Description
IGF::OT::IGF EQuIS software maintenaance license agreement. In accordance with (IAW) Federal Acquisition Regulations (FAR) 13.106-1 (b) (1), for orders not exceeding the simplified acquisition threshold, the Contracting Officer may solicit from a single source, such as licensing agreements. The software requirement has unique requirements that are compatible with other software systems in use by the Agency. Background Facts: Earthsoft Inc. is the only vendor qualified to provide maintenance and technical support to its proprietary EQuIS Online Documentation and Support system software which has been utilized by the program office over the past 10 years. EPA has identified Earthsoft Inc. as the only provider of commercial services and parts able to meet the requirements of this procurement. Earthsoft Inc. is the only known source able to satisfy the Governments requirement because they are the only source qualified to perform preventative maintenance with access to the proprietary software. Other vendors, unfamiliar with this software and any programming/processes, cannot provide maintenance and technical support to this proprietary software without the real possibility the software would not work afterwards. (1) Identification of the agency and the contracting activity: US Environmental Protection Agency, Region 5, Superfund Division (2) Nature and/or description of the action being approved. Single source award. (3) A description of the supplies or services required to meet the agency's needs. Annual renewal of EQuIS license agreement for an estimated price of $31,500. (4) An identification of the statutory authority permitting other than full and open competition. IAW FAR 13.106-1 (b) (1), for orders not exceeding the simplified acquisition threshold, the Contracting Officer may solicit from a single source, such as for licensing agreements. (5) A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. USEPA, Region Superfund requires EDD (electronic data deliverables) from all data providers, including accredited Contractor Laboratory Program labs, the Chicago Regional Laboratory, Potentially Responsible Party data providers, and USEPA contractor data providers. The EDD is specifically designed to work with the EQuIS software developed by EarthSoft, Inc. Since the early 2000?s, Region 5 Superfund has used the EQuIS software license. (6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies. A combined synopsis/solicitation posting occurred for six days using FAR Part 12 on the government point of entry, fbo.gov prior to the previous order placed in August 2013. The Agency received no responses. (7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. IAW FAR 12.209 and 15.404-1 (b)(2)(ii) the Contracting Officer compared historical prices for same items and determined the price is fair and reasonable. (8) A description of the market research conducted (see part 10) and the results or a statement of the reason market research was not conducted. Market Research was conducted on August 21, 2013, when a combined synopsis/solicitation was potsed using FAR Part 12 on the government point of entry, fbo.gov. The Agency received no responses. This market research was considered current. The Agency will perform more Market Research prior to the next renewal to verify only one source still exists. (10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. No sources have expressed in writing any interest in the acquisition. (11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. The Agency will perform more Market Research prior to the next renewal to verify only one source still exists.
