Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION UNDER 10 U.S.C. 2304(c) (2) Unusual and Compelling Urgency that the Government Would be Seriously Injured RFQ No. HSCG85-15-Q-P45205 Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by FAR Subpart 6.3 and in accordance with the requirements of FAR 6.303-1 and HSAM 3006.302-2, the justification for the use of the statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.302-2 as follows: 1. Agency and Contracting Activity. The United States Coast Guard, Surface Force Logistics Center (SFLC), Icebreaker, Buoy and Construction Tender (IBCTPL), proposes to enter into a contract on the basis of other than full and open competition. 2. Nature and/or description of the action being approved: The Coast Guard Surface Forces Logistics Center (IBCTPL) has requested to emergency Dry Dock the US Coast Guard Cutter (USCGC) SCIOTO (WLR 65504) at the below listed Contractor's Facility for compelling reasons. SCIOTO is limited on shaft speed due to the catastrophic damage on both propellers which limits engine propulsion speed and maneuverability. 3. Description of Supplies or Services: Contractor is required to perform services on the SCIOTO due to catastrophic damage. The contractor shall renew both ships propellers as per the Coast Guard Specification package. The contractor is also required to remove both rudders to remove propellers, check bearing clearances, Port and Starboard Propulsion Shafting alignment and check shafts for straightness as per the Coast Guard Specification package. 4. Identification of the Statutory Authority Permitting Other Than Full and Open Competition: The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (2) implemented by the Federal Acquisition Regulation (FAR) 6.302-2 entitled "Unusual and compelling urgency that the Government would be seriously injured unless agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open completion need not be provided for". 5. Demonstration that the Nature of the Acquisition Requires Use of the Authority Cited: CGC SCIOTO has sustained a class "Cat 3" CASREP. CGC SCIOTO is restricted from performing scheduled deployments. The CGC SCIOTO is at home moorage in Keokuk, IA and is limited on engine speed and maneuverability. It has been determined because of the loss of maneuverability this reduces their operational ability to navigate safely, greatly impacts responsibilities to ensure proper functionality of aids to navigation, and safety of the crew. The vessel has a geographic restriction to drydock facilities to within 650 river status miles as per LANTAREAINST 3100.1D. After 01 November to 15 March no transit through Melvin Price Lock and Dam during this period which limits southern drydock facilities on the Mississippi river. Obtaining certification may be possible for additional facilities but will extend the time for solicitation and award of repair contracts and more loss of operational days. 6. Description of effort made to ensure that offers are solicited from as many potential sources as deemed practical. Proposed Contract Action is being made under FAR 6.302-2 purchases conducted using simplified acquisition procedures, if unusual and compelling urgency precludes competition to the maximum extent practicable) and the Government would be seriously injured if the agency complies with the time periods specified in FAR 5.203. 7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: The Contracting Officer anticipates the cost to the Coast Guard will be fair and reasonable by comparing proposed prices with the independent Government estimate, historical pricing/previous awards, and price analysis. 8. Description of market research: Due to the nature of this casualty and the urgency requirement for its repair, this project must be awarded as soon as possible to ensure repairs are completed in a timely manner to return the cutter back to full mission capable status. If this casualty is not corrected in a timely manner USCGC SCIOTO will not be able to meet her mission requirements and the Coast Guard will be without a critical 65' Harbor Tug asset to meet Coast Guard Maritime / Navigation duties. The Coast Guard's market research located one shipyard within the vessel's geographic restricted area that is capable of accomplishing the work. 9. Any other facts supporting the use of other than full and open competition: A diving support service inspection discovered USCGC SCIOTO starboard and port propellers have several gouges, missing metal and bends on the utmost tips of several blades. CASREP message, P 072004Z OCT 2014 was issued documenting limited mobility of the vessel. 10. Agency Actions to Remove or Overcome Competition Barriers on Subsequent Acquisition(s) for the Supplies or Services: Due to the nature of this emergency casualty, the Coast Guard's ability to overcome any barrier to competition is limited. The Coast Guard will make a continuous effort to contact all shipyards and develop geographical restrictions that promote competition.
