- THIS IS A NOTICE OF INTENT. The Broadcasting Board of Governors/International Broadcasting Bureau (BBG/IBB), Office of Contracts (CON) located in Washington, D.C. intends to negotiate and award a non-competitive contract to Level 3 Communications, LLC, to provide direct Internet Protocol (IP) access services to the BBG’s news bureaus located in the White House, State Department, the Senate and House Press Galleries as well as direct IP access services and Ethernet connectivity services from BBG’s main headquarters located at the 330 Independence Avenue SW, Cohen building, Washington DC to the agency’s MTIPS and MPLS service provider’s Point of Presence (POP)( 1220 Connecticut Avenue, NW Washington DC) in Washington, DC. The anticipated period of performance is October 1, 2014 through September 30, 2015. The total contract period of performance will not exceed one (1) year. The statutory authority permitting other than full and open competition that is applicable to this procurement is 41 U.S.C. 253(c)(1) which is implemented at FAR Subpart 6.302-1 as follows: “When the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for. Level 3 Telecommunications, LLC in the only source able to meet this requirement. Based on recent consultations with GSA, BBG’s building manager, there are only two known vendors that own and manage independent and diverse telecommunication circuits capable of connecting BBG to external telecommunication hubs. The other vendor is the incumbent and BBG must have more than one source capable of providing this critical requirement. Therefore, BBG plans to award a sole source contract to Level 3. The nature of the proposed acquisition requires the above-cited authority because BBG’s critical 24/7 broadcast mission is vulnerable to telecommunication outages and it requires uninterruptable access to telephony, Internet, and other telecommunication services. BBG must guarantee resiliency and eliminate single point of failure by distributing the procurement of key services to vendors that own and manage their own telecommunication infrastructure. This requirement is necessary to ensure the survivability of BBG’s telecommunication services if any single provider fails. In addition the agency is required to plan for disaster recovery and business continuity. The BBG must make every effort to procure resilient telecommunication infrastructure services that are routed through diverse telecommunication hubs. This Notice of Intent is not a request for competitive price proposals. The written response received from interested firms shall provide sufficient detail to allow for an evaluation by the Government without the need for the submission of additional information. The written response must be submitted to Myria Carpenter, Contract Specialist, Broadcasting Board of Governors/International Broadcasting Bureau, Office of Contracts, 330 C Street, SW, Room 4300, Washington, DC 20237 by Thursday, September 18, 2014 12:00pm EST. Telephone, email or faxed responses are NOT acceptable and will NOT be considered. No telephone responses of an interested firm's statements of interest, capabilities, and pertinent experience will be accepted by BBG. Any determination to compete or not to compete this proposed contract is solely within the discretion of the Government. This Public Notice is not an RFP, IFB, or RFQ.
