Description
This contract action was accomplished using other than competitive procedures because there is only one responsible source due to a unique capability provided, and no other supplies or services will satisfy agency requirements (FAR 6.302-1). See posted J&A for further information. JA# 201419 1. Contracting Organization:The contracting organization responsible for this action is the San Francisco District, San Francisco, CA. 2. Description of Action: This procurement is proposed to provide services for evaluating alternative financing for infrastructure/dam improvements from Large Business Alvarez-Marsal to the South Pacific Division, USACE. Consulting services are intended to define alternative financing possibilities analyze potential future project feasibility and preparing reports and briefings. This effort supports the USACE Infrastructure Strategy (UIS) Initiative. Alternative financing is also known as public-private partnerships, or P3. 3. Description of Services: USACE is seeking consultant support to evaluate the alternative financing opportunities for infrastructure/dam improvements in coordination with the non federal sponsor, or other stakeholders. This approach would require the coordination of multiple federal, state, and local stakeholders within the water supply and flood control system and identification of potential revenue sources to attract private capital investment in furtherance of USACE's goal of reducing federal funding requirements while accelerating and/or maintaining construction service levels. Accordingly, USACE is interested in evaluating the economic and fmancial feasibility of the Project using alternative financing tools. 4. Authority: The statutory authority permitting the sole sourcing of services is Far 6.302-1, 10 USC 2304 ( c ) (1), quote mark Only one responsible source and no other supplies or services will satisfy agency requirements quote mark. 5. Applicability Of Authority: Large Business Alvarez-Marsal is the only company that has sufficiently detailed knowledge ofUSACE Infrastructure Strategy, knowledge ofP3, and capability to develop and analyze financial arrangements to perform the tasks necessary to determine P3 feasibility. In this instance, the required expertise is a function of historic knowledge based on previous demonstrable work supporting P3 opportunities in the Southern California water market. Finally, Alvarez-Marsal has previously provided supported the South Pacific Division. 6. Efforts to Obtain Competition: A survey of companies that provide these kinds of services included the Basil, Bowman, Prost, Cole and Associates, Balfour-Beatty, Booze, Allen, Hamilton and others concluded that they don't have the detailed knowledge of Southern California water markets that is critical to a successful P3 effort. Although these other firms could gain the necessary expertise given time and funding, only Alvarez-Marsal can ediat ly commence the effort without expending additional USACE and contractor resources. Smce this effort is intended to provide additional resources to address critical USACE infrastructure needs, this effort will reduce USACE costs supporting active projects. Additionally, this effort timing has been constrained by HQUSACE development of sufficient guidance to provide sponsors and stakeholders with the details necessary to reshape ongoing, active projects for 2014 Water Resources Reform and Development Act compliance. As time is of the essence, the effort to obtain competition was limited. 7. Fair and Reasonable: Cost of this effort will be negotiated and is expected to be comparable to other similar efforts USACE has conducted. 8. Other Facts: Reference (40 CFR Part 141 and 21 CFR Parts 129/165). 9. Further Competition: Since this is a one-time effort, USACE does not intend to seek further competition. 10.
