Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 11, Richard L. Roudebush Medical Center. 1481 West 10th St. Indianapolis, IN 46202. 2237 Transaction # 583-15-1-072-0045 2.Nature and/or Description of the Action Being Processed: Biosense Webster items needed to upgrade the Carto System in the EP lab. Biosense Webster, 3333 Diamond Canyon Road, Diamond Bar, California, 91765; telephone (800) 729-9010. 3.Description of Supplies/Services Required to Meet the Agency's Needs: This is an upgrade to software and catheters already in place in the EP lab. An exact match of items listed in the quote is necessary to upgrade existing equipment. This is a firm fixed price PO with the upgrade to take place a day after after receipt of the PO (October 10, 2014). 4.Statutory Authority Permitting Other than Full and Open Competition: (X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Biosense Webster catheter software and equipment is already in use at this facility. This is a direct upgrade to existing software and equipment that are made to fit with an existing system already in place at the Indianapolis VAMC. The software and equipment must exactly match the criteria in the attached quote to work with the existing equipment. There are no other parts/software available that are compatible with the existing proprietary software and equipment. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: There is no significant action that the government procurement process could take to overcome any of the barriers to competition raised in this justification, as this is a direct upgrade to existing software and equipment that are made to fit with an existing system already in place. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: This is an upgrade to existing equipment and would be costly to replace completely. There is only one vendor and the price of $40,196 is in line with what was paid recently for similar equipment (PO 583A40190; $42,121.75). 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: There are no other vendors that are compatible with the existing proprietary software and equipment. An Internet search was conducted. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: There is no significant action that the government procurement process could take to overcome any of the barriers to competition raised in this justification. However, we will continue to monitor the market and search for additional vendors for future purchases. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
