- GENERAL SERVICES ADMINISTRATION Leasing Division Justification for Other than Full and Open Competition (POSTED IN FOB/REDACTED) Aguada PR, Project No. 2PR0122, Lease No. GS-02B - LPR19106 Exercise Five (5) Year Renewal Option Proposed Action : The term of the current Lease is expiring and the Government now intends to exercise a renewal option which will extend the term of the Lease for an additional five (5) years and secure the Governments occupancy to permit accommodating the operational need of the agency to remain at the current location. Description of Requirement : As the Agency has confirmed its continuing need to remain in its current delineated area and is requesting to remain in its current location, by exercising the 5-year Lease renewal option and permitting lease cancellation upon thirty (30) days written notice to the Lessor during the renewal term, remaining at this location would comply with agency's requirements and protect the Government's current occupancy. Certification of Statutory Authority : 41 U.S.C. 3304 Unique Qualifications : The current location is already constructed to meet required needs without the need for additional TI improvements. TI improvements would be required under a competitive lease procurement. Continued occupancy at the existing location also eliminates the costs associated with a physical move, including moving costs and the cost of replicating telecommunication and data installations (collectively with the costs of TI improvements, and relocation costs). Determination that Anticipated Costs will be Fair and Reasonable : The anticipated costs for the renewal term will be fair and reasonable. Based upon a review of market data known to the Lease Contracting Officer and obtained from local brokers, the total renewal annual rent is well within the market range and slightly above the average, as confirmed by a renewal analysis. However, when relocation costs are added to the shell rent and operating costs, the aggregate rental costs at a new location would increase. By staying at the current location and paying the proposed aggregate rent, the Government would realize a substantial savings over the five year renewal term. It has therefore been determined that it is in the best interest of the Government to renew the current lease at the existing location.
