- JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724. 2. Description of Action: This proposed action is for a firm-fixed-price delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government Wide Acquisition Contract (GWAC) for up to an additional 120,000 units over the next four years of Lumension Endpoint Security brand name software licenses to include maintenance and technical support and maintenance and technical support for 380,000 licenses previously acquired and is use across VA. The period of performance for this action shall be for a period of twelve months, with three 12-month option periods for continuation of maintenance and technical support for all VA-owned licenses, if exercised. 3. Description of Supplies or Services: The proposed action is for software licenses, maintenance and technical support for brand name Lumension software for VA, Office of Information & Technology (Ol&T). VA currently owns 380,000 Lumension Endpoint Security brand name software licenses that are fielded throughout the enterprise; however, OI&T requires up to an additional 120,000 software licenses over the next four years for a total of up to 500,000 licenses in order to install security monitoring capability in all VA personal computers (PC) and control the transfer of data to removable media attached to VA client PC devices. Lumension brand name software provides the functionality required to secure data and secure the transfer of data between electronic endpoint devices and external devices or media. Additionally, OI&T requires software maintenance and technical support for its existing 380,000 licenses as well as up to 120,000 new licenses. The maintenance shall include enhancing and optimizing software, remedying defects; as well as providing new fixes, patches, corrections, releases, updates, versions and upgrades to the software throughout the period of performance. Technical support includes providing assistance for the software via telephone, email, or website 24 hours a day, 7 days a week (24/7). The current contract which provides maintenance and technical support for the existing 380,000 licenses expires September 30, 2014. This proposed action will provide maintenance for up to the 120,000 licenses acquired under this action through September 30, 2015, and then provide support for up to 500,000 total licenses during the option periods by co-terming support to licenses being acquired under this action with the 380,000 existing licenses. The total estimated value of this proposed action inclusive of all options is. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. Based on extensive market research, as described in paragraph 8 of this document, it was determined that limited competition is anticipated for the required brand name software licenses and maintenance. VA currently utilizes 380,000 Lumension brand software licenses that perform necessary security monitoring functions. The licenses are installed at various locations throughout VA. VA's current endpoint security for PCs is comprised of only Lumension brand software and if another brand of software were introduced, there would be interoperability and compatibility issues with the existing software that VA currently owns and operates. Specifically, any other brand name software would not be able to communicate with the existing software due to the proprietary technical data constraints of the software. In addition, supporting multiple systems would require additional VA staff or contract support to maintain both systems. Only Lumension brand name software can ensure full interoperability and compatibility with the software currently in use. Additionally, Lumension software is the only software that provides all VA required functional capabilities including enabling administrators to quickly establish and enforce device control policies by rapidly identifying devices and then assigning permissions at a high level or all the way down to a specific application per users, user groups or even a particular user; preventing copying of private information and electronic Protected Health Information to all unauthorized removable media; ensuring non-intrusion to the existing computing environment and will not lock down communication channels or slow system performance; and allowing detailed configuration of color schemes and fonts necessary to meet Section 508 requirements for the sight impaired. If VA were to switch to another product, then clients and servers would have to be removed and replaced within the entire VA, with no control over universal serial bus (USB) access. As a result, anyone could easily plug in a device and potentially install a malicious application virus. This poses serious information security issues because much of the information VA has on file is medical records and Personally Identifiable Information (PII), therefore it is necessary for VA to comply not only with the Health Insurance Portability & Accountability Act to keep data safe but to protect all Veteran data across the enterprise. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 5.301 and 16.505(b)(2), this action will be synopsized and the Justification for an Exeception to Fair Opportunity will be made publicly available within 14 days of award on the Federal Business Opportunities Page (FBO). In addition, in accordance with FAR 16.505(a)(4)(iii)(A), this Justification for an Exception to Fair Opportunity will be posted on the NASA SEWP IV website with the solicitation. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to perform market research to determine if there are any products and/or source providers available that will enable future requirements to be competed. 8. Market Research: Market research for other sources/service providers was conducted in March 2014 to determine if the current Lumension software being utilized in VA can be supported by other service providers. Specifically, the Government's technical experts reviewed similar software, McAfee, to see if it has the same functionality as the Lumension product. Based on preliminary VA testing, McAfee software would not be able to communicate with devices using the existing 380,000 Lumension software licenses due to the proprietary technical data constraints of the software to perform the necessary security monitoring functions. Only Lumension brand name software can ensure full interoperability and compatibility with the software currently in use throughout VA at this time. Based on the above market research, it is determined that only Lumension software and maintenance support can be utilized as Lumension is the only supplier of software updates (to include enhancing and optimizing software, remedying defects; as well as provide all new fixes, patches, corrections, releases, updates, versions and upgrades to the current software) and technical support. 9.
