- Notice of intent to award a sole source contract modification under the authority of Federal Acquisition Regulation Part 6, Subpart 6.302-1 (only one source) and FAR 52.217-8 (Option to Extend Services). The Mission and Installation Contracting Command, Installation Contracting Office at Fort Riley, KS intends to contract with Direct Packet Inc; DBA One Vision Solutions; Irving TX 75039-3910 on a sole source basis for VTC Maintenance & Service on Fort Riley, Kansas. The estimated duration of performance is 6 (six) months. The contractor shall provide maintenance and service, to include all telephone support and materials necessary to enable the covered products to perform correctly in accordance with their warranties, specifications, user manuals, descriptions and/or other related documentation, and to timely resolve each problem or error (collectively, the quote mark SERVICES quote mark ). The extension will be in accordance with FAR 52.217-8, quote mark Option to Extend Services quote mark clause which is included in the contract but was not evaluated as part of the original contract award. In the decision of Major Contracting Services, Inc., B-401472, September 14, 2009, the Government Accountability Office (GAO) held that where an agency failed to evaluate the price of an extension authorized by FAR 37.111, as implemented in FAR Clause 52.217-8, the exercise of an option under that clause constitutes a quote mark new procurement quote mark that has to meet the FAR Part 6 standards for less than full and open competition. Although this contract contains FAR Clause 52.217-8, the clause was not evaluated in accordance with the GAO's criteria. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. In doing so, interested sources must submit technical capabilities, pricing, and other information that demonstrates their ability to meet the Governments needs no later than the 15th day after this notice is posted. Detailed capabilities must be submitted to the Installation Contracting Office Fort Riley, Attn.: W911RX12F0009; 1792 12th Street; Fort Riley, KS 66442. This synopsis is not considered a request for bid/quote/proposal. No solicitation document is available and telephone requests for technical information will not be honored. No contract will be awarded on a basis of offers received in response to this notice, but offers will be used to determine if a comparable source is available and more advantageous to the Government. ( IAW FAR 5.207(c)(16)(ii) when using FAR 6.302-1 as authority) All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency.
