- JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION Requisition No.: PR3572966 1. The Office of Acquisition Management, Regional Procurement Support Office (RPSO), Frankfurt, is conducting this acquisition for Maintenance Stage W5 Generator Service, on behalf of FAC-Frankfurt. The estimated cost is $224,936.00. 2. Nature and/or description of the action being approved. Award of a new firm fixed-price Purchase Order. 3. A description of the supplies or services required to meet the Department's needs. W5 Overhaul and service of MTU emergency power generators performed in current generator site while ensuring a safe work area through proper operation and control of Siemens switchgear. 4. An identification of the regulation permitting other than full and open competition. 41 U.S.C. 1901 and FAR 13.501(a)(1)(ii) - Only one responsible source and no other supplies or services will satisfy agency requirements. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Siemens AG has the Maintenance Contract with MTU Friedrichshafen (manufacturer of the two generators) for the complete power generation system which is comprised of the following individual components: A. The generators B. The "medium-high" and "low" voltage switchgears C. The power distribution systems These 3 components are designed to be highly integrated for reliable functionality. In addition to already being maintained by Siemens, the switchgear (item B) and power distribution systems (item C) are both comprised of Siemens components. While the Generators are integrated into these Siemens electrical systems, if a company other than Siemens AG is contracted to do the W5 Overhaul on the Emergency Generator, the other company would be required to subcontract a Siemens AG representative to oversee any work performed on the system to ensure there is no malfunction and to ensure the work is carried out in a safe manner in a hazardous area. 6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. Not applicable. 7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. Quotation was approved by SME, Neil Goudy, in OBO. 8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted. Not applicable. 9. Any other facts supporting the use of other than full and open competition. None. 10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition. None. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. None. 12.
