- JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for the procurement of one brand name Splunk Enterprise Perpetual Software License 100 GB/Day for software maintenance support services. This requirement is in support of the Office of Information Technology Product Development (OIT-PD) Identity and Access Management (IAM). This proposed action will be a Firm-Fixed-Price (FFP) delivery order (DO) issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government-Wide Acquisition Contract (GWAC). The period of performance for the maintenance support services shall be twelve months from date of award. 3. Description of the Supplies or Services: The proposed action is to procure one brand name Splunk Enterprise Perpetual License 100 GB/Day for software maintenance support services. The Splunk Enterprise Perpetual 100 GB/Day software maintenance support services shall include telephone support, online documentation, web forums, email, a web-based portal for submitting cases and tracking case status, updates, upgrades, maintenance releases and reset keys, defect resolution which repairs the defect in the version of the software purchased or instructs to install a newer version of the software with that defect repaired. 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c) (2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b) (2) (i) (B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized". 5. Rationale Supporting Use of Authority Cited Above: This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. Based on extensive market research, as described in paragraph eight of this document, it was determined that limited competition is viable among all the SEWP resellers for this brand name requirement. Only resellers can provide Splunk's proprietary annual subscriptions for maintenance support due to the proprietary nature of the brand name requirement. Any other source would need access to this proprietary data to provide the aforementioned services. Without fully operational Splunk software, serious disruption will occur in the ability of resources at Terremark Data Center to efficiently and effectively monitor the system health of VA and congressionally mandated systems. Specifically, the negative impacts of this degradation in service includes a reduction or suspension of system monitoring support services that will be experienced by VA and congressionally mandated systems such as VA Authentication Federation Infrastructure (VAAFI), Veterans Health Identification Card (VHIC) and Access Services. In turn, as system health is reduced, current and planned VAAFI, VHIC and Access Services customers will experience an immediate degradation of services which will prevent Veterans timely access to their health information and benefits. Utilizing any other brand name would result in interoperability and compatibility issues with the currently fielded Splunk software. If another brand name item was to be utilized it would not be able to communicate with the existing Splunk license due to the proprietary code of the software. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. It was determined however that limited competition is viable among authorized resellers for this brand name effort. In accordance with FAR 5.301 and 16.505(b)(2), this action will be synopsized at award on the Federal Business Opportunities Page and the justification will be made publicly available. In accordance with FAR 16.505(a)(4)(iii)(A), the justification will be posted with the request for solicitation on the NASA SEWP IV GWAC. 7. Actions to Increase Competition: Although the Government is limiting competition as a result of specifying a brand name item, there are several authorized resellers of the Splunk Enterprise Software Maintenance Support on the NASA SEWP IV GWAC. Finally, in order to remove or overcome barriers to competition in future acquisitions for this requirement, the agency will work with the program office to perform additional market research so that other solutions can be considered. 8. Market Research: The Government's technical experts conducted market research to ascertain the ability of any other source, other than a Splunk reseller, that can provide the aforementioned services. VA technical experts conducted market research in October of 2014 by researching other similar brand name items. Specifically the Government reviewed software support from Hewlett Packard's ArcSight as well as Tripwire. The aforementioned brands could not operate in the current environment due to interoperability and compatibility issues. It was confirmed after speaking with Splunk that the software currently contains proprietary information and only Splunk and its resellers can provide the software maintenance support. While other sources possess general capabilities needed to provide similar services, no other source was found to meet VA's needs without access to the proprietary information. Additional market research was conducted by utilizing the Manufacturer Look up tool on the NASA SEWP IV GWAC website. The search identified 25 Splunk, Inc. resellers; four Value Added Resellers (VARs) and Computer System Original Equipment Manufacturers from Group A, five Service-Disabled Veteran-Owned Small Business VARs from Group B, nine small business VARs from Group C, and seven large business VARs from Group D. The market research demonstrates that adequate competition exists amongst Splunk, Inc. resellers on the NASA SEWP IV GWAC. 9. Other Facts: N/A
