Description
THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of the National Institute of Arthritis and Musculoskeletal and Skin Diseases (NIAMS), intends to negotiate and award a purchase order without providing for full and open competition (Including brand-name) to Miltenyi Biotec Inc., 2303 Lindberg Street, CA 95602-9562 for purchase of equipment known as Miltenyi autoMAC Pro Separator (BRAND NAME OR EQUAL: Miltenyi autoMAC Pro Separator). NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code is 334516 - Analytical Laboratory Instrument Manufacturing with a Size Standard of 500 employees. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-78, Effective 25, and November 2014. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($150,000). JUSTIFICATION This is a requirement to replace existing Miltenyi autoMAC Pro Separator equipment operated by the NIAMS office of Science and Technology, Translational Immunology Section (TIS). The equipment is used for analyses and cell isolation and separation for numerous laboratory research purposes. The equipment will replace existent autoMac Pro Separator which is part of the current laboratory Flow Cytometry. The purchase includes full service for a period of one year. Services included: planned maintenance service, repair service, loaner equipment service, technical support service. STATUTORY AUTHORITY This acquisition is conducted under the authority of 41 U.S.C. 253(c) under provisions of the statutory authority of FAR Subpart 6.302- (1) FAR 6.302-1-only one responsible source and no other supplies or services will satisfy agency requirements. PROJECT DESCRIPTION 1. autoMACS® Pro Separator - Starter Kit, Item Number: 10, Material Number: 130-092-545, Quantity: One (1). • The autoMACS® Pro Separator consists of: 1 x autoMACS® Pro Instrument 1 x MACS® MiniSampler 1 x MACS® Reagent Rack 4 3 x MACS® Chill Racks (Chill 5, Chill 15, Chill 50) 5 x 2 autoMACS® Columns 2 x 2 autoMACS® Column Substitutes 1 x autoMACS® Pro Buffer Combination Instrument software, user manual and short instructions PERIOD OF PERFORMANCE: Delivery upon Award CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by December 23, 2014 at 6 pm Eastern Standard Time (EST) and must reference number HHS-NIH-NHLBI-CSB-AR-2015-034-IM.
