- J&A for Proximity Readers JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY The contracting agency responsible for the proposed contract action is the 48th contracting Squadron (48 CONS), RAF Lakenheath, Unit 5120, APO, AE 09461. This Justification for Other Than Full and Open Competition is prepared with the regard to the acquisition of Vindicator Proximity Readers in support of a sole source contract action for the Detachment 2, 25 Intelligence Squadron, United Kingdom. II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED This Firm Fixed Price (FFP) contract is a new follow-on to an existing contract, FA5587-13-F- A018, for Vindicator Technologies Proximity Readers, inclusive of all hardware and installation. This requirement is essential in fully securing the 25th Intelligence Squadron work facility and their mission to provide 100 percent support to the 352nd Special Operations Group. III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS The following Vindicator Technologies' equipment and estimated total are required to meet the agency's need: 0001- Break Glass Emergency Door Release Pull Station 1 EA 0002- Surface Mount Box for Emergency Door 1 EA 0003- HID Prox RFID Cred-ISO Prox II Cards 100 EA 0004- HID Prox RFID Reader w/Keypad 4 EA 0005- Electro-magnetic lock, single door 1 EA 0006- BMS, Level 2 2 EA 0007- HID Prox RFID Creader w/o keypad 2 EA 0008- PIR, 360 deg, Tritech 6 EA Equipment Total: $X,XXX 0009- Travel/installation/shipping (14days/110hrs) Est. Total: $XX,XXX Vindicator Proximity Readers are required for completion of the existing alarm system in order for the facility to meet National Security Agency (NSA) accreditation. The type of appropriation used to fund this request will be 3400, O&M funds. Funds are currently available for FY14 and have been submitted to 48th CONS for procurement. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION 10 USC 2304(c), as implemented by FAR 6.302-1(2)(ii) (FAR 6.303-2(b)(4)) V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) Currently the 25th Intelligence Squadron is utilizing a facility that is scheduled for demolition, due to the alarming growth of asbestos and unsound structure, which limits the ability to maintain a secure facility. They are projected to move into their newly renovated facility 30 September 2014; however, this facility is also unsecure, due to the inability to meet accreditation standards IAW Intelligence Community Directive (ICD) 705 and NSA policies. The new facility will require 24/7 security; therefore, the inability to maintain this level of security will create a 90 percent mission degradation for the unit. The new facility recently underwent a survey by an NSA accreditor to ensure the security system installed in this facility were in compliance. As is, the existing Vindicator Alarm System is not in compliance and will require additional hardware, hence the need for this requirement. In accordance with Air Force Instruction (AFI) 31-101, Security (Integrated Defense), the accrediting authority must approve interior Intrusion Detection Systems (IDS) before purchase and installation. The products available through Vindicator Technologies have been Air Force approved for protection levels 1-4, authorized by the NSA accreditor, and falls within the guidelines of AFI 31-101, ICD 705, and Intelligence Community Tech Spec for ICD/ICS 705. The additional hardware required to meet NSA accreditation are listed in Section III. These items are compatible with the Vindicator Alarm System currently installed. Outsourcing the Vindicator Proximity Readers and installation would require all Vindicator brand name equipment to be removed and replaced with a new brand of equipment. In accordance with FAR 6.302-1(2)(ii), the supplies in this request are available from the original source, Honeywell-Vindicator Technologies, considering this is a follow-on contract for the continued development of a major system. The justification for this rationale is to prevent substantial duplication of cost to the Government that is not expected to be recovered through competition. As stated earlier, outsourcing the readers and installation would require the existing alarm system, valued are $75K, to be removed. The substantial cost to the government to remove and replace the entire system with an alternatively branded commercially available system would not be recovered through competition. Being that the 25th IS current facility is scheduled for demolition at the EOFY, it will cost the government £46,000 GBP ($76,972 USD) per month, in maintenance cost, if this facility is not turned over to Civil Engineering (CE) by then. In addition, it will create 90 percent degradation for 25th IS mission and ability to support the 352nd SOG. The 25th IS believes that award to any other source would result in substantial duplication of cost to the Government and extensive delays in fulfilling their obligations to the 352nd SOG, as they would not be operating in full capability. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE Research for previous contracts was conducted to identify which companies have installed these systems at other Air Force installations. Research was conducted via Federal Procurement Data System-Next Generation (FPDS-NG) and a large number of solicitations were submitted for Full and Open Competition, with only one quote from Vindicator Technologies received (see attached Corrective Action Report samples). For the previous contract (FA5587-13-F-A018), salient characteristics were posted via GSA Advantage, 4 September 2013, to numerous vendors and Vindicator Technologies responded with the only quote. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE After researching FPDS-NG, multiple Air Force contracts have been awarded to Vindicator Technologies via Full and Open Competition solicitation procedures. Based on the solicitation results of these contracts, only one offer was received. These contracts were relative in nature to this request. The Contracting Officer (CO) will determine price fair and reasonable in accordance with FAR 13.106-3(a)(2) using comparison for the proposed price with prices found reasonable on previous purchases. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED Market research was not conducted as this is a requirement to provide hardware and installation for an existing alarm system. The Proximity Readers and installation will be procured from the original source, Honeywell-Vindicator Technologies. As state earlier, outsourcing the readers would require removing and replacing the existing Vindicator Alarm System and installing another brand name to maintain compatibility. Continuing with Vindicator Technologies will avoid compromising the integrity and functionality of the current system, while maintaining compliance to achieve accreditation. This will also prevent any delays which may occur procuring a new alarm system, to include installation. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION The Vindicator Proximity Readers, that are required to meet NSA accreditations, have specific hardware which is not compatible with alarm systems designed or provided by any other manufacturer. The cost of replacing this system to ensure compatibility with other manufacturers equipment far exceeds any benefit which may be realized by the effort. Vindicator Technologies have proven to be perfectly equipped to secure a wide range of systems across the military and government. The uniqueness of this request requires for employees to have completed full Background Investigations and have been cleared for working in a secure Government facility. Vindicator Technologies has fulfilled this requirement. The proprietary nature of the hardware controlling the system dictates the use of Vindicator products for continued interoperability and function. X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION See Section VI above. XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED Prior to any future acquisitions of this nature, additional market research will be conducted to determine if any other responsible sources have entered the market as suppliers of this specialized equipment. If other sources are available, an examination regarding quality and technical capabilities will be performed to ascertain if new equipment meet customer needs. XII. CONTRACTING OFFICER'S CERTIFICATION The contracting officer's signature on the Coordination and Approval Document evidences that he/she had determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(b)(12). XIII. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(c)).
