This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.The solicitation number is RFQP0620150034 and is issued as an invitation for bids (IFB), unless otherwise indicated herein.The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-78. The associated North American Industrial Classification System (NAICS) code for this procurement is 311999 with a small business size standard of 500.00 employees.This requirement is a [ Small Business ] set-aside and only qualified offerors may submit bids.The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on 2014-12-11 15:30:00.0 Eastern Time or as otherwise displayed at www.FedBid.com.FOB Destination shall be Mendota, CA 93640 The DOJ BOP Field Offices- FCI MENDOTA requires the following items, Meet or Exceed, to the following: LI 001: 1800 Lbs or 60 Cases @ 30 Lbs Total - Cheese, Sliced, (Real Cheese, Not Imitation), As specified in the Code of Federal Regulations, TITLE 21, CHAPTER I, SUBCHAPTER B, PART 133 -- CHEESES AND RELATED CHEESE PRODUCTS, Subpart B, 133.173,One of the following cheeses, (To be determined by the FSA), Pasteurized Process Cheese American, Cheddar, Provolone, Swiss or Monterey Jack. Each of the ingredients used in the food shall be declared on the label. Manufacturer?s letters will NOT be accepted in lieu of labeling., 1, LOT; LI 002: 2000 Lbs or 50 Cases @ 40 Lbs Total - Cheese, Cheddar, Natural, Loaf/Block or Shredded Coarse, (Real Cheese, Not Imitation) As specified in the Code of Federal Regulations, TITLE 21, CHAPTER I, SUBCHAPTER B, PART 133 -- CHEESES AND RELATED CHEESE PRODUCTS, Subpart B, 133.113, Rineless, Aged 30 - 60 Days, Milk Fat Solids: 50% Minimum, Moisture 39% Maximum, Wisconsin Grade A or Equivalent, Packaging: 5 lb to 60 lb sealed Bags or containers. Each of the ingredients used in the food shall be declared on the label. Manufacturer?s letters will NOT be accepted in lieu of labeling Bidder needs to indicate if cheese is Loaf/Block or Shredded Coarse), 1, LOT; LI 003: 3000 Lbs or 75 Cases @ 40 Lbs Total - Cheese, Mozzarella, Part Skim, Loaf/Block or Shredded, (Real Cheese, Not Imitation). As specified in the Code of Federal Regulations, TITLE 21, CHAPTER I, SUBCHAPTER B, PART 133 -- CHEESES AND RELATED CHEESE PRODUCTS, Subpart B, 133.156, Low Moisture, Milk Fat in Solids: 40% Minimum, Moisture 52% Maximum, Wisconsin Grade A or Equivalent, Packaging: 5 lb to 40 lb sealed Bags or containers. Each of the ingredients used in the food shall be declared on the label. Manufacturer?s letters will NOT be accepted in lieu of labeling (Bidder needs to indicate if cheese is Loaf/Block or Shredded Coarse), 1, LOT; Solicitation and Buy Attachments ***Question Submission: Interested offerors must submit any questions concerning the solicitation at the earliest time possible to enable the Buyer to respond. Questions must be submitted by using the 'Submit a Question' feature at www.fedbid.com. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, DOJ BOP Field Offices- FCI MENDOTA intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. DOJ BOP Field Offices- FCI MENDOTA is taking this action in an effort to improve both vendor access and awareness of requests and the agency's ability to gather multiple, competed, real-time bids.All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make a bid on www.FedBid.com.Offerors that are not currently registered to use www.FedBid.com should proceed to www.FedBid.com to complete their free registration. Offerors may not artificially manipulate the price of a transaction on www.FedBid.com by any means. Failure to comply with the below terms and conditions may result in offer being determined as non-responsive. As defined in the Federal Acquisition Regulation (FAR) 2.101, the terms ?offer? and ?offeror? refer to a response to a solicitation that, if accepted, would bind the submitter to perform the resultant contract. Failure to comply with this term may result in the Bid/Proposal/Quotation being determined to be unacceptable. New Equipment ONLY; NO remanufactured or "gray market" items. All items must be covered by the manufacturer's warranty. Bid/Offer MUST be good for 60 calendar days after close of Buy, unless otherwise indicated. Shipping must be free on board (FOB) destination CONUS (Continental U.S.), which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination. This solicitation requires registration with the System for Award Management (SAM) prior to award, pursuant to applicable regulations and guidelines. Registration information can be found at www.sam.gov. No partial shipments are permitted unless specifically authorized at the time of award. Delivery is required on or before the first week of January 2015. Non delivery within the required time frame will result in cancellation of award. The Bidder/Offeror/Quoter may not substitute any item/service listed on this order without prior written approval from the BOP Contracting Officer. No other individual is authorized, either verbally or in writing to change part numbers, manufacturer, quantity, delivery dates, or any other specifications of this Buy. Items/services that do not conform to descriptions and part numbers found in this Buy will be rejected at the time of delivery causing a return at the contractor's expense. (a) A variation in the quantity of any item called for by this contract will not be accepted unless the variation has been caused by conditions of loading, shipping, or packing, or allowances in manufacturing processes, and then only to the extent, if any, specified in paragraph (b) of this clause. (b) The permissible variation shall be limited to: _5__ Percent increase _5__ Percent decrease This increase or decrease shall apply to all line items. The Contractor is responsible for the delivery of each item quantity within allowable variations, if any. If the Contractor delivers and the Government receives quantities of any item in excess of the quantity called for (after considering any allowable variation in quantity), such excess quantities will be treated as being delivered for the convenience of the Contractor. The Government may retain such excess quantities up to $250 in value without compensating the Contractor therefor, and the Contractor waives all right, title, or interests therein. Quantities in excess of $250 will, at the option of the Government, either be returned at the Contractor?s expense or retained and paid for by the Government at the contract unit price. This solicitation incorporates one or more clauses by reference, with the same force and effect as if they were given in full text.
