- Vendor shall certify that it is a Cisco Gold, Silver or Premier Authorized Channel as of the date of the submission of their offer, and that it has the certification/specialization level required by Cisco to support both the product sale and product pricing, in accordance with the applicable Cisco certification/specialization requirements. Unless otherwise specified, Vendor shall warrant that the products are new and in their original box. The Vendor confirms to have sourced all Cisco products submitted in this offer from Cisco or through Cisco Premier Authorized Channels only, in accordance with all applicable laws and current Cisco?s applicable policies at the time of purchase. Vendor shall provide Buyer with a copy of the End User license agreement, and shall warrant that all Cisco software is licensed originally to Buyer as the original licensee authorized to use the Cisco Software. Cisco Equipment Specifications: Definitions: "Cisco Channel Partners" means the Cisco Registered, Certified (Gold, Silver, Premier), and Specialized Partners authorized by Cisco to resell Cisco Equipment within the U.S. (territory in which the end user is located), as published on the Cisco Partner Locator at the following URL: http://tools.cisco.com/WWChannels/LOCATR/jsp/partner_locator.jsp, at the time the Cisco Equipment is acquired. The Cisco Channel Partner shall be listed in the U.S. listing of the Cisco Partner Locator. "Cisco Distributors" means Cisco Distributors, Distribution Partners, or Authorized Distributors authorized by Cisco to resell Cisco Equipment within the U.S. (territory in which the end user is located), as published on the Cisco Distributor Locator at the following URL: http://tools.cisco.com/WWChannels/LOCATR/jsp/distributor_locator.jsp, at the time the Cisco Equipment is acquired. The Cisco Channel Distributor shall be listed in the U.S. listing of the Cisco Distributor Locator. "End User Customer" means NETL. NETL shall be the business entity identified by the party placing the applicable purchase order with Cisco as the Initial End User of the Cisco product in question. "Primary Market" means an authorized Cisco product certified as being sold directly from Cisco through a Cisco Channel Partner or Cisco Distributor directly to the end user customer. "New" means new in the box, never previously owned nor previously registered with Cisco. Must be direct from a Cisco Channel Partner or Cisco Distributor as identified above and must be certified as an authorized Cisco Primary Market item. In accordance with the above definitions, the Cisco Equipment must be "new" in the box, purchased directly from either a Cisco Channel Partner or Cisco Distributor and registered directly with NETL identified as the end user customer. When the equipment is acquired, the Cisco Premier Channel Partner or Cisco Premier Distributor shall be notified that this equipment must be from the primary market with the intent to have identified NETL as the end user customer for certified service." NOTICE: ALL TECHNICAL QUESTIONS CONCERNING THE LISTED ITEMS ON THIS REQUEST FOR QUOTATION (RFQ) SHOULD BE DIRECTED TO Mr. Douglas Stull, Douglas.Stull@contr.netl.doe.gov, 304-285-4767. NOTICE: Vendors who are going to provide a quote in response to the Request for Quotation, Standard Form 18 (RFQ), are strongly encouraged to submit their quotation on the RFQ form and Continuation Sheet, Optional Form 336, via the FedConnect portal at www.fedconnect.net. If the vendor cannot submit their quote via the FedConnect portal, they may submit their quotation to the Purchasing Agent assigned to this requirement, Kathleen Nedzesky, e-mail address Kathleen.Nedzesky@netl.doe.gov. Ms. Nedzesky can be reached by telephone for procurement related questions at (412) 386-5536. If submitting via FedConnect, please do not submit via email. EVALUATION: The award will be made to the low priced, technically acceptable offer. An award shall be made to the responsible offeror submitting a technically acceptable quote and offering the lowest evaluated price. To be considered for evaluation, offerors must quote on all items/services listed in the solicitation. Offerors shall submit descriptive literature detailing features, technical capabilities and warranty data. Technical acceptability will be determined solely on the content and merit of the information submitted response to this provision as it compares to the minimum characteristics provided above. Therefore, it is essential that offerors provide sufficient technical literature, documentation, etc., in order for the Government evaluation team to make an adequate technical assessment of the quote as meeting technical acceptability. Compliance will be determined by the offeror's provision of literature showing performance capabilities or through written narr ative discussing the points not covered by the published literature All items must be quoted to be considered.
