Statement of Work Schedule of Supplies This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6 and in conjunction with FAR Subpart 13.5 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Quotes are being requested and a written solicitation will not be issued. 1. Solicitation F2M3FR4170A001 is issued as a Request for Quotation (RFQ). 2. This RFQ incorporates provisions and clauses in effect through Federal Acquisition Circular 2005-76. 3. This notice is NOT to be construed as a commitment by the United States Air Force. The Government is NOT liable for any costs and/or activity associated with providing a response to this announcement. Any costs incurred as a result of a response to this announcement shall be borne by the firm and will not be charged to the government for reimbursement. 4. This acquisition is a 100% Small Business set-aside under NAICS Code is 334118 with a small business size standard of 1,000 employees. 5. Description of Requirement: Line items 0001 through 0007 to upgrade Texas Law Enforcement Telecommunications System (TLETS) in accordance with the Schedule of Supplies (Atch 1) and the Statement of Work (SOW), Atch 2. In the Schedule of Supplies, where brand name items are referenced, equivalents are acceptable. However, in accordance with FAR 52.211-6, Brand Name Or Equal, if offering an equivalent, your offer must be accompanied by sufficient data to evaluate acceptability. If not provided, your quote may be rendered non-responsive and no longer eligible for award consideration. 6. Desired Delivery Date: Not to exceed 45 calendar days after receipt of award. Indicate Proposed Delivery Date in the quote. 7. Basis of Award: In accordance with FAR 52.212-2, Evaluation - Commercial Items, the Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers (in no specific order): a) Technical Acceptability: A detailed technical plan of execution shall be submitted with the quote for evaluation. Technical plans lacking sufficient information to determine acceptability and compliance with the SOW may be deemed non-responsive. Technical plans not submitted with the quote may render the quote non-responsive and no longer eligible for award consideration. b) Price: Offerors shall propose on all items. Only firm fixed price offers will be evaluated. Any offer using a sliding price scale or subject to escalation based on any contingency will NOT be accepted. Quotes determined to be unreasonable, imbalanced or incompatible (excessive or insufficient) with the scope of effort to be accomplished will NOT be considered. Submit pricing on the attached Schedule of Supplies (Atch 1). The Government reserves the right to award to other than the lowest price quote if the lowest priced offer does not demonstrate the technical capability to complete the requirement. The Government also intends to award a contract without discussions with respective offerors. Since award will be based on initial responses, offerors are encouraged to submit their most advantageous pricing in their initial response. 8. This RFQ incorporates one or more provisions or clauses by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted with its quotation or offer. CLAUSES OR PROVISIONS INCORPORATED BY FULL TEXT 52.211-6 BRAND NAME OR EQUAL (AUG 1999) (a) If an item in this solicitation is identified as "brand name or equal," the purchase description reflects the characteristics and level of quality that will satisfy the Government's needs. The salient physical, functional, or performance characteristics that "equal" products must meet are specified in the solicitation. (b) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must-- (1) Meet the salient physical, functional, or performance characteristic specified in this solicitation; (2) Clearly identify the item by-- (i) Brand name, if any; and (ii) Make or model number; (3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and (4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications. (c) The Contracting Officer will evaluate "equal" products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. (d) Unless the offeror clearly indicates in its offer that the product being offered is an "equal" product, the offeror shall provide the brand name product referenced in the solicitation. (End of provision) FAR 52.212-1 - Instructions to Offerors -- Commercial Items (tailored). Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on an SF 1449, letterhead stationery, or as otherwise specified in the solicitation. Offers must be valid for at least (60) days. At a minimum, offers must show -- (1) The solicitation number; (2) The time specified in the solicitation for receipt of offers; (3) The name, address, and telephone number of the offeror; (4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary; (5) Terms of any express warranty; (6) Price and any discount terms; (7) "Remit to" address, if different than mailing address; (8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically); (9) Acknowledgment of Solicitation Amendments; (10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and (11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation.
