- SOW This is a notice of the Government's intent to solicit and a sole source award (base with four option years) to Thermo Electron North America LLC ("TENA"), 1400 Northpoint Pkwy Suite 50, West Palm Beach, FL 33407-1976 for a Maintenance Agreement on TSQ Quantum Less GC, Trace GC 2000 and TriPlus Base Unit 120/230V machines. TENA is the only known source to make repairs to the machine without voiding any warranties. The service contract shall also include any needed parts and labor that would be required for this equipment (including required software support). The FSIS TSLs perform regulatory testing of meat, poultry and egg products for the presence of food borne pathogens and sanitary indicator organisms. The equipment requires parts and technology that are only available from TENA. TENA has proprietary rights to the design and software utilized for the Mass Spec Systems and is the only company with access to performance verified component parts and software. Repairs and calibrations require proprietary training that is only available from Thermo Fisher Scientific certified engineers. The use of certified engineers also ensures the necessary repairs and calibrations will result in equipment that is fit for use and complies with the Laboratory Quality Management System and ISO 17025 requirements. The Eastern Laboratory is required to have an annual instrument calibration and preventive maintenance in order to maintain the ISO 17025 accreditation. The OQ/PV and PM protocols, which are provided in the service agreement from TENA is proprietary and documents the equipment has been compliant with ISO 17025 requirements. The vendor is the sole source for this service and there is no other vendor or technician who can provide comparable capabilities. There is no other servicer on the market that can be utilized that is proprietary to the developer, TENA. This procurement will be conducted under the authority of FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. Authority: 41 U.S.C. 253(c)(1). The items will be serviced at our Western Eastern Lab located in Alameda CA. It is anticipated that this procurement will be conducted as a Commercial Item acquisition under FAR Part 12. This is not a request for quotations or an announcement of a forthcoming solicitation. Request for copies of this solicitation will not be honored or acknowledged. The Government does not intend to pay for information received. All interested parties must respond within four (4) business days from the date of this notice. Written responses must provide clear and concise documentation indicating your firm's capability to provide the unit. Verbal responses are not acceptable and will not be considered. When responding to this announcement, respondents should refer to Announcement AG-3A94-S-14-0185. If after September 18, 2014, no viable responses have been received in response to this announcement, USDA/FSIS shall negotiate solely with Thermo Electron North America.
