- General Services Administration Public Building Service Leasing Division Justification for Other than Full and Open Competition (Redacted) Project No. 0PR2112, Ls. No. GS-02B - 18969 Proposed Action : The term of their current five (5) year Lease Renewal is expiring and the Government now intends to enter an eight (8) year Succeeding Lease, three (3) years firm, which establishes a new Lease term. Description of Requirement : As no additional Lease Renewals are available, the Agencies have consented to GSA's commitment to an eight (8) year Succeeding Lease, three (3) years firm with 90 day cancellation rights, in whole or in part. As a New/Replacement strategy is yet to be completed, a new Succeeding Lease will be negotiated. The new Lease period will provide the time to complete planning activities, as well as the time to move. Simultaneously, the Lease terms will permit the return of space, in whole or in part, after the firm term at no additional expense or liability to the Government. Certification of Statutory Authority : 41 U.S.C. 253 § 3304 Unique Qualifications : The current location is already constructed to meet required needs without the need for additional TI improvements. TI improvements would be required under competitive lease procurement. Continued occupancy at the existing location also eliminates the costs associated with a physical move, including moving costs and the cost of replicating telecommunication and data installations (collectively with the costs of TI improvements, "Relocation Costs"). A Succeeding Lease will also protect the Governments occupancy during this process at anticipated costs that will be fair and reasonable. Determination that Anticipated Costs will be Fair and Reasonable : The anticipated cost for the new Succeeding Lease period is fair and reasonable. Based upon a review of market data known to the Lease Contracting Officer and obtained from the internet and local Brokers, the total anticipated Succeeding Lease rent is well within the market range. However, when relocation costs are added, to the shell rent and operating cost, the aggregate rental cost at a new location would increase. By staying at the current location and paying the current aggregate rent, the Government would realize a substantial savings over the new eight year Succeeding Lease term. It has therefore been determined that it is in the best interest of the Government to renew the current lease at the existing location. The above information is accurate and complete. Requirements supporting this justification for other than full and open competition are certified as accurate.
