- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) 1.Contracting Activity: Department of Veterans Affairs, NCO 20, for the Puget Sound VA Medical Center 2.Nature and/or Description of the Action Being Processed: This is a request for Other than Full and Open Competition to enter into a new firm fixed price contract with Roche Diagnostics for on-site, full service maintenance and repair to ensure that the Benchmark Ultra Blood Stainers are kept in proper operating condition and ready for clinical testing. In accordance with FAR 13.5 Test Program for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Purchase Request 663-15-1-213-0008 funds on-site, full service maintenance and repair to Benchmark Ultra Stainer Modules SN 312323 and 312324 located at the Puget Sound VA Medical Center. The equipment must be kept in proper operating condition and ready for clinical testing. This requirement includes all parts and service to properly provide preventative maintenance, diagnostics, phone support, on-site repairs, and software updates to ensure that all units are fully operational according to manufacturer specifications prior to departure. The estimated value of the base year is $32,590.00. The estimated total contract value is $180,080.32 for a base and four option years contract. Estimated Period of Performance for the base year is December 1, 2014 through November 30, 2015. 4.Statutory Authority Permitting Other than Full and Open Competition: The statutory authority for restricting competition is Section 4202 of the Clinger-Cohen Act of 1996 and is implemented by FAR 13.106-1(b)(2): (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Roche Diagnostics is the manufacturer of the Benchmark Ultra Stainer. Roche Diagnostics holds all licenses to the software and the unique ability and knowledge to support the Benchmark Ultra Stainers. Per a proprietary letter from Michelle Noles of Roche Diagnostics, all maintenance of the equipment and any servicing must be performed by factory-trained engineers of Roche Diagnostics. This equipment is specialized and only the manufacturer is authorized to maintain the equipment. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The contract specialist posted a special notice on FBO to publicize the VA's intent to solicit from a single source. The notice was available on October 31, 2014. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The Independent Government Cost estimate anticipates the cost to the government to be $180,080.32 for a base and four option years, however a quote provided by the Contractor on 10/17/2014 stated the actual contract price would be $171,076.30. Price reasonableness is based on a comparison of the proposed price with prices found reasonable on previous purchases of similar requirements. VA260-14-F-1588 was awarded on February 24, 2014, for service on similar equipment, with a total contract value of $174,584.79. VA260-14-F-1588 and the current requirement both require full service maintenance on two pieces of blood analyzing equipment. Additionally, the Contractor's quote was very comparable to the Independent Government Estimate of $180,080.32. If the Government was to forgo a preventative maintenance contract, individual repairs, parts and maintenance of the equipment could be higher than the yearly cost of the service agreement. The cost to the Government is considered fair and reasonable based on a comparison of prices found reasonable on previous purchases. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: a)No agency inventories have been identified that have this requirement on hand. b)A search for "Stainers" did not return any results through UNICOR. c)A search for "Stainers" proved Ability One is not able to provide this requirement at this time. d)GSA Advantage! did not located vendors that could provide the service. Roche Diagnostics does have a GSA contract however services are not included on the contract. e)A small business search under NAICS code 811219 returned 3,362 results.
