Description
Cape Kudugnak Remediation Mod J&A Control No. POA 14-46 22 August 2014 JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. CONTRACTING AGENCY: U.S. Army Corps of Engineers, Alaska District, Contracting Division, 2204 3rd Street - Post Office Box 6898, Joint Base Elmendorf-Richardson (JBER), Alaska 99506-0898. 2. DESCRIPTION OF ACTION: The action being approved is a modification to Firm-Fixed Price Contract No. W911KB-14-D-0007 Task Order 0001, awarded to BSI-TLI J.V. under competitive task order ordering procedures, for the remediation at Cape Kudugnak on Atka Island. It is noted that the Atka Cape Kudugnak FUDS property is a former long range radio site located on Atka Island, 1,100 miles southwest of Anchorage, and approximately 110 miles northeast of Adak, Alaska in the Andranof Island group of the Aleutian Islands (very remote project site). The period of performance will remain unchanged under the current contract. The same terms and conditions under the current contract will be applicable to this modification. 3. DESCRIPTION OF SUPPLIES/SERVICES: The existing contract to be modified is for environmental remediation at Cape Kudugnak, Atka Island. This request is for a modification of the subject contract to add an additional 375 tons of POL-contaminated soil quantity for excavation, packaging, transportation, and disposal. The dollar value of the proposed action is $605,028.75 (375 tons at $1,613.41/ton). 4. AUTHORITY CITED: Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(C) - Modification to the subject order must be issued in the interest of economy and efficiency because it is a logical follow-on modification to an order already issued under the contract, in consideration that all awardees were given fair opportunity to be considered for the original task order. 5. REASON FOR AUTHORITY CITED: Pursuant to FAR 16.505(b)(2)(i)(C) - in the interest of economy and efficiency, this is a logical follow-on requirement which is available from the incumbent contractor - as the services are determined to be available only from the original source in the case of follow-on contracts for the continued provision of specialized services when award to another source would result in substantial duplication of cost or unacceptable delays in fulfilling the agency's requirements (interest of economy and efficiency). a. The four current ERS MATOC contract holders were afforded fair opportunity to be considered for the original requirement and a Request for Proposal (RFP) was issued on 27 November 2013 with proposals due on 13 December 2013. After evaluation and price analysis, it was determined that BSI-TLI (J.V) submitted the lowest price of the four (4) technically acceptable proposals, and was determined to be the Lowest Priced Technically Acceptable proposal. Contract award was made to BSI-TLI (J.V) on 24 December 2014 for $2.59 million (Contract No. W911KB-14-D-0007 T.O 0001). b. The contact was awarded to BSI-TLI J.V.; the bid schedule includes, among other items, line item costs for mobilization/demobilization and several remedial field activities. c. A modification was processed on 11 July 2014 to exercise CLIN 0011 for the maximum quantity of 200 tons for $322,682. d. The subject modification is to add an additional 375 tons of POL-contaminated soil for excavation, packaging, transportation, and disposal. This will be at the same unit price of CLIN 0011 which is $1,613.41 per ton of POL-contaminated soil. See modification notes (attached) for specific modification breakdown. e. By addressing the additional quantity of POL-contaminated soil, a second mobilization and demobilization cost is eliminated. This will save the Government a minimum of $800,000.00. 6. EFFORTS TO OBTAIN COMPETITION: As the contractor is currently mobilized to Cape Kudugnak on Atka Island and has constructed a road to the site for conducting the remedial action, they are the only contractor authorized to access the project site (environmental regulations require use of specialized transport methods - the road constructed by BSI-TLI must be used for the required remediation efforts). Currently BSI-TLI is the only contractor in the area that can conduct the additional contaminated soil removal work before the barge arrives in late August for demobilization. 7. ACTIONS TO INCREASE COMPETITION: The Alaska District will have the potential for future work at Atka Island and plans to compete any new project requirements between the preselected MATOC contractors under the Environmental Remediation Services (ERS) IDIQ contract. 8. MARKET SURVEY: This Justification and Approval will be posted on FedBizOps prior to remediation. This is for award of a modification to an existing task order contract. This proposed action would not incur materially different work than is contained in the contract, would add work (quantity) that is in proximity to the ongoing work, would save the Government a minimum of $800,000.00, has a willing and engaged partner in the current contractor, and is in the best financial and performance risk interests of the Government. 9.
