- Determination and Findings of Contracting Officer's decision to sole source award based upon a finding of only one source reasonably available. This notice is published in accordance with Federal Acquisition Regulation (FAR) Part 5.101(a)(1) requiring the dissemination of information on proposed contract actions. This is a Notice of Intent to make a Sole Source Fixed Price award under the authority of 41 U.S.C. §3304(a)(1), as implemented by FAR 13.106-1(b)(1)(i), and is not a request for competitive proposals. The Department of Homeland Security, U.S. Customs and Border Protection, Border Enforcement Contracting Division intends to issue a firm fixed price purchase order to Raytheon Digital Force Technologies, LLC (DFT) of 9455 Waples Street, Suite 100, San Diego, CA 92121-3760. CBP Special Operations Group (SOG) has a need to obtain two (2) Digital Force Technologies Muskrat multi-protocol gateways, three (3) DFT Rincon node bridging gateways and two (2) DFT Pan Tilt motor units to integrate with existing DFT sensor node equipment currently used by SOG. This requirement ensures maximum performance and efficiency of the remote sensing and reporting system as a whole. The North American Industry Classification System (NAICS) code for this acquisition is 334290 - "Other Communications Equipment Manufacturing". DFT is a large business. This will be the only notice of the Government's intent to solicit and negotiate with one source in accordance with FAR 13.106-1(b)(1)(i). The sole source fixed price award shall be made prior to September 30, 2014. While this synopsis does not constitute a solicitation, interested vendors may identify their interest and capability to respond to the requirement. It is the Government's belief that only DFT's Gateways are interoperable with the sensors and system currently in use by SOG; however, firms that believe they can provide the supplies required that fully meet the Government's requirements may submit a capabilities statement in writing to the identified point of contact within seven (7) days after publication of this notice. Such documentation shall be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government.
