Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY Justification for other than full and open competition. Purchase Request number F2V4FM4219A001. Agency Agency Contracting Activity Department of the Air Force Air Mobility Command 6thMedical Group 3250 Zemke Ave Bldg 1078 MacDill AFB, FL 33621-5119 Department of the Air Force Air Mobility Command 6th Contracting Squadron 2610 Pink Flamingo Ave MacDill AFB, FL 33621-5119 II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED The Government intends to exercise FAR 52.217-8, Option to Extend Services clause. This clause was included in the original Task Order Proposal Request (TOPR), as well as the subsequent task order award (FA8053-12-D- 0028-5S02) issued off the Air Force Medical Service Commodity Council (AFMSCC) Clinical Acquisition for Support Services (CLASS) contract. CLASS contracts are utilized to supplement medical staff at Air Force Medical Treatment Facilities (MTFs) with a wide range of qualified clinical credentialed and non-credentialed health care workers (HCWs) in the 50 United States and Guam. The current ordering period for the CLASS ends on 20 September 2014. The extended ordering period will be from 21 September 2014 to 20 March 2015. The increase will support the 6th Medical Group (MDG) while a new long term contract is awarded that would provide Basic Life Support (BLS) patient transports as well as comprehensive Advanced Life Support (ALS) care. III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS The CLASS incumbent contractor will continue to provide Emergency Medical Technicians (EMT-B) to support treatment in a clinical setting such as an Acute Care Clinic or an Urgent Care Clinic, ambulance emergency response, in-flight emergency response, non-in-flight emergency response, transfer and transport services. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION 10 U.S.C. 2304(c) (1), as implemented by FAR 6.302-1(a)(2). V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF ONLY ONE RESPONSIBLE SOURCE Currently, there are eight (8) EMTs performing services to MacDill AFB under CLASS vehicle FA8053-12-D-00280-5S05. Each contractor under the multiple award CLASS contract was given fair opportunity to be considered for this task order award IAW procedures outlined in FAR 16.505(b). The competitive follow-on contract is currently underway. The re-compete began on 14 Aug 2014, with a Sources Sought Synopsis on FedBizOpps. Based on the original projected milestones, a 20 Mar 2015 award date for the follow-on contract is anticipated. The follow-on extension is for continued support services from highly specialized Emergency Medical Technicians. This follow-on effort is only required for 6 months as the scope of the effort has changed from BLS to ALS. The new requirement will be in place at the end of the extension period rendering our need for BLS only temporary. It is not practical to solicit new contractors for a 6-month contract. Accordingly, the current contractor is the only firm capable of providing the services described in Section III above without the U.S. Air Force experiencing unacceptable delays in fulfilling its requirement. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE Due to the short duration of this effort, it is not practical to seek additional competition for this extension. The proposed contract action is made under the terms of the existing CLASS that was previously synopsized in sufficient detail to comply with the requirements of FAR Part 5.207 with respect to the current proposed contract action. The initial task order under the CLASS contracts was competitively placed using the procedures under FAR 16.505 - Ordering (9 Mar 2005). A Task Order Proposal Request (TOPR) identified specific program requirements and each contractor under the multiple award CLASS contract was given a fair opportunity to be considered for the task order award as specified under FAR 16.505(b). It is not practical to solicit new contractors for a requirement that will no longer exist past the 6-month extension period. Award to any other source would result in unacceptable delays in fulfilling the agency's requirement to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the Medical Groups requirements. Awarding a short-term bridge contract to a new contractor would leave the government vulnerable to various problems due to loss of corporate knowledge and experience and ultimately would risk mission disruption. Additionally, while credentialing was being conducted, the Government would endure unacceptable delays in contract performance resulting in extended response times for on-base medical emergencies. Due to the criticality of this requirement, any disruption in contractor support would be gravely detrimental to 6 AMW personnel and their beneficiaries. The contracting officer provided fair notice to the contractor of the government's intent to issue an extension for services. A synopsis of this office's intent to exercise FAR 52.217-8, Extension of Services, will be posted to FedBizOps as document number F2V4FM4219A001 for a period of fifteen days. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE The original task order was competed amongst the twenty- two (22) CLASS vendors. Pursuant to FAR 52.217-8, the extension will be at the rates competitively established in the contract. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED Market research continues to be conducted through product searches on the World Wide Web by comparing contractor costs with other EMTs performing the same or similar types of work. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION None X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION See Section VI above. XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED The impending procurement will be recompeted as full and open competition. The intent of the Government is to solicit the follow-on procurement as a competitive Small business Set-Aside and award to one contractor. The scope of the current acquisition changed significantly due to a previous fatality and does not meet the demands of MacDill AFB. XII. CONTRACTING OFFICER'S CERTIFICATION The contracting officer's signature on the Coordination and Approval Document evidences that he has determined this document to be both accurate and complete to the best of his knowledge and belief. XIII. TECHNICAL/REQUIRMENTS PERSONNEL'S CERTIFICATION As evidence by their signatures on the Coordination and Approval Document, the technical and/or requirements that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(c)).
