Description
TASK REQUEST Title of Project: "29th National Veterans Golden Age Games (NVGAG) Secured Storage Space" Time Frame: December 12, 2014 - December 11, 2015 1.1 Task Description: Contractor shall provide all Secured Storage Space Services required as identified below. 1.2 Period of Performance: The storage will be made available Friday, December 12, 2014 starting at 12:00 pm and the last day will be Friday, December 11, 2015 at 12:00 pm. 1.3 Preferred Locations: Omaha, NE 1.4 Submit all price proposals and descriptive literature via e-mail to both: Charles HamptonandEESVendorProposals@va.gov Contract Specialist Department of Veterans Affairs PCO East - St. Louis 11152 South Towne Square St. Louis, MO 63123 314-894-6656 ext. 65101 Charles.Hampton2@va.gov Paper, faxed, or web-based proposals will not be accepted. Closing date for receipt of proposals is Thursday, December 11, 2014 at 12:00 PM CT. Requirement: The government requires secured storage space ranging between 12,000 - 15,000 square feet. Space must be indoors with forklift capability and climate controlled. Space must have adequate lighting. An alarmed security with fence is preferred, yet not mandatory if building is alarmed. The space must be accessible to the government during anytime Monday - Friday and accessible on Saturday and Sunday upon request with 24 hour request notice. Space must contain dock space with adequate turn around for tractor trailers. At least one unisex restroom is preferred. If restroom is not available, government should be allowed to have porta potties placed on site and maintained for duration of the contract. Contractor will submit all cost for secure warehouse storage space to include any labor cost associated with the preparation of this secured storage space. If more than one location is submitted an individual response for each location is required. PRICE PROPOSAL: A price proposal in accordance with the following CLIN must be provided. CLIN 0001 - Secure Storage Space to include breakout of all cost: To include price per square foot, labor (if applicable) & total combined cost. All pricing must be included in the above CLIN. The Contractor shall reject ad-hoc requests except from the Contracting Officer. Additional funding can ONLY be approved by the Contracting Officer. AWARD: The award will be made to the Offeror(s) determined to be most advantageous to the Government price and other factors considered. Award may be made with or without discussions with the offeror(s). Department of Veterans Affairs reserves the right to conduct an on-site inspection of offered facilities. All responsible sources that can meet the requirements and provide items as listed above may respond to this solicitation by submitting price and descriptive literature. A. Evaluation Factors: Size and Quality of Services and Accommodations 1. Secured Storage Space: Access and availability 2. Secured Storage Space Size: Size and quality of secured storage space. A Department of Veterans Affairs Representative may schedule a site visit to validate size and quality of secured storage space 3. Location: Omaha, NE in Proximity to downtown, convention center II. Past Performance: 1. Provide up to three references of vendors of similar requirements and scope 2. Reviews of online and commercially available customer comments. III. Price Factors: 1. Rental rates (per square footage) 2. Total space allotted as set forth in Requirements above 3. Labor Cost 4. Other discounts or prices The following factors shall be used to evaluate offers: Past Performance and Price in descending order of importance. Subfactors are approximately equal in importance. The factors other than price, when combined, are more important than price. SAM Registration - In accordance with FAR 52.204-7 System for Award Management (July 2013), contractors are required to register in the System for Award Management (SAM) database http://www.sam.gov prior to award of any contract or order. B. Invoice Submission i.All invoices must be submitted within 45 days of the originally scheduled service or project completion. In addition, please submit your invoice through the OB10 financial system for payment. If you are not enrolled in the OB10 financial system, please email USClientServices@ob10.com or call 1-877-752-0900. ii.If an invoice is submitted within 45 days of the originally scheduled service or project completion all undisputed charges will be due and payable within 45 days after receipt and approval of the final bill from Contractor. Disputed items shall not be payable until resolved. iii.Only those charges specified by the Department shall be charged to the government. iv.Payment will be made in accordance with the Prompt Payment Act (31 U.S.C. 3903) and the Office of Management and Budget (OMB) circular, A-125, Prompt Payment without any further obligations. viii. Department of Veterans Affairs agrees that the invoice will be fully paid within 30 days after the receipt of a proper invoice in accordance with the Prompt Payment Act (31 U.S.C. 3903) and the Office of Management and Budget (OMB) circular, A-125, Prompt Payment. v.In the event any charges are disputed, all undisputed amounts will be paid within 30 days. All undisputed charges not paid within 30 days will be subject to interest in accordance to the Prompt Payment Act (31 U.S.C. 3903). C. Potential Conflicts of Interest i. There is potential for conflicts of interest (see FAR Subpart 9.5, Organizational and Consultant Conflicts of Interest) due to the nature of the work contemplated under this agreement. ii. As a part of the quote, for the BPA as well as the individual order, the offeror shall provide the Contracting Officer with complete information about previous or ongoing work that is in any way associated with the contemplated acquisition and which may present a conflict of interest or the appearance of a conflict of interest. iii. The offeror shall inform the Contracting Officer whether, to the best of its knowledge and belief, it has any conflicts of interest as defined below: personnel, employees, or agents) has interests, either due to other activities or relationships with other organizations, which place it in a position that may be secure impartial, technically sound, objective assistance and advice from the competitive advantages may accrue to the Contractor in question. iv. If during the course of performance of this agreement, the Contractor discovers an organizational conflict of interest with respect to the agreement which has not been reported to the Department of Veterans Affairs. The Contractor shall notify the VA of the conflict immediately and submit a proposed mitigation plan to the VA for approval. If the conflict cannot be avoided, eliminated or mitigated to the satisfaction of the Contracting Officer, the agreement may be terminated. v. If during the course of performance of this agreement, the Contractor discovers a personal conflict of interest with respect to one of its personnel working on the agreement, the Contractor shall notify the Department of Veterans Affairs of the conflict immediately and submit a proposed mitigation plan to the VA for approval. Personal conflicts of interest will be handled by the Contracting Officer on a case-by-case basis. Depending on the severity of the conflict, alternative staff may be appointed to work on the contract. However, if substitution of personnel does not eliminate the conflict or the appearance of a conflict, the agreement may be terminated. vi. The Contractor shall also inform the Contracting Officer of interest or presence of an appearance of a conflict of interest on the part of the Contractor. D. Prohibition of Advertising of Award - The Contractor shall not refer to this award in commercial advertising, or similar promotions in such a manner as to state or to imply that the product or services provided is endorsed, preferred, or is considered superior to other products or services by the Department of Veterans Affairs. This includes advertising, or similar promotions, in all forms or electronic, broadcast, and print media. In addition, the Contractor is restricted from reproducing the image(s) of the Department of Veterans Affairs in any form of commercial advertising, or similar promotion. This includes images of official seals and buildings. Any proposed usage of such symbols must be brought to the attention of the Contracting Officer (CO). E. Termination - An order may be terminated, canceled or modified without liability by mutual written agreement of the parties at any time. The performance of an Order by either party is subject to acts of God, war, epidemic, acts and/or threats of terrorism, VA regulation, non-appropriation of funds, VA budget cuts, disaster, fire, strikes, civil disorder, or other similar cause beyond the control of the parties making it inadvisable, illegal or impossible to hold the meeting or provide the facility. The order may be terminated without penalty, damages, or option fees for any one or more of such reasons by prompt written notice from one party to the other; or if this event qualifies for termination under this clause but the parties elect to hold the event on a lesser basis, VHA is released from all guarantees, commitments, and attrition fees. F. Liability - Contractor shall indemnify and hold the VA harmless against any and all liability, loss, expense, fee, claim, suit, judgment or damage on account of (i) any injury to the person or property of any registrant, guest, invitee, employee, agent or representative of Contractor for bodily injury, including death, property damage, personal injury and discrimination arising out of the willful or negligent acts or omissions of Contractor, its agents, Contractors, employees, agents and representatives, or (ii) any breach of the promises, representations and warranties of Contractor made herein. The VA shall not be responsible for any property damage caused by Contractor's negligence or willful misconduct or the negligent or willful acts of other guests or groups in the Contractor. G. Tax Exemption - Department of Veterans Affairs, as a Federal Government Agency, is tax exempt in accordance with the following tax-exempt clauses: 52.229-1 State and Local Taxes (Apr 1984) 52.229-4 Federal, State & Local Taxes (Jan 1991) H. Insurance - The Contractor agrees to carry adequate personal property, liability and other insurance protecting itself against any claims arising from any activities conducted in the Secured Storage Space during the government's usage. The Department of Veterans Affairs, as a Federal agency, is self-insured. All claims against the Department of Veterans Affairs shall be filed in accordance with the Contract Disputes Act of 1978, as amended (41 U.S.C. 601-613). I. Indemnification - The Contractor shall indemnify, defend and hold harmless the Department of Veterans Affairs and its officers, directors, agents, and employees from and against all liabilities, actions, claims, demands, losses or damages (including reasonable attorney's fees) arising out of or resulting from (i) any breach by the Contractor or any of the terms, conditions, representations or warranties contained in this Contract, (ii) the gross negligence or wrongful acts of the Contractor or any of its employees, agents or contractors. The Department of Veterans Affairs does not indemnify. J. Compliance with Law - The United States Government is sovereign over all state and local laws. All claims against the Department of Veterans Affairs shall be filed in accordance with the Contract Disputes Act of 1978, as amended (41 U.S.C. 601-613).
