- Solicitation This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTES ARE BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. The Solicitation number is AG-56A1-P-15-0006 and is being conducted as a 100% Small Business Set-Aside, under the procedures of Part 12 and 13, for a brand name or equal purchase. The North American Industrial Classification System (NAICS) number is 511210. The solicitation incorporates provisions and clauses that are in effect through Federal Acquisition Circular 05-78 dated December 26, 2014. The US Forest Service intends to award a Firm-Fixed price type contract for: ARCOM Masterspec specification writing system subscription. Requested items have been identified by a "brand name or equal" description and shall be quoted as such. This justification is based on compatibility. The required subscription is for previously procured software, however, quotes offering "equal" products (including products of the brand name manufacturer other than the one described by the brand name) will be considered if such products are clearly identified in the quote and it is determined by the Forest Service to meet fully the salient characteristic on the above products. Unless the vendor clearly indicates in their quote that they are offering an "equal" product, the quote shall be considered as offering a brand name product referenced in this synopsis/solicitation. If the offeror proposes to furnish an "equal" product, the brand name of the product to be furnished shall be provided in the quote. If requested by the Forest Service, each offeror shall submit a sample of the items he/she proposes. Award shall be made resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The provision at FAR Clause 52.212-1, Instructions to Offerors (JUL 2013), and addendum is incorporated. ADDENDUM to 52.212-1, modify (b) Submission to offers: "Submit signed and dated offers to the attention of Christopher Frank, Purchasing Agent, via email to: chrisfrank@fs.fed.us. All quotes are due by 3:00PM CST, Friday January 23, 2015. See the attached solicitation. Delivery of items shall be immediately after-receipt-of-order. Incorporated by reference are FAR Clauses 52.212-4, Contract Terms and Conditions (SEPT 2013), and 52.212-5, Contract Terms and Conditions Required to Implement Statutes and Executive Orders (JAN 2014), Subsection (a), (b), 1, 5,10, 13, 21,23, 24, 25, 26, 33, 43 and (e). ADDENDUM to Clause 52.212-4, add 52.211-6-BRAND NAME OR EQUAL (AUG 1999); 52.216-2-ECONOMIC PRICE ADJUSTMENT - STANDARD SUPPLIES (JAN 1997); 52.216-18-ORDERING (OCT 1995); 52.233-2-SERVICE OF PROTEST (NOV 2013). The Head of the Contracting Activity, US Forest Service - Eastern Regional Office, 626 E Wisconsin Ave, Suite 300, Milwaukee, WI, shall serve as the Forest Service contact in accordance with 52.233-3-PROTEST AFTER AWARD (AUG 1996). Offeror Representations and Certifications (MAY 2011) apply, 52.212-2 Evaluation-Commercial Items (JAN 1999) is incorporated by reference and applies to this acquisition. ADDENDUM 52.212-2 (a)-Award will be based on technical capability of item offered to meet the Government requirement and price. The Period of Performance shall be from date of award through January 31, 2016, with the potential of up to four (4) option years at the Governments discretion. All vendors must be registered in SAM to receive government contracts. The Forest Service began using a new payment system (WWW.IPP.GOV ) which must also be registered in.
