- JUSTIFICATION FOR OTHER THAN FULL AND OPEN C OMPETITION (J&A) 1. Contracting Activity: The Defense Logistics Agency, Defense Supply Center Philadelphia (DSCP), Directorate of Construction and Equipment. 2. The action being approved is the solicitation for supplies on o ther than full and open competition basis. 3. The contract will provide for the purchase of three hundred twenty-five well drill pipe and for the 325 pcs containing 93,000 lbs. of steel and made to order, NSN 3820-01-338-9963, manufactured by Atlas Copco, (CAGE 0CA08) under part number 855017W0479. Following is a description of the NSN required to meet DLA's needs: Item Description (Application) NSN Quantity Unit Price Adaptor tool (Drill Bit) 3820-01-338-9963 325 $824.50 This is a one-time buy with no options. The total estimated value of this buy is $296,240.75. It will be awarded as a fixed price contract 4. The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (1), only one responsible source and no other supplies will satisfy agency requirements (FAR 6.302-1). 5. This item is Sole Source to Atlas Copco, (CAGE 0CA08). This item is an 18' 3/4" drill pipe weighing 285 pounds each. The item is used utilized with the Atlas Copco Water Well Drill Rig. The part was developed by Ingersoll-Rand (the part was subsequently acquired by Atlas Copco in 2004 when Atlas Copco acquired the Ingersoll-Rand Drilling Solutions Division.). The drawing contains trade secret information and has copyright protection. Attached is the drawing which indicates these attributes. The value to the Government is the part will be built to the original drawing specification. The Government physically does not have in its possession sufficient, accurate or legible data to purchase this part from other than the current source. The item is manufactured by Atlas Copco, in accordance with their proprietary drawings and technical data, which is not available to the Government. 6. The acquisition will be synopsized in FED BizOpps and the solicitation will be posted to DIBBS. Vendors interested will be solicited. Offers received will be evaluated for this buy or future procurements (see item 11). 7. As the contracting officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable. Offers received will be subjected to price analysis considering current prices, historical prices and development of a Fair Market Price (FMP) based on current market conditions for similar items. 8. A market survey will not be conducted as the NSN is manufactured in a sole source environment by Atlas Copco, (CAGE 0CA08) under part number 855017W0479. 9. Specifications are not available, nor is this item suitable for full and open competition, due to the fact that the Government physically does not have in its possession sufficient, accurate or legible data to purchase this part from other than the current source. The item is manufactured by Atlas Copco in accordance with their proprietary copyrighted drawings and technical data, which is not available to the Government. The rights to use the data are not owned by the government. The technical certification indicates that the technical data is proprietary and will not support a brand name or an "or equal" full and open competitive procurement. The AMS / AMSC code is 3D (Sole Source - Data to produce is not physically available). This item is an 18' 3/4" drill pipe weighing 285 pounds. The item is used utilized with the Atlas Copco Water Well Drill Rig. 10. Atlas Copco (CAGE 0CA08) is the sole manufacturer of the 18' 3/4" drill pipe. 11. Defense Logistics Acquisition Directive (DLAD) 52.217-9002, Conditions for Evaluation and Acceptance of Part Numbered Items, encouraging the submission of offers for alternate products will be included in the solicitation to indicate that the contracting officer will consider all offers. 12.
