- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval Other Than Full and Open Competition For Denver Immunohistological and Genetic Testings 1. Contracting Activity: The agency responsible for this acquisition is The Department of Veterans Affairs, VISN 19, 4100 East Mississippi Ave, Suite 900, Glendale, CO 80246. The Department of Veteran Affairs proposes to enter into a new contract on the basis of other than full and open competition for the Eastern Colorado Healthcare System Laboratory Program Office. 2.Nature and/or Description of the Action Being Processed: The Network Contracting Office 19 (NCO19) has a requirement for referral laboratory testing services including immunohistochemical staining; molecular/PCR; flow cytometry; FISH; ISH; Cytogenetic Karyotyping; Immunoflourescence; and microarrays on tissue samples. These services allow medical professionals at the Eastern Colorado Health Care System (ECHCS) to diagnose diseases and potential treatments. The risk to the government by not having these services is to potentially misdiagnose medical issues of patients. Contracting activity proposes to sole source with the incumbent vendor, Clarient, 31 Columbia, Aliso Viejo, CA 92656. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Provide specialty genetic mutation testing performed on samples to provide information for the diagnosis, prevention or treatment of a disease or assessment of a medical condition for the Denver ECHCS Lab. Each test is pre-priced (determined) during the original RFP process. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(c) (1), as implemented by FAR 6.302.1 (X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( X ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Clarient is the only vendor that can provide a complete test menu that is required by ECHCS. Other vendor can provide the equipment and reagents for ECHCS to perform the testing in house. However, ECHCS currently does not have the space, funding, and specialized personnel to do that. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable The following sources were researched and determined unacceptable, unable to perform specialized tissue tests: "ARUP "Roche Diagnostic 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The contractor was sent a RFQ on an interim contract. The Contract Specialist and the COR investigated that other vendors have limited test menu and prices are higher than Clarient. Therefore the prices are fair and reasonable in comparison to the historical prices originally established in the prior contract dated January 15, 2009. Due to volume increases, the contractor quoted a price break, offering lower prices for higher volume of tests. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted by the contract specialist seeking sources of service-disabled veteran owned small businesses, veteran owned small businesses, and small businesses on schedule and open market, none were found. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The contracting officer will continue to survey the market for new companies that enter the marketplace. Additionally, the contracting officer will discuss with the small business specialist to determine if new contractors/equipment are introduced into the marketplace that may be able to meet this requirement.
