- Limited Source Justification The 502d Contracting Squadron has a requirement for SAS Software Maintenance in support of the AMEDD C&S, JBSA - Fort Sam Houston, TX. Conducted market research identifies that this requirement can only be met by Executive Information Systems, LLC, the sole authorized reseller of SAS Software, and the only firm that provides SAS products to the Federal Government. SAS has proprietary rights to its software and does not provide source codes that would allow software modifications by other firms. All interested sources who can refute these findings with clear and convincing evidence to support their ability to provide the SAS Software Maintenance should respond via e-mail to the 502d Contracting Office. The statutory authority permitting other than full and open competition is 10 U.S. C. Section 2304 (c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements and (FAR) 8.405-6, Limited Sources. This is NOT a solicitation for proposals or an invitation for bids. The Government does not anticipate receiving responses to this notice. If parties choose to respond, any cost associated with preparation and submission of data or any other cost incurred in response to this announcement are the sole responsibility of the respondent and will not be reimbursed by the Government.
