- U.S. General Services Administration LEASE NUMBER: GS-04P-LSC60185 PROJECT NUMBER: 2SC0247 Agency Name: U.S. Forest Service (USDA) - A/B Code 1223 The General Services Administration currently leases 20,123 Rentable Square Feet (RSF) with a Common Area Factor of 1.0, yielding 18,295 ANSI BOMA Office Area square feet (ABOA) at 4931 Broad River Road, Columbia, SC 29212-3530 under lease number GS-04P-LSC44129. The current lease expires 9/30/2014. Approval is requested to negotiate a ten (10) year / two (2) year firm term succeeding lease with the incumbent Lessor without full and open competition for continued occupancy at this location. 2. DECSRIPTION OF THE SUPPLIES OR SERVICES REQUIRED. GSA received a response from the U.S. Forest Service on 6/27/2013 for a continuing need, more specifically, the agency requested to remain in the current location which was built-to-suit in 2004 to accommodate their mission. Numerous discussions between GSA Federal Realty and the agency transpired regarding the agency relocating to vacant Federal space. GSA Federal Realty team (John Behizedah) reaffirmed on 9/18/2013 discussions were still in progress. The agency furnished written justification on 6/27/2013 to GSA in support of their request to remain in place, or at the least, occupy a suburban/rural location. _____________________________________________________________________________________ Justification for Other Than Full and Open Competition After numerous discussions with the Forest Service, the Leasing Specialist/Contracting Officer prepared a written endorsement of the agency's justification to remain in place. Memorandum was submitted to Victoria Corkren (4PT) on 10/22/2013 under Scott Mowry's (Branch B) signature. An advertisement was placed in FedBizOps on 11/18/2013 with a response deadline of 12/13/2013 in accordance with full and open competition. There were no responses/ Expressions of Interest received. The Leasing Specialist/Contracting Officer personally visited the property and the local agency representative (Don Walker) on December 9, 2013. The visit was a re-affirmation the agency's justification to remain in place was with merit. Resolution was reached between GSA Federal realty and the Forest Service on 1/27/2014; the agency will need to make best efforts to relocate to vacant federal space. A succeeding lease enables GSA sufficient time to collaborate with the agency to prepare requirements that may enable the agency mission to adapt to an urban environment in the Strom Thurmond Federal Building as a long-term solution. Additionally, the succeeding lease allows GSA sufficient time to program BA54 money, develop a scope of work and complete the tenant improvements required to backfill the Federal space. The 10 year, 2 year firm term Succeeding lease action is a contingency plan in the event BA54 funds are not available for this relocation; the Federal space is not ready for occupancy; or the physical configuration is deemed non-functional to accommodate the agency's mission. The current Annual rent is $313,388.00 PRSF inclusive of annual CPI increases, and the estimated cost of the ten (10) year lease is $3,133,880.00. The estimated annual cost of this lease is $454,377.34 per year based upon a Bullseye Market Research report generated on 9/16/2013 and preliminary discussions with the incumbent Lessor. The total contract value over ten (10) years is $4,543,773.40 incorporating expected rental adjustments over the term of the lease. 3. IDENTIFICATION OF STATUTORY AUTHORITY. 41 U.S.C. 253(c) (1): Only one responsible source and no other supplies or services will satisfy agency requirements. _____________________________________________________________________________________ Justification for Other Than Full and Open Competition 4. DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED. In accordance with a full and open competition, an advertisement was placed in FedBizOps on 11/18/2013 with a response deadline of 12/13/2013 for a 10 year lease, 2 year firm term. There were no responses/ Expressions of Interest received. As demonstrated herein, "Only One Responsible Source" is available in the best interest of the Government. The current source is uniquely qualified as the space is immediately available and is already constructed to meet the agency's unique requirements with no disruption to the agency mission or incurring associated moving costs. The current facility was a build-to-suit construction in 2004 designed to accommodate the tenant agency's specific requirements such as:  Parking for up to 93 vehicles  Parking area with wide turning radii capable of handling large (+55 foot) commercial / industrial vehicles (ie., flatbed tractor trailers; service vehicles with light bars; cherry-picker trucks; fire trucks)  Secured parking area for motor pool vehicle storage  Large communication antenna(s) and satellite dishes  Proximity to state and local counter-part agencies  Motorpool service center; including large vehicles for maintenance of communication equipment in motor pool vehicles (15 vehicles)  Readily accessible facilities for storing fire-fighting tools and communication equipment  Training room and conference facilities for year-round cross-functional/inter-agency collaboration and to serve as staging area during catastrophic events (forest fires; hurricanes)  Conveniently accessible to general public seeking information and services A succeeding lease is necessary to: (A) Provide continuity of operations; (B) Allow time for GSA planning and programming of BA-54 funds; (C) Provide for build out of the Federal space; and (D) Relocate the agency if GSA can deliver functional space to fulfill the agency's mission requirements. The present Lessor is uniquely qualified to provide the current space until the alterations of the U.S. Forest Service space are completed. GSA anticipates that the construction of the new Federal space in the Strom Thurmond Federal Building can be completed on or about October 1, 2016. _____________________________________________________________________________________ Justification for Other Than Full and Open Competition 5. DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS PRACTICAL. The current strategy is to utilize Government owned space per the Federal Management Regulation, (FMR) 102-79.55. A pre-Solicitation FedBizOps notice was posted on 11/18/2013 with a response deadline of 12/9/2013 for a ten (10) year, two (2) year firm term lease. No responses/ Expressions of Interest to the solicitation were received. 6. DESCRIPTION OF MARKET RESEARCH CONDUCTED Market research provided 9/13/13 by the BULLSEYE Team (REIS; CBRE EA) resulted in a determination that the rates for similar Office Space in the Columbia, SC market ranges from $20.54 to $24.62 PRSF for a fully serviced lease. Co-Star was another market rent research source for Columbia, SC. The current location rent is $22.36 PRSF for a full service lease which is within range of the market rate range deemed to be fair and reasonable. A cost benefit analysis was not conducted as there were no alternative locations to perform/base the calculations. 7. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION. Relocation to another facility would involve significant down-time for the Agency and duplicative cost for the Government. Under the terms of the current lease, a full complement of systems furniture is provided as part of the rental rate. If the Forest Service is relocated to another site, the Government would need to replicate cost for systems furniture; data cabling; telephone cabling; and other operational administrative costs. The current lease expires 9/30/2014. A succeeding lease is necessary to provide continuity of operations. If GSA were not to award a succeeding lease, the lease would expire and the agency would become a holdover tenant, which has the potential for additional legal ramifications, and can result in ultimate higher rental payments from lack of Governmental negotiating position. 8. LIST OF SOURCES THAT EXPRESSED INTEREST IN THE ACQUISITION. STATEMENT OF ACTIONS TO OVERCOME BARRIERS TO COMPETITION. By this action the Government will save costs associated with moving; telecommunications/data replication; and tenant improvement costs. The current space will meet the agency's requirements until they relocate to Federal space. Therefore, the Government will not be seeking competition with this succeeding lease action. The U.S. Forest Service concurs with this action. 10. TECHNICAL REQUIREMENTS PERSONNEL CERTIFICATION.
