Description
FEDBIZOPS SOLE SOURCE DRAFT DOCUMENT/ NEXDIA INC. AUDIO SOFTWARE AND MAINTENANCE SUPPORT The Department of Justice (DOJ), Criminal Division, intends to negotiate and award a sole source purchase order with Nexdia Inc. for continuation of highly important Nexdia Audio- Finder License and Annual Maintenance Services.DOJ Criminal Division's Information Technology Support Office has primary responsibility for the fulfillment of all license and maintenance support functions for the organization. The proposed purchase order will maintain continuity Audio Finder support services.Presently, the aforementioned services are being provided to Criminal Division through under Nexdia Inc. Audio Finder Licenses and Annual Maintenance open market. The primary contract expired on Dec 15, 2014 and must be renewed. The services of Nedia Inc. are required to continue the support for Audio Finder licenses and annual maintenance supporting software for the Narcotics and Drug Division Dept of Justice users. The period of performance for the purchase order will be approximately one year beginning around Dec 16, 2014 through Dec 15, 2014.Nexdia Inc. has the necessary knowledge, experience, and staff to maintain the financial software support services required by the Criminal Division. Nexdia Inc. is the only source that can seamlessly perform the required critical services using Criminal Division's Audio Finders software licenses and maintenance which is unique to the Criminal Division. Nexdia Audio Finder has been used extensively and successfully by the Criminal Division on previous investigations. In response to government subpoenas, the international banking interest involved with trading activities and thousands of hours of trader files. Using Audio finder Criminal Division is able to rapidly ingest and analyze chat files, identify the voices of participating individuals and match the spoken representation to documented trading activity. For this support renewal requirement, the duplication of costs to provide the necessary software training and the security clearance process could not be recovered by Criminal Division through competition or any other means. The statutory authority permitting other than full and open competition for this contract extension is 41 U.S.C. 253(c)(1), as implemented by FAR 6.302-1, which provides for limiting competition in those situations where only one responsible source and no other supplies or services will satisfy agency requirements. No source other than the incumbent can satisfy this need given the transition period that would be required and conducting a follow-on acquisition for this need would result in unacceptable delays in fulfilling the agency's requirements.For the reasons noted above, Criminal Division intends to award a purchase order to Nexdia Inc. to ensure that the Criminal Division is able to meet its mission and to continue services while it completes the follow-on solution.THIS NOTICE IS NOT A REQUEST FOR COMPETTIVE QUOTES and no solicitation will issued, however any firm that believe it can satisfy the requirements must give written notification to the Contracting Officer in the form of a capability statement. All supporting evidence must be in sufficient detail that demonstrates the ability to comply with the requirements and must be furnished to the point of contact listed below by Friday Dec 15, 2014 at 12:00 PM EST. A determine by the government not to compete this proposed purchase order based on responses to notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
