- This is not a Solicitation of Request for Proposal (RFP). The Defense Commissary Agency (DeCA) is seeking qualified contractors for the acquisition and delivery to provide, distribute and merchandise approximately10 top selling, approved commercially available magazines to approximately 178 U.S. military commissary locations (See http://www.commissaries.com/store_locator.cfm ) for resale purposes. The successful offeror shall merchandise, order and maintain in-stock conditions consistent with commercial retail business practices, to include removal and disposal of all expired magazines at all the commissary locations. DeCA will determine the magazines placement (plan-o-gram) in the display racks. Signage concerning pricing will be provided by the commissary. The successful offeror may recommend changes and deletions of magazines based on sales increases or decreases, nonetheless any changes/deletions are at DeCA's discretion. The selection of magazines is subject to the provisions of Title 10 United States Code Chapter 147 Subchapter I, Section 2484 and Subchapter II Section 2495, Public Law 104-2-1, Section 343(a)(1), as implemented by the Department of Defense in DoD Instruction 4105. The DoD Instructions to these provisions can be found and are located at the following website: http://www.dtic.mil/whs/directives/corres/pdf/i410570_062998/i410570p.pdf. All Retail Display Allowances (RDA), Business Growth Incentives or other discounts shall be passed through to the patron to result in the lowest possible price of the magazines. The successful offeror shall provide 100% buy back on the purchase price for all unsold magazines remaining at the commissary upon expiration date. The successful offeror shall remove and dispose of all unsold magazines from the commissary no later than the expiration date under the compliance of state and local solid waste disposal requirements and in accordance with environmental and energy conservation laws. The successful offeror will be responsible for all costs incurred and associated with the removal and disposal of all these unsold magazines. The successful offeror shall sign a guaranteed sales agreement, which is standard to the industry, prior to start of the contract. Display racks are not part of this requirement. The display racks are made available by the magazine publishers as a cost of doing business, distributed among the commissaries and placed at designated register checkout stations. These display racks become store fixtures and are not a part of the contract. The successful offeror shall ensure the physical safety and protection of all magazines, to include packaging and/or receptacles used for containment, from the manufacturer to the end customer (commissary location). The period of performances are projected to consist of a base period of 24 months and three option periods of 12 months. The NAICS code for this acquisition is 424920, which sets the small business threshold at 100 employees. The successful offeror shall be registered in the System for Award Management (SAM) located at https://www.acquisition.gov, before time of award. Electronic Document Access (EDA) is a requirement for any offeror that receives a contract award resulting from a solicitation.
