental expenses) shall be billed in accordance with FAR 31.205-46, Travel Costs, and must be authorized by the COR in advance of travel. All travel-related expenses, per diem, airfare, transportation, etc., will be reimbursed to the contractor on a cost-reimbursable basis in accordance with the Joint Travel Regulations (JTR) (Volume 2) within the contiguous United States and set forth in FAR 31.205-46, "Travel Costs." The Contractor shall submit all travel receipts (currently, all items costing $75 or more) to be eligible for full reimbursement. Reimbursable airfare shall be paid at the least expensive prevailing rates for commercial airlines. When required, and pre-approved by the Contracting Officer, the most reasonable means of ground transportation, i.e., taxi, bus, car rental, shall also be allowable. Contractor shall submit copies of expense reports and receipts with invoices for payment. Travel will be on a separate CLIN and is not expected to exceed $5,000 for the whole effort. A designated representative will administer and conduct physical fitness testing annually based on calendar year, for all Police officers. 2. STANDARDS a. Guidelines. Using guidelines comparable with the Army's Civilian Police Program, minimum physical fitness standards, and the Cooper Institute administering standards are as follows. (1) Execute 19 pushups in 2 minutes. (2) Run 1.5 miles (2.41 km) in 17:30 minutes. (3) Alternate physical fitness events are permitted as follows for Police officers with medically documented restrictions or disabilities who cannot perform certain events but can otherwise perform the essential job functions. (a) Two Mile Walk. 2 mile walk in 32 minutes. (Alternate for 1.5 mile run) (b) 25 Foot Dummy Drag. 25 foot dummy drag in 15 seconds. (Alternate for push-ups) b. Minimum Physical Fitness. The minimum physical fitness standards measure the individual's minimum level of fitness required for this position. While the Agency will (as best as possible) support each officer with time, facilities, and resources to initiate and/or maintain personal health, wellness and exercise programs, these remain an individual responsibility. Officers should consult with their personal physician and/or professional fitness trainer prior to initiating a personal exercise program and maintain a routine exercise program on their personal time. c. Initial Fitness for New Hires. The initial fitness testing for new hires will be administered during initial pre-employment evaluation of tentative selectees. There are no retest opportunities for new hires. The test will be administered as determined by the Police Chief at the closest DLA location (with police forces) for the tentative selectee. Test results will be documented and reported to Human Resources. Selectees who do not pass the physical fitness test will not be hired as a DLA Police officer. d. Annual Tests. Police officers are required to take and pass the fitness test on an annual basis. Annual physical fitness tests will be administered within 3 months from the date of the employee's last annual medical examination. HQ police fitness test is administered IAW local bargaining agreements. (1) In the event a current employee cannot meet the physical fitness requirements, they will be afforded an opportunity to retest within 90 days. If the employee fails the retest, they will be afforded one last test within 90 days. Upon a third failure within the test cycle, the Human Resources office will be contacted to provide advice regarding removal determination. (2) Using available installation resources, certified fitness personnel will assist the officer in developing a fitness program. e. School Attendance. An officer who has attended the Uniformed Police Training Program at the Federal Law Enforcement Training Center or Army Civilian Police Academy at Ft Leonard Wood and successfully completed the Physical Efficiency Battery portion will not be required to test until the next test cycle the following year, provided it is not later than 12 months after the date the successfully completed Physical Efficiency Battery training was effected at one of the aforementioned schools. 3. MEDICAL PROFILES a. Temporary Medical Profile. If an officer is on a temporary medical profile (up to 12 months) that prohibits taking the fitness test, a make-up test will be scheduled 90 calendar days from the expiration of the profile. b. Permanent Profile. Any officer that receives a permanent medical profile (greater than 12 months), that prohibits them from performing the fitness test or other duties, will be referred for a fit for duty evaluation. c. Notice. Officers will be given at least 30 days' notice prior to their annual physical fitness test to allow time for resolution of possible medical clearance issues. It is the officer's responsibility to notify management of any temporary or preexisting condition, management and the officer working together will make arrangements for medical clearance prior to the administration of the physical fitness test. d. Medical Clearance. All officers with temporary or permanent medical conditions will be medically cleared by a government physician prior to taking the physical fitness test. Unless medical clearance allows for immediate testing using an alternate fitness test event, officers will be given up to 90 days from the date of medical clearance to prepare for the fitness test. e. Decision. The Chief, Security and Emergency Services, in consultation with DS-S, HR, Police Chief and medical personnel, will make a final determination in reference to retention or removal based on the fit for duty evaluation. Decisions will be on a case-by-case basis and well documented. 4. TEST ADMINISTRATION a. Notification. Officers will be notified of the date/time of the fitness test no later than 3 days prior to the date of the test. b. Hydration. Officers should ensure they are adequately rested and hydrated prior to the test. Officers are permitted to drink water (or other hydrating fluids) during rest breaks. c. Inclement Weather. The test will be postponed in case of inclement weather such as heavy rains, snow accumulation, icy road conditions or an elevated heat stress index. 5. PROCEDURE and SEQUENCING of PHYSICAL FITNESS TEST. The following procedure and order for testing are to be read and explained by test administrator to those taking the fitness test: a. Warm Up. Warm up for 3 minutes. b. Test. Perform the Push Up test, then rest for 3 minutes. (1) To assume starting position, the officer will assume the front-leaning rest position by placing hands where they are comfortable for them. Feet shall be together or up to 12 inches apart. When viewed from the side, the body should form generally a straight line from shoulders to ankles. Hands should be approximately shoulder width apart. (2) On the command "GO", officers begins the push-up by bending elbows and lowering entire body until upper arms are parallel to the ground. Then, return to the starting position by raising entire body until your arms extend fully. The body must remain in a generally straight line and move as a unit for the entire repetition. At the end of each repetition, the scorer will state how many push-ups of the repetition the officer has correctly completed. (3) If the officer fails to perform the first five push-ups correctly, the scorer will tell the officer to go to his/her knees, and the scorer will explain their mistakes. The officer will then be allowed to start over. After five push-ups, no restarts are allowed. Testing continues; incorrect push-ups do not count. c. 1.5 Mile Run. Conduct stretching exercises for 2 to 3 minutes; perform the 1.5 mile Run; conduct cardio-cool down for 5 minutes. (Run may be accomplished on treadmill, if available) (1) Timed run along a pre-selected, pre-measured course. Multiple participants will start at the same time. Walking is permitted. There is no pro-rating of time, all participants must complete the full run/walk for a time to be recorded. Once the time has started, it will not be stopped. (2) Course will be as level as possible. (3) Officer's will not be pushed/pulled or physically helped in any way. d. Alternate Events (1) Two-mile walk. This event uses the same course as the 1.5 mile run. Test administrator must observe the officer during the entire event and must ensure the person maintains a walking stride. Those who break into any type of running stride will be disqualified from the event and given a "no-go." To pass this event, the individual must walk 2 miles in 32 minutes. (2) Dummy Drag (a) Weight. The dummy must be of average proportionate height and weight of an adult and weigh between 140 and 150 pounds. (b) Safety. When picking up and putting down the dummy, bend knees to lower back. (c) Hold. Stand behind the dummy and hold it under its arms. (d) Procedure. At the starting line, participants must move the dummy in a controlled manner for 25 feet and place the dummy on the ground safely at the completion of the event (dummy's feet must pass the 25 foot line). (e) Passing Test. Participants must complete the event, without dropping the dummy, within 15 seconds to successfully pass. 6. ADDITIONAL GUIDANCE a. Excused for Physical Fitness. Police officers may be excused for up to three hours per week to engage in fitness activities at the worksite or installation fitness facility where the employee is working. Fees or expenses for membership or use of fitness facilities are the responsibility of the employee. Release of the employee is contingent upon the supervisor's determination that workload permits the employee to engage in fitness activities. (1) Prior to exercising outdoors, or in unconditioned indoor space, it's the employee's responsibility to determine whether there is a local heat stress index advisory regarding work/rest cycles. The local servicing safety and occupational health office can provide guidance regarding heat stress and work/rest. (2) Employees must follow the advised work/rest cycle and water intake guidance while exercising. (3) Fitness coordinators may suspend any or all outside exercise activities per the guidance of installation medical personnel, based on local weather conditions including the reported heat stress index or icy ground conditions. (4) In the event a Police officer cannot meet physical fitness requirements within prescribed standards, DLA will conduct a job search in the commuting area in an effort to locate a vacant position for which the employee is qualified. b. Test Administrator. The Police Chief will designate a test administrator (police training section, staff personnel, or other trusted personnel). The test administrator shall receive training as a physical fitness coordinator through the Cooper Institute, FLETC, or other source as approved by DS-S and will be present to conduct the test. c. LMS. Physical fitness test results and completion dates will be recorded in the Learning Management System under course code SEC-DLAPISTAPFT (DLA Police In-Service Training - Annual Physical Fitness Test).
