Description
THIS SOLICITATION IS A BRAND NAME TO FURNISH AND INSTALL TWO NEW 5-TON BARD AIR CONDITIONING UNITS AT THE NATIONAL WEATHER SERVICE FORECAST OFFICE (WFO) IN MILLINGTON, TN. (I) This is a solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice and in accordance with the simplified acquisition procedures authorized in FAR Part 13. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (II) This solicitation is issued as a request for quotation (RFQ). Submit written quotes on RFQ Number NWWP9223-15-00854 (III) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-79. (IV) This solicitation is being issued as a small business set-aside. The associated NAICS code is 238220. The business size standard is $15.0 million. (V) This solicitation is to furnish and install two 5-ton Bard Air Conditioning units, disconnect, remove and dispose/recycle the two existing 5-ton Bard units and ground-mounted condensing units. in accordance with the attached Statement of Work. Line Item 0001 - Furnish and Install Two (2) 5-ton wall mounted R-410a Bard cooling units, R-410a Bard cooling units, P/N W60A2-B0ZXXXX2J to be installed in the National Weather Service Office - Mobile Alabama. Services, Non-Personal, to provide labor, material, and equipment, unless otherwise provided herein to replace two bard air conditioning units in accordance with the attached Statement of Work. The National Weather Service Radar Operations Center in Norman, OK competed and selected Bard Manufacturing Company, Inc., (BMC) as the sole authorized source for cooling equipment for the Nexrad Radar Shelters cooling requirements. All Nexrad Radar facilities use standardized equipment to save initial cost and reduce maintenance. The Bard units are dimensionally configured with supply and return air vents in a pattern already in place for the Fibrebond radar shelters and require no other wiring preparation to install. The refrigeration circuits are all internal and the only installation work involves connecting the power and controls circuits and sealing the bolt mounting flange to the radar shelter. The reliability of the Bard units is a proven factor, and the units are produced and available with the voltage, cooling, ventilation, air filtration, color, evaporator/condenser coil configurations and control modules required by the National Weather Service for installation at all Nexrad Radar Shelter sites. (VI) Description of requirements is as follows: See attached Statement of Work which applies to this procurement. (VII) THE PERIOD OF PERFORMANCE SHALL BE AS FOLLOWS: From 90 Days from Date of Award (VIII) FAR 52.212-1, Instructions to Offerors -- Commercial Items (APRIL 2014), applies to this acquisition. The offeror shall submit a quote for each line item. NOTICE TO OFFERORS: Instructions for submitting quotations under this request for quote must be followed. Failure to provide all information to aid in the evaluation may be considered non-responsive. Offers that are non-responsive may be excluded from further evaluation and rejected without further notification to the offeror. Quotes shall be fully executed and returned and any acknowledgements of solicitation amendments. Submit quotations to the office specified in this solicitation at or before the time specified in the solicitation. Email quotes are preferred and can be sent to Joseph.feibel@noaa.gov. At a minimum the contractor shall provide the following information: a) Point of contact name, telephone and E-mail address. b) DUNS Number c) At least two references of similar projects including company name, point-of-contact, phone number and email address (if available) Provide all evaluation criteria in accordance with 52.212-2 in this package. 1352.215-72 Inquiries (Apr 2010) Offerors must submit all questions concerning this solicitation in writing to Joseph.feibel@noaa.gov. Questions should be received no later than 11:00 AM. EST, December 31, 2014. Any responses to questions will be made in writing, without identification of the questioner, and will be included in an amendment to the solicitation. Even if provided in other form, only the question responses included in the amendment to the solicitation will govern performance of the contract. (End of clause) 52.237-1 Site Visit (Apr 1984) Vendors are urged to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award. Offers will be evaluated based on price and the factors set forth in paragraph (a), and award will be made to the firm offering the best value to the Government. Paragraph (a) is hereby completed as follows: Evaluation will be based on the following: 1. Price. 2. Past Performance. Quotes shall include at least two references relevant to the offeror's performance to provide the service being solicited. References must include the company name and contact person's name, phone number and email. The Contractors past performance evaluation will be based on responsiveness, quality, and customer services. This is a PASS/FAILevaluation. (X) 52.212-3 The offeror must submit a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (OCT 2014), with its quote. The offeror shall complete the annual representations and certifications electronically in System for Award Management at https://www.sam.gov/portal/public/SAM/. An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via http://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the System for Award Management (SAM) website, the offeror shall complete only paragraphs (c) through (o) of this provision. (a) Definitions. As used in this provision- "Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program. "Forced or indentured child labor" means all work or service- (1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or (2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties. "Inverted domestic corporation", as used in this section, means a foreign incorporated entity which is treated as an inverted domestic corporation under 6 U.S.C. 395(b), i.e., a corporation that used to be incorporated in the United States, or used to be a partnership in the United States, but now is incorporated in a foreign country, or is a subsidiary whose parent corporation is incorporated in a foreign country, that meets the criteria specified in 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c). An inverted domestic corporation as herein defined does not meet the definition of an inverted domestic corporation as defined by the Internal Revenue Code at 26 U.S.C. 7874. "Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture. "Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate- (1) Are conducted under contract directly and exclusively with the regional government of southern Sudan; (2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization; (3) Consist of providing goods or services to marginalized populations of Sudan; (4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization; (5) Consist of providing goods or services that are used only to promote health or education; or (6) Have been voluntarily suspended. "Sensitive technology"- (1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically- (i) To restrict the free flow of unbiased information in Iran; or (ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and (2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)). "Service-disabled veteran-owned small business concern"- (1) Means a small business concern- (i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and (ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
