Description
THIS IS A NOTICE OF INTENT TO SOLE SOURCE, NOT A REQUEST FOR A PROPOSAL. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The New Orleans District, US Army Corps of Engineers (USACE) intends to negotiate on a noncompetitive basis in accordance with FAR 6.302-1(a) (2) - Only one or a limited number of responsible sources and no other supplies or services will satisfy agency requirements. This Notice of Intent is NOT a request for competitive proposals. The New Orleans District, US Army Corps of Engineers (CEMVN) has a requirement to purchase Bottomland Hardwood-Wet (BLH-Wet) Mitigation Bank Credits located in the Barataria Basin watershed as specified below, to compensate for unavoidable habitat losses caused by the construction of the West Bank and Vicinity (WBV) Hurricane and Storm Damage Risk Reduction System (HSDRRS). As part of the plan, CEMVN will purchase BLH-Wet mitigation bank credits in the Barataria basin to mitigate BLH-Wet habitat impacts caused by the construction of the WBV HSDRRS. Enterprise mitigation bank meets all of the following qualifications to be eligible to sell credits to satisfy WBV HSDRRS mitigation requirements. For the proposal to be considered responsive and for the contractor to be considered responsible, the mitigation bank shall: be approved by CEMVN and in full compliance with its Mitigation Banking Instrument (MBI), its other legal instruments (such as its conservation servitude and its financial assurances) and the standards set forth in 33 CFR Part 332; be physically located within the Barataria Basin as defined by the following boundaries: in Louisiana, south and west of the Mississippi River, north of the Gulf of Mexico and east of Bayou Lafourche provide the habitat type that matches the habitat type being mitigated; have mitigation credits assessed using version 1.0 of the Wetland Value Assessment (WVA) Community Model available to fully compensate for the impacts to the particular habitat to be mitigated; and have a duly-recorded perpetual conservation servitude/easement. NAICS: 523910. Total value is estimated to cost between $500,000 and $800,000. The request for proposal will be issued on or about 4 February 2015, with a proposal due date established. Enterprise is the only company who has the necessary mitigation bank credits for the USACE New Orleans District to purchase. Utilization of a different contractor would create unacceptable delays in fulfilling the agency's requirement, because other companies would have to go through the approval process which is lengthy and timely. Parties must be registered in SAM (sam.gov) and may express their interest, accompanied by supporting literature, to the Contracting Officer no later than 2 February 2015 by 12:00pm Central Standard Time. Responses should be sent to charles.r.zammit@usace.army.mil and michelle.y.lappen@usace.army.mil. Telephone responses will not be accepted. Information received will be for the purpose of determining whether or not to conduct a competitive procurement; therefore, the initial submission must include adequate information for the Contracting Officer to determine whether the contractor is capable of providing the required services. Additional information will not be requested. The determination to conduct a competitive procurement based on responses to this notice is solely within the discretion of the Contracting Officer. This Notice of Intent is NOT a request for competitive proposals.
