- The U.S. Fish and Wildlife Service, Region 3, Bloomington, MN intends to award a sole source firm fixed price order under authority of FAR 6.302-1, Other than Full and Open Competition procedures, and FAR Part 13 Simplified Acquisition procedures to Waters Technologies Corporation for the acquisition of High Pressure Chromatograph (HPLC) Empower 3 Software upgrade. HPLC software is used to quantify lampricide concentrations during sea lamprey stream treatments and toxicity bioassays throughout the Great Lakes Regions at FWS, Marquette Biological Station; Michigan. Waters HPLC has been used by the program for over 20 years and has proven to be a robust and dependable instrument for the field use as required by the program, and its results are used to assess lampricide treatment effectiveness and ensure compliance with state and federal regulations. This product is proprietary to Waters Technologies Corporation and the company is a sole re-seller of their manufactured software and equipment. Therefore it is critical that the components are purchased from the manufacturer. These activities have followed a decision based framework and reaching a critical phase where continued collaboration with Waters Technologies Corporation is imperative in order to maintain consistency throughout the Program, and interoffice compatibility. The North American Industry classification (NAICS) code is 334516, and the size standard is 500 employees. This notice is not a request for competitive proposals; however, firms with expressed interest and capability are encouraged to respond. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government.
