Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY The contracting organization responsible for this action is the 192 MSG/MSC VaANG Base Contracting Office II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED The contractual action is a Firm Fixed Price Contract for the acquisition of customer service functions: Customer Services to include CAC Card Services, DEERS, and RAPIDS on Unit Training Assembly (UTA) weekends. III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS Under the contemplated contract, HYPERION BIOTECHNOLOGY, INC., will provide the following supplies and services in sustainment of the VaANG: Customer Services to include CAC Card Services, DEERS, and RAPIDS on Unit Training Assembly (UTA) weekends for a period of time not to exceed 12 months. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION The statutory authority permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1) and the Federal Acquisition Regulation Part 6.302-1. V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) Request to award this requirement to only one responsible source. The requirement is a follow-on contract for the same services currently offered during the work week on Joint Base Langley Eustis throughout the week. Recommend sole source negotiation with recently awarded contractor to be employed at JBLE for these services under contract # FA4890-13-C-0108, Contractor: HYPERION BIOTECHNOLOGY, INC. This vendor has been provided all Government furnished facilities, property and equipment necessary to run the program for JBLE. The Government currently has no way to perform this function outside of contract. Award to any other source in the interim would result in substantial duplication of cost since all of the equipment required to complete the work associated with the contract is already installed and being operated and maintained by HYPERION BIOTECHNOLOGY, INC. The duplication of cost is not expected to be recovered through competition. In fact, if a different contractor is awarded a separate contract effort through the VaANG, there will be additional costs incurred for the VaANG to allow their contractor to change over custody of all equipment/supplies every Friday and Monday before and after the UTA. This would also require the ACC-AMIC contractor to work additional hours which may not be in the Air Force budget or which Air Force is not willing to allow, even if reimbursed. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE A notice of the Government's intention to award the sole source contract will be publicized as required by FAR 5.2. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE It is anticipated the cost will be determined fair and reasonable in accordance with FAR 8.404(d). VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED Several companies are able to perform the work. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION None X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION See Section VI above. XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED No feasible actions have been identified.
