Amendment No.: 0005 is for Solicitation No.: A14PS00794 is as follows: 1. To include the following far clauses in full text: 52.233-04, Applicable Law For Breach Of Contract Claim (OCT 2004) United States law will apply to resolve any claim of breach of this contract. 2. L.8.2.1 Page Limitations will be removed. 3. Section M: scoring will be as follows: The assigned scores (100 points total) for each factor shall be: Factor 1: 10 points; Factor 2: 20 points; Factor 3: 10 points; Factor 4: 20 points; Factor 5: 20 points; Factor 6: 20 points; Factor 7: will be the quoters overall price which shall be used with the total score to calculate a best values rating for each quoter by dividing the overall price by the quoters overall score and the one with the lowest rating will be the best value contractor for the work. 4. To include the questions, recieved and government repsonse (NO MORE QUESTIONS WILL BE ACCEPTED) Concern 1: Neither I nor my technical staff can locate in the FP-03 or in recently published this year, FP-14, Type L - Ultra High Build Waterborne Acrylic traffic paint with glass beads. The BIA has listed this Type L under Section 634.01 Description as an Add: Type L Ultra High Build Waterborne Acrylic traffic paint with glass beads. response: the technical requirements are found in the supplemental specifications under section 634 which provides the AASHTO and ASTM requirements. We are not using the FP-14 on this solicitation so make that clear to the bidders. Question A: Since there seems to be no published document for Type L within the FP-03 or FP-14, will you consider replacing Type L with Fed Spec TTP-1952E Type 3 High Build Waterborne Self Cross-Linking 100% Acrylic Resin HD21-A? I have attached a copy Fed Spec TT-P-1952E, 10 July 2007 for your review, Section 3. REQUIREMENTS, 3.1 Composition 3.1.1 Materials describes the acrylic resin used for Type III shall be a 100% crosslinking acrylic. By making this change you allow several traffic marking manufactures to compete on a level playing field which always results in a better price for the BIA. Life cycle performance of the traffic marking will not be lost when this product is applied as engineered and specified in NMDOT at 22 mils DFT with a double drop Type I and Type 3 glass beads. Response: Section 718.24 of the supplemental specifications tells the contractor what the paint must meet. If the contractor wants to propose changing the paint type they can submit a proposal to the government after award of contract but not during the bidding. We believe the table in section 718.24 is close to the same paint referred to in this question. If the bidder believes that his paint is equal to or better than what we spec, he can take the risk in putting his unit price in the bid schedule based on such paint but there is no guarantee that the government will accept it. You won't find a "Type L - Ultra High Build Waterborne Acrylic traffic paint with glass beads" in the FP-03 Standard Specification. Therefore, we provide that specification in our Supplemental Specifications to account for that type of material. This is why we include a Supplemental Specification for that very reason. Concern B - Neither I nor my technical staff can locate in MUTCD Section 718.24, Ultra High Build Waterborne Acrylic traffic paint. which is listed in your specification, 634.02 Material as, Add: Ultra High Build Waterborne Acrylic traffic paint. There is a 718.24 Temporary Pavement Markings: which specifies (a) Preformed Retroreflective Tape and (b) Raised Pavement Markers. MUTCD did recently make changes to this Section 718 products and coding but there still is not 718.24 Ultra High Build Waterborne Acrylic to be found. Response: Section 718.24 is in the supplemental specs and not the MUTCD. Please see "Attachment A Scope", the last two pages have the specification for the paint. Question C: Since there seems to be no published document supporting, 718.24 Ultra High Build Waterborne Acrylic, can this be changed to, MUTCD 718.17, Waterborne Traffic Paint? Response: No, but as per the response to question (A) you may submit your price, but the govenrment may not accept the paint change. 5. In Section F.1 remove the following, "605 days', TO READ "110 calendar day". 6. To remove the entirety of Section F.3. 7. TO correct the number of calendar days to 110 Calendar days for the completion of this contract. 8. Changes to apply: in Section 152.05 on P.26 will be changed to read, "152.04". 9. See attached to include all buy Indian Act Clauses. 10. The following changes will apply to this solicitation: a. P. 65. sec. M. l, second sentence of second paragraph, delete in it's entirety. b. P. 65, sec. M.l, last sentence of third paragraph check facilitates should be changed to facilitate. c. Sec. 106.01 add a space between theFP-03. 11. All other terms and conditions to remain the same.
