Description
This is a combined synopsis and solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Request For Quotation (RFQ) number is N66604-15-Q-0482. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-78. This requirement is unrestricted with NAICS Code 511210 and small business size standard of $38,500,000.00. Contractors must be registered in the System for Award Management (https://www.sam.gov/portal/public/SAM/) to be eligible for award. Instructions for registration are available at the website. The Naval Undersea Warfare Center Division Newport (NUWCDIVNPT) intends to purchase the following sole make and model Mathworks, MATLAB software renewal maintenance products; no substitution items allowed: Qty. Product 84 MATLAB Maintenance (SUBML) 4 Simulink Maintenance (SUBSL) 2 DSP System Toolbox Maintenance (SUBDS) 7 MATLAB Report Generator Maintenance (SUBMR) 83 Signal Processing Toolbox Maintenance (SUBSG) 2 Simulink Report Generator Maintenance (SUBSR) 2 MATLAB Compiler Maintenance (SUBCO) 1 Stateflow Maintenance (SUBST) 8 Statistics Toolbox Maintenance (SUBST) The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1. It is expected to place a purchase order with The Mathworks, Inc. Natick, MA, as they are the sole developer and manufacturer of the MATLAB software, and renewal maintenance for this software is the only option meeting all of the Government's minimum requirements. Period of performance is 12 months, with a renewal period from 1 January 2015 - 1 January 2016. Delivery is F.O.B. Destination: Naval Station, Newport, RI. This procurement will be processed using FAR Part 13, Simplified Acquisition Procedures. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract is based upon responses to this notice and is solely within the discretion of the Government. All other timely offers will be considered. Other offers for other products must submit complete product information and prices. A firm fixed price (FFP) type purchase order is anticipated. FAR 52.212-1, Instructions to Offerors -- Commercial Items, applies. Evaluation will be in accordance with FAR 52.212-2, Evaluation -- Commercial Items. Evaluation factors are technical capability, price, and past performance, with each being equally important. FAR 52.212-4, Contract Terms and Conditions -- Commercial Items, and 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items, also apply. The following addenda or additional terms and conditions apply: Payment terms are electronic invoicing through Wide Area Workflow (WAWF). Offers should include price, past performance, delivery terms and if not already registered in SAM, a completed copy of the provisions at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items. Defense Priorities and Allocations Systems (DPAS) rating of DO-C9 applies. Offers must be submitted to Contracts Department, Building 1258, NUWCDIVNPT, Code 0222, 1176 Howell Street, Newport, Rhode Island 02841-1708, or emailed directly to keri.gunn@navy.mil. Offers must be received by 2:00 pm on 15 December 2014. Offers received after this date will be considered late and not considered for award.
