- This notice is published for informational purposes only and not as a request for competitive quotations. The USDA Forest Service (FS), Springfield, OR awarded a sole source contract under the authority of the test program for commercial items at 41 U.S.C. 1901, to the Oregon Military Department. USDA-Forest Service Willamette National Forest and State of Oregon-Oregon Military Department (OMD) are co-located in the Lane County Armed Forces Reserve Center at 3106 Pierce Parkway, Springfield, OR. This contract action specifically provides a method of payment to the OMD for the FS share of the facility Operating and Maintenance (O & M) cost. The costs include utility bills, facility maintenance, supplies, grounds maintenance and custodial work with an estimated value of $12,000 per month. As the owner of the site and largest shareholder in the building, OMD will receive all bills. It is not possible to have bills sent separately to the individual tenants. The sole source action was originally approved through a Determination and Finding (D&F) that the Economy Act was the appropriate instrument to procure the facility. The Department of Defense (DoD) was our partner in the acquisition, but once the facility was accepted, it was deeded to the State Military Department to manage. Therefore, since the Economy Act does not apply to the State, the FS must use a different instrument to reimburse the OMD for O & M expenses as required by the Tenancy in Common Agreement signed by the OMD and the FS in June 2005. This document provides for fair and reasonable allocation of expenses. All expenses are reviewed and approved according to the terms set forth in the Tenancy in Common Agreement prior to submission of invoices. I certify that this justification is accurate and complete to the best of my knowledge and belief. Since this effort exceeds $150,000 but does not exceed $650,000, this certification serves as approval.
