- The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with ASML US of Tempe, Arizona for the purchase of a service and maintenance plan for NIST's existing ASML PAS5500/275D i-Line stepper lithography system under other than full and open competition by the authority of FAR subpart 13.106(1)(b). NIST has a requirement for a multiyear service and maintenance plan for its ASML PAS5500/275D i-Line stepper lithography system which supports research in the Center for Nanoscale Science and Technology (CNST) user facility as a shared resource accessible to researchers from industry, academia, NIST, and other government agencies through collaboration. Due to its use as a shared resource in a user facility, it is imperative that the instrument be serviced regularly and repaired promptly in order to keep downtime to a minimum. ASML deploys service engineers who are fully trained and certified on its proprietary ASML COACH diagnostic software. This proprietary COACH diagnostic software, which is available exclusively to ASML engineers, serves as an up-to-the-moment service and maintenance manual describing in detail the proper procedures to repair and maintain the ASML stepper. Having access to this diagnostic software is critically important as the ASML stepper is a very complicated system made up of many electrical and mechanical subsystems and components. The ASML COACH software explains in detail the operation, diagnostics, and repair of all the components found on the stepper and provides comprehensive guidance to the service engineer on how to perform maintenance and repair operations correctly. In addition, ASML is the only source for factory-certified, OEM replacement parts. ASML does not sell replacement parts through distributors or third-party service companies. A factory-trained engineer with experience in ASML stepper systems and the COACH diagnostic software is required for comprehensive service and maintenance of this instrument. ASML COACH diagnostic software and factory-certified parts are proprietary and are available exclusively through ASML US. ASML US is the only contractor that can provide comprehensive service and maintenance for the ASML PAS5500/275D i-Line stepper lithography system. Therefore, ASML US is uniquely qualified to provide the required service and maintenance. Delivery shall be FOB Destination, Gaithersburg, MD, and be completed in accordance with the Contractor's commercial schedule. This requirement is expected to be awarded in April, 2015. The North American Industry Classification System (NAICS) code for this acquisition is 811219, and the size standard is $20.5M. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 3:00 p.m. (EST) on January 23, 2015. Inquiries will only be accepted via email to paula.wilkison@nist.gov. No telephone requests will be honored. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
