- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Activity: Department of Veterans Affairs, Rocky Mountain Acquisition Center, NCO 19; 4100 E. Mississippi Avenue, STE 900, Glendale, CO 80246. Justification for Other than Full and Open Competition. Purchase Request Number 554-15-1-450-0019. 2.Nature and/or Description of the Action Being Processed: This justification is for a firm fixed price sole source procurement for preventive maintenance (PM) on a Benchmark LT Immuno Analyzer. The manufacturer and authorized PM service provider is Roche Diagnostics Corporation. The PM services are for Eastern Colorado Health Care System (ECHCS) to be provided at Denver VAMC, 1055 Clermont St, Denver, CO 80220. PM services are required for a base year and 4 option years for a total value of $75,665.63. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Preventive maintenance services are required on an Immuno Analyzer Stainer Model B, SN: 610311. Only Roche Diagnostics Corporation can provide this service. The contract covers all annual PM service checks, and unscheduled repairs and parts. ECHCS requires 5 years of service from 1 November 2014 through 31 October 2020. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(c) (1), as implemented by FAR 6.302.1 (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The contractor, Roche Diagnostics Corporation is the sole vendor that can provide service, repair, OEM parts, and software updates to the equipment as needed. Roche Diagnostics Corporation only authorizes its certified technicians to perform maintenance and repairs to keep systems certified and operational. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: None 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Cost to the Government will be determined fair and reasonable in accordance with FAR Part 13.106-3 comparison with similar items in a related industry. Two PM service contracts were recently awarded and show PM cost ranging from $5,458.00 to $11,836 per laboratory equipment system. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted through Government contract directory, VETBIZ, Small Business Administration Dynamic search, and GSA eLibrary. No other vendors were found to provide this PM service to meet ECHS requirements. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: As new equipment is needed in the future ECHCS will conduct market research for new systems. Procurement of these systems will be conducted on a competitive basis. The contracting officer will also conduct independent market research to identify potential sources that can satisfy requirements.
