- THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Station Support Contracts and Simplified Acquisitions Branch (SSSA) on behalf of the National Institute of Aging intends to negotiate and award a contract without providing for full and open competition (Including brand-name) to Carl Zeiss Microscopy, LLC One Zeiss Drive Thronwoodm, NY 10594 for the purchase of a one year servie agreement for two Zeiwss LSM 510 Confocal Mircroscopes. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 334516 with a Size Standard of 500 employees. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2005-69, September 3, 2013. This acquisition is conducted under the procedures as prescribed in FAR subpart 13.5-Test Program for Certain Commercial Items STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.501(a)Soliciting from a single source. (1) For purchases exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, or industrial mobilization). and the statutory authority of FAR 6.302-1-Only one responsible source and no other supplies or services will satisfy agency requirements 41 U.S.C. 253(c)(1). And For a proposed contract exceeding $650,000, but not exceeding $12.5 million, the competition advocate for the procuring activity, designated pursuant to 6.501; or an official described in 6.304(a)(3) or (a)(4) must approve the justification and approval. This authority is not delegable. DESCRIPTION OF REQUIREMENT To procure a new service agreement for the two Zeiss LSM 510 Meta Confocal Microscope systems of the LCS that will ensure timely service and maintenance by specially trained Zeiss service engineers CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The National Institutes of Health (NIH) is the nation's leading medical research agency and the primary Federal agency whose mission is to seek fundamental knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life, and reduce illness and disability, conducting, supporting and making medical discoveries that improve people's health and save lives. The National Institute on Aging (NIA) is a part of the National Institutes of Health (NIH), conducting research into the aging phenomena. The NIA's mission is to seek fundamental knowledge about normal and pathological aging and to use that knowledge to reduce the burden of aging. Scope of Work The contractor shall provide service and maintenance for all portions of the above Zeiss LSM 510 Meta Confocal Microscope systems in order to ensure operation of the confocals at maximum performance. This includes, all computer software and hardware, optical and laser components and all other parts of the LSM 510 Meta systems, as detailed in Zeiss QUOTE number: 42015822 Specifically the contractor shall: 1.Supply all replacement parts as required with new parts in order to maintain the equipment at Original Equipment Manufacturers (OEM's) specifications. 2. Service engineer availability during the coverage period 8am-6pm, Monday through Friday to assure efficient service of the scanner. 3.Standard Coverage: The Contractor shall provide on-site remedial service and maintenance during normal working hours (from 8:00 AM to 6:00 PM local prevailing time, Monday through Friday). On-call backup service support shall be provided when the on-site service engineer is not available (e.g. holidays, vacations, illness, and training periods). 4.Regular preventive maintenance inspections and adjustments shall be performed as specified by the manufacturer. Scheduled maintenance shall be performed at a mutually agreed upon time during the Governments hours of operation. 5.Technical support and remote diagnostics shall be provided by the Contractor 24 hours per day, 7 days per week. This telephone support shall be available within one hour of the NIH placing a service request. 6. Contractor Responsibilities: The Contractor shall provide all necessary documentation, repair parts, spare parts, accessories, maintenance supplies, all special tools, test and support equipment, travel and transportation, personnel skill requirements, and other related services required in performance of maintenance tasks to keep the equipment in good operating condition, as detailed in Zeiss QUOTE number 42015822. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by December 29, 2014 12:00 noon eastern standard time and must reference number HHS-NIH-NIDA(SSSA)NOI-15-64.
