- Call for Expressions of Interest in the Engineering and Environmental Management Company (EEMC) for the Commonwealth Utilities Corporation power generation and fuel transmission facilities on Saipan and Rota, Commonwealth of the Northern Mariana Islands (CNMI) A. Type of Engagement On September 26, 2014, the Federal District Court for the Commonwealth of the Northern Mariana Islands ("Court") entered a Final Order Re: Joint Stipulation among the United States, Commonwealth Utilities Corporation (CUC) & Commonwealth of the Northern Mariana Islands (CNMI) ("EEMC Order"). EEMC Order establishes an Engineering and Environmental Management Company ("EEMC") to achieve expeditious compliance with Stipulated Order Two ("SO2"), a consent agreement between the U.S. Environmental Protection Agency (EPA) and CUC and CNMI for compliance with the Clean Water Act and other environmental laws and regulations, previously entered by the Court. EPA and CUC contemplate the Court issuing a Letter of Engagement ("LoE") that would include a Fixed-Rate, Indefinite Delivery/Indefinite Quantity arrangement for the EEMC. The period of performance of the LoE is expected to consist of a four-year base period followed by a one-year award term, for a total possible period of five (5) years. As provided in the EEMC Order, after five (5) years, the LoE may be extended for continued performance of any services within the limits and at the rates specified in the LoE. The total estimated value of the LoE is to be $20,000,000 over the total period of the agreement, which includes payment for all project costs. B. Statement of Work / Project List The EEMC would furnish the necessary personnel, material, equipment, services, and facilities (except as otherwise specified), to perform projects included, but not limited to the Statement of Work/Project Descriptions provided in Attachment 1. Work will be tasked in accordance with the EEMC Order Section B1 (Attachment 2). C. Key Personnel and Fixed Labor Rates The EEMC would assign the following key personnel for the duration of the LoE: Principal Professional / Lead Project Manager Project Manager(s) The company would also provide fixed labor rates for the following labor categories. The fixed rates and fixed prices are inclusive of all indirect costs and profit. The company may propose a percentage escalation for fixed and overtime rates which could apply for specified periods of the LoE. These rates and proposed increases would be valid for the entire period of performance. LABOR CATEGORY Principal Professional Senior Engineer Engineer Junior Engineer Senior Scientist Scientist Junior Scientist IT Professional IT Technician Senior Technician Junior Technician Safety Officer/Industrial Hygienist Subcontract Specialist Foreman Equipment Operator Field Clerk Laborer Explosive Technician Surveyor Administrative D. Other Direct Costs (ODCs) and Indirect Rates ODC's include travel, subcontracting and miscellaneous ODC's, such as specialized labor, and equipment. The contractor would specify the G&A rates for each subcategory below to apply to the entire period of performance. DESCRIPTION Travel Subcontracts Other Direct Costs E. Required Reports The EEMC would prepare and deliver to the designated addressee(s) listed under distribution, the reports listed below. 1. Quarterly Progress Reports, in accordance with the EEMC Order Section C.3. 2. Work Plans, Quality Assurance Plans, Site Safety Plan(s) and Final Reports, as required by Stipulated Order Two. 3. Weekly or Monthly Progress Reports, documenting activities completed, as required. 4. Annual Expense Projection Reports, in accordance with the EEMC Order Section D.1(e) 5. Other reports as required by Stipulated Order Two and the LoE. F. Monthly Invoice and Progress Report The EEMC would furnish technical and financial progress reports and invoices as provided in the EEMC Order. G. Disclosure Requirements for Conflict of Interest During the past three (3) calendar years, has the company or any employees that will be working at this site performed work at this site/facility? If the answer is yes, describe, in detail, the nature of work the company or employee(s) performed and provide the names of the employee(s); the dates the work took place and identify the client(s) for whom the work was performed. Note: For reporting purposes, all clients including Commercial, Federal, State or local entities should be included in the check for potential conflict of interest. H. Information required for expression of interest Companies shall submit correspondence to EPA, expressing its interest in performing the duties of the EEMC, along with: - corporate information - possible subcontractors - resumes of key personnel, such as Lead Project Manager/Principal Professional and Associate Project Managers - information on specific relevant experience for performing the tasks in the Scope of Work and management of Indefinite Delivery/Indefinite Quantity Contracts - conflict of interest information discussed above These expressions of interest should be submitted via email to the reviewing parties by 17:00 November 7, 2014 Pacific Standard Time. The total email size of the expression of interest should not exceed 5 megabytes. Be advised, this sources sought posting is issued under NAICS (North American Industry Classification System) code 541620 - Environmental Consulting Services. There are also two duplicate sources sought postings issued under NAICS code 237120 - Oil and Gas Pipeline Related Structures Construction and code 541330 - Environmental Engineering Services. The reason for the duplicate postings stems from the desire for maximum public dissemination and participation. Expressions of interest will be reviewed by EPA and CUC in accordance with EEMC Order Section A.3. Additional information may be requested by EPA, prior to EEMC candidates being provided to the Court. If at any time during this process, a potential candidate is no longer interested in the EEMC position, the company is requested to withdraw its expression of interest through notification to EPA.
