Description
The United States Patent and Trademark Office (USPTO) has a continuing requirement for UCD and UI/UX Support Services for the Office of Chief Information Officer (OCIO), Trademark Systems Division (TSD). The USPTO intends to negotiate and award a contract for UCD and UI/UX services to Applied Technical Systems (ATS), DUNS Number: 004821021, 3505 NW Anderson Hill Road, Suite 200, Silverdale, WA 98383-9161, a Service Disabled Veteran Owned Small Business (SDVOSB), for a period of performance, base and one (1) option year, of 2/1/2015 to 1/31/2017 (base period of performance of 2/1/2015 to 1/31/2016). The anticipated award date is 1/5/2015. This contract is a follow-on for UI work done on Contract No.: DOC50PAPT1200006, in which the period of performance ends 12/31/2014. The associated North American Industry Classification System (NAICS) code for this requirement is 541519 (Other Computer Related Services), proposed Product Service Code (PSC) is R413 (Specifications Development Services), and Small Business Size Standard is $27.5 million. TSD requires UCD and UI/UX support services as part of the Trademark Next Generation (TMNG) N-tier development effort for TMNG's portfolio of projects. Services are to include: requirements elicitation, information architecting, and front-end design and development. Services will also include continuing development and rework based on the prioritized product backlog to create a unified interface. Support includes technical skills such as: experience with Extensive Markup Language (XML) and Cloud Computing that are aimed at improving business operations; experience creating UI test plans and test cases; experience with UI integration testing and user acceptance testing; experience with UI usability testing and section 508 testing, experience creating and recording UI test scripts, experience with TMNG management tools such as Rally and Subversion (SVN), experience working with TMNG product owners and shareholders to define/refine user acceptance criteria; and experience creating and populating TMNG test data. The proposed source is ATS. USPTO has an immediate need to continue these services as a result of an existing project schedule and USPTO Strategic Plan priorities for the Trademark IT portfolio. The intent of this procurement will be to support continuation of the UI design effort and approach to ensure consistency of this design approach. The design effort and approach is expected to be completed by 2016. The intent beyond this procurement is to have competitive solicitations for the implementation projects if those projects are contemplated by the Government. We anticipate additional costs (up to $1.3 million increase) and delays (4-6 months) should a new contractor be introduced to the projects at this time. In early 2012, TSD conducted market research using focus groups across the organization to identify areas where functionality improvements are needed. The results of this research were used as the foundation for a UCD prototype effort. The objective of the prototype effort was to select a UI design for TMNG. This design is critical as TMNG will be a common website with multiple components and services. The UI will ensure a consistent look and feel across all of TMNG. ATS received several task orders against this multiple-award IDIQ contract vehicle for User Interfaces Design that resulted in a three (3) month effort that is creating a clickable prototype to include user stories. ATS has also developed TMNG's Enterprise Pattern Library, received positive customer feedback for their UCD and UI support for the TM portfolio, and successfully deployed functionality over multiple releases. ATS has consistently delivered results and exceeded expectations of the project's agile requirements. The USPTO schedule cannot be disrupted as several high priority internal and external-facing projects, namely the TMNG Internal, Trademark eFile, Trademark Identification Manual, and Trademark Electronic Official Gazette projects, would be impacted significantly in terms of milestones if this contract were awarded to another Contractor not familiar with the TMNG and UI environment at USPTO. We anticipate that there would be an approximate four to six month delay and $0.7M to $1.3M cost increase across the four (4) projects while we get a new team on-board, acclimated, and fully productive. Specific impacts to individual projects that are interdependent on these UCD and UI/UX support services being implemented are: Project Projected Delay Cost Increase Due to Delay TMNG Internal 4 - 6 months $0.4M to $0.6M Trademark E-File 4 - 6 months $0.1M to $0.3M Trademark ID Manual 4 - 6 months $0.1M to $0.2M Trademark Electronic Official Gazette 4 - 6 months $0.1M to $0.2M Total Estimated Impact 4 - 6 months $0.7M to $1.3M ATS is the only known contractor that can fulfill this immediate need based on program urgency and allow the OCIO to continue to support the implementation and production of these services. ATS is the only known UCD contractor that can provide uninterrupted service. Because of the short turn-around of this requirement and the need to ensure no disruption in the tight production schedules of this follow-on project and other interdependent projects within the TMNG portfolio, fulfilling this requirement with a different Contractor would result in additional risk and delay due to unavoidable learning curves and the need to learn USPTO procedures. Furthermore, the development has reached a point where the use of another Contractor would create substantial duplication of time and costs to the Government that is not expected to be recovered. ATS-provided support for UCD and UI/UX services is a logical follow-on to their original competed and awarded task order. Time and system-specific experience are the Agency's most critical factors driving this requirement. The experience required with the USPTO UI environment is unique and requires considerable ramp-up time in order for the contractor to complete these projects at an acceptable level of performance. Interrupted services will result in a critical impact and extreme risk, both internal and external, to the Agency's ability to perform its mission and provide IT support services to the trademark review and processing environment. Contractors are hereby notified that as a result of USPTO's exemption from the Competition in Contracting Act, the subject requirement is to be procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG), PTAG 6.1.1 (c) and the Patent and Trademark Office Efficiency Act, 35 U.S.C. 2(b)(4)(A). This notice is not a request for competitive proposals.
