Attachment 2: Request for Sole Source Memo Format DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 11, John Dingell VA Medical Center, Justification for Other Than Full and Open Competition to Wayne State University, for MRI services on animals for research. Details included on 2237 transaction # 553-15-1-081-0035. 2.Nature and/or Description of the Action Being Processed: This request is for a new firm-fixed price purchase order for Wayne State University (5700 Cass Ave STE 4900, Detroit, MI 48202, 313-577-3726) to provide use of a specialized small bore high field MRI machine optimized to obtain the highest quality images possible of the rats proposed in the funded study. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Service to provide use of a specialized small bore high field MRI machine optimized to obtain the highest quality images possible of the rats proposed in the funded study. The estimated cost is $17,500.00 ($175.00 per hour) for the performance period of November 1,2014 through September 30, 2015. 4.Statutory Authority Permitting Other than Full and Open Competition: ( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The application for this research was funded to obtain new and important imaging data using specialized small-bore high field MRI scanners at Wayne State University School of Medicine. The only other such MRI scanners are located in Ann Arbor. However, in addition to the increased cost of using the system in Ann Arbor, they would be scientifically unreasonable to use because travel from Detroit to Ann Arbor would introduce unacceptable variables into the experimental design due to increased exposure to noise and possible sample compromise during travel (critical considerations for our studies focused on the auditory system). All of our preliminary data in our funded proposal, as well as our previous publication on this topic, were collected using the small animal high field MRI at Wayne State University. This makes this Contractor uniquely able to ensure optimal continuity of data collection and interpretation and allow us to take the best advantage of our prior experience with this system. The 11T MRI scanner in Scott Hall at Wayne State University allows high resolution analysis of the chemical contents of the sample. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research was conducted, the only other acceptable MRI was located in Ann Arbor and it was deemed impracticable to use the system in Ann Arbor both in terms of expense and experimental design as described in section 5. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The rate of $175.00 per hour is fair and reasonable based on the IGCE of $175.00 per hour.
