Description
NOTICE OF INTENT TO AWARD SIMPLIFIED ACQUISITION USING OTHER THAN FULL AND OPEN COMPETITION FOR THE MAINETENANCE OF 3 LUMENIS LASERS AT VA SOUTHERN NEVADA HEALTHCARE SYSTEM. The NAICS Code is 811219. The small business size standard is $20.5M. The Government intends to solicit and negotiate with one source under the authority of FAR 13.106-1(b)(1). The proposed sole source is for the following services: The Contractor's unique qualifications are as follows: Lumenis is the original equipment manufacturer of the equipment listed. They are the only authorized maintenance service provider of these units and maintain proprietary rights of replacement parts and servicing of this equipment. Lumenis does not train, authorize or endorse third party companies or individuals to service their equipment and will not agree to repair damages made by third party companies or unauthorized technicians on the equipment. Servicing of Lumenis lasers without the appropriate training, procedures, tools and quality systems may result in malfunction of the equipment and exposure to harmful levels of radiation to the patient, user and bystanders. This notice of intent is not a request for competitive quotations; however, any quotation received IAW the attached Statement of Work by 3:00PM PST on September 17, 2014 will be considered by the Government. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Any quotations should be e-mailed to Jaclyn.Alverson@va.gov no later than 3:00pm PST on September 17, 2014. Only proposals received by this date will be considered. Be advised that all correspondence sent via e-mail shall contain a subject line that reads "Quotation for Servicing of Lumenis Equipment". See attached document: Attachment 1 (Statement of Work). Statement of Work (SOW) (as of 9/9/2014) 1. CONTRACT TITLE: Lumenis Total Protection Plan Service Agreement 2. DEFINITIONS: Acceptance Signature - Veterans Affairs (VA) employee authorized to sign off on the Engineering Service Report (ESR), which indicates that Preventative Maintenance (PM) or unscheduled maintenance is either complete or pending completion Authorization Signature - Contracting Officer's Representative (COR) signature, which indicates COR accepts the work status as stated in the ESR VA - Veterans Affairs VAMC - Veterans Affairs Medical Center VASNHS-VA Southern Nevada Healthcare System NIST - National Institute of Standards and Technology OEM - Original Equipment Manufacturer CO - Contractor Officer COR - Contracting Officer Representative Preventative Maintenance (PM) - Periodic services required to maintain the equipment so that it may be operated in accordance with its intended design and functional capacity with minimal malfunction, down time, and inoperative conditions Field Service Engineer (FSE) - Contractor personnel authorized to perform maintenance (corrective and / or preventative) services on the VA premises Engineering Service Report (ESR) - Documentation of the services rendered for each scheduled or unscheduled maintenance event under the terms and conditions of the contract Contract Year - Begins the day the contract is awarded and ends a year after the contract award date 3. SCOPE: The Contractor shall provide all labor, supplies, parts, supervision and materials required to repair and maintain Government-owned Lumenis equipment. The equipment to be serviced and maintained is listed below: a.Equipment Description: AcuPulse 30ST Laser Manufacturer: Lumenis Model: Acupulse 30ST Part #: GA-0000170 Serial#: 107 Purchased: 3/19/2012 Location: VAMC Podiatry b.Equipment Description: Versapulse Powersuite 100 Laser Manufacturer: Lumenis Model: VersaPulse Powersuite 100 Part #: 0638-803-01 Serial#: 492 Purchased: 3/19/2012 Location: VAMC Surgery c.Equipment Description: Selecta Duet Laser Manufacturer: Lumenis Model: Selecta Duet Part #: GAS900000 Serial #: 10498 Purchased: 3/19/2012 Location: VAMC Eye Clinic 4. SPECIFIC TASKS: This contract includes the following services: a. Preventative Maintenance: Two PM visits will be included and scheduled with Biomedical Engineering. The PM's shall be conducted following manufacturer specified procedure. All costs for preventative maintenance parts are included. Parts provided must be the original manufacturer parts. Service Engineers will also recalibrate Equipment to ensure it conforms to Lumenis performance specifications. b. On-site repair service: Includes the cost of parts, travel and labor (During normal working hours 7:30am-4pm Pacific Time, Monday-Friday). Contractor shall provide service within 48 hours of initial on-site repair request. c. Technical support: Unlimited technical support is included Monday-Friday 6:00am-5:00pm Pacific Time. d.All software and hardware maintenance updates are included. e.Loaner equipment will be provided for extended repairs, based upon availability. f.Shipping: When applicable, the Contractor shall provide the required shipping materials (box and packing materials) to ensure sensitive equipment is securely packed. These shipping material costs shall be included in this Contract. 5.RESPONSE TIMES: The Contractor will acknowledge requests by telephone for service within 2 hours. The Contractor will be on-site within 48 hours of telephone acknowledgement of the service request. The Contractor will always contact the COR before and after arrival at the site. The Contractor shall provide in the space below the name, address and telephone number of the office where service calls are to be placed (available 24 hours a day, 7 days a week): Name:____________________________________________ Address:__________________________________________ __________________________________________ Telephone:________________________________________ 6.REPORTING: Service technicians are to check in with the Security Officer on duty at VAMC. a.Service technicians are to check in and out with Biomedical Engineering @ (702) 791-9000 x14062 upon arriving at the VAMC for performance of work. b.Service Report: The Contractor shall provide a written service report for the Government's record of repairs. The report shall include the repairs provided, parts replaced, and any additional maintenance information deemed necessary by the manufacturer to ensure the highest level of operation. This report shall be forwarded electronically to vhalasbiomed@va.gov utilizing Microsoft suite software or PDF no later than five (5) days after repairs. 7.AUTHORIZED SERVICE: Only those services specified within are authorized under this contract. Before permitting any service or repairs of a non-contract nature, the Contracting Officer must be advised of the reasons for this additional work. The Contractor is cautioned that only the Contracting Officer or his/her designee may authorize additional service or repairs that are outside of the scope of this contract and that reimbursement shall not be made unless prior authorization is obtained. 8.REMOVAL OF EQUIPMENT: Government property shall not be removed from the station without a signed Property Pass. This property pass may be obtained, after removal is authorized by the Contracting Officer or COR. Equipment shall not be removed by the contractor from the Government site for minor repairs. The contractor assumes full responsibility for the equipment while it is off-site, including not only the repair of the equipment, but also any loss or damage to the equipment while off-site or in transit. 9.CONTRACTING OFFICER REPRESENTATIVE (COR): Delegation of Authority letters shall be forwarded to the using service and the Contractor after agreement has been signed, identifying the individual(s) as the COR(s). No service shall be provided without the approval of the COR or his/her designee of this contract. The Contractor shall not accept any instructions issued by any other person(s) other than the Contracting Officer or his/her delegated representative acting within the limits of his/her authority. 10.CHANGES: The Contractor is advised that only the Contracting Officer, acting within the scope of the contract has the authority to make changes which affect the contract in terms of quality, quantity, price or delivery. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment shall be made in the contract price to cover any increase in costs incurred as a result thereof. 11. CONTRACTOR'S RESPONSIBILITIES: a.The Contractor shall maintain personal liability and property damage insurance prescribed by the laws of the Federal Government. He/she shall take all precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, or others, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by him/her or his/her employees fault or negligence. b.Contractor shall comply with all VA safety standards, manufacturers/industry standards, FDA, OSHA, TJC and the latest edition of NFPA-99. 12. CONTRACTOR SUBMITTALS/INSURANCE REQUIREMENTS: The Contractor shall be required to provide copies of the following: a.The Contractor is required to comply with Federal and State Workers Compensation and liability insurance. Reference FAR clause 52.228-5-Insurance and Subpart 28.307-2-Liability. b.Within 15 days of the awarded contract, the Contractor shall furnish to the Contracting Officer certification from his/her insurance company indicating that the coverage has been obtained and that it may not be changed or cancelled without guaranteed thirty (30) day notice to the Contracting Officer. New certifications shall be furnished prior to the expiration date. 13.REFUSAL OF CONTRACTOR PERSONNEL: The Government reserves the right to accept or reject Contractor's staff for the rendering of services. Complaints concerning Contract Personnel performance or conduct shall be dealt with by the Contractor, and/or the COR with the final decision made by the Contracting Officer. 14.PERSONNEL QUALIFICATIONS/EXPERIENCE REQUIREMENTS: All equipment service related activities need to be performed by an individual who has successfully completed, by Lumenis standards, the Lumenis Comprehensive Laser Training courses; including but not limited to electrical safety training, laser safety training, and clinical training offered by a certified Lumenis clinical trainer. Service technicians shall be fully trained and qualified to service the equipment. Service technicians are to provide certificates of competency. 15.SMOKING POLICY: Smoking is not permitted within or around the VA, except in designated areas. 16.SAFETY AND FIRE PREVENTION: In the performance of this contract, the Contractor shall take such safety precautions as necessary to protect the lives and health of the occupants of the building. Fire and safety deficiencies, which exist and are part of the responsibility of the Contractor, shall be immediately corrected. If the Contractor fails or refuses to correct deficiencies promptly, the COR may issue an order stopping all, or any part, of the work. The Contractor shall comply with applicable Federal, State, and local safety and fire regulations and codes, which are in effect during the performance period of the contract. The Contractor personnel shall follow applicable facility policies concerning fire/disaster programs. 17.VA POLICY: Possession of weapons is prohibited. Enclosed containers, including tool kits, are subject to search. Violations of VA regulations may result in citations answerable in the United States (Federal) District Court. 18.HOURS OF SERVICE: Normal hours of coverage will be Monday through Friday from 7:30am to 4:00pm, Pacific Standard Time, excluding federal holidays. All service/repairs will be performed during stipulated hours of coverage unless requested or approved by Biomedical Engineering. 19.NATIONAL HOLIDAYS: The contractor is not required to provide service on the following National holidays, nor will the Contractor be paid for these holidays.
