Description

This is a combined synopsis/solicitation for commercial items prepared in accordance with the Federal Acquisition Regulation (FAR) format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. The government intends to issue a Purchase Order in accordance with FAR PART 13.106 for the requirement under Simplified Acquisition Procedures. The solicitation number is 1142624 and this solicitation is issued as a Request for Quote (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-78 effective December 26, 2014. The associated North American Industry Classification System (NAICS) Code is 333314 ‐ Optical Instrument and Lens Manufacturing. FSC Code is 6650. Small Business Size Standard is 500 employees. Acquisition is unrestricted. Contract Type: Commercial Item-Firm Fixed Price. REQUIREMENTS: Part I: General Information A. Introduction The U.S. Food and Drug Administration, National Center for Toxicological Research (NCTR) has a requirement for one (1) upright microscope, to include shipping, inside delivery, installation, testing, onsite training, and post-warranty maintenance for up to four (4) 1-year option periods, for Zebrafish embryo/3D sample visualization, evaluation and imaging in high magnification of specific specimen regions, both anatomic and morphologic. B. Scope The Contractor shall provide one (1) completely configured upright microscope system to optimally achieve the work described above to include, but not be limited to, all necessary components, accessories, software, components, hardware, drivers, adapters, tubes, monitors/workstations, plates, objectives, filters, cameras, condensers, stages, modules, slides, control and display panels, lenses, eye/nose pieces, clamps and holders, etc., as a seamless, turn-key solution. Salient Characteristics of requirements At a minimum, the upright microscope system: • Shall be a newly manufactured, not be used, refurbished, or previously used for demonstration. • Shall be capable of cool illumination capturing of both fluorescent and bright-field images as still and time-lapsed with video capture. • Shall be capable of capturing high resolution (minimum of 5 megapixels), color images. • Shall be capable of 6D imaging. • Shall be capable of temperature control of samples to room temperature with ability to increase to a minimum of 28°C. • Shall include at least 4x, 10x, 20x, 40x (water immersion) and 60x (water immersion) objectives. • Shall include filter cube DAPI and phase-contrast optics. • Shall include filer cube FITC and phase-contrast optics. • Shall include filter cube TRITC and phase-contrast optics • Shall include a minimum of a one (1) year parts and labor warranty from date of acceptance, to include software updates. Minimum Installation, Testing, Training and Documentation Requirements: The Contractor shall provide all labor, travel, and tools to install the equipment at the address provided below, to include freight and inside delivery. Equipment shall be tested once installed to verify all aspects of the system are operating within parameters of the required specifications. The Contractor shall demonstrate upon completion of installation and testing that the item meets all specifications. Upon acceptance of the system, on-site training shall be given by the Contractor as necessary to provide adequate information to end-users on system operator familiarization and maintenance procedures. All standard information on the equipment, including but not limited to User Manuals, Operation and Maintenance (O&M) Manuals, Material and Safety Data Sheets (MSDS), troubleshooting guides and any other applicable documentation, shall be provided upon installation of the system. Minimum Service Requirements: At a minimum, the Contractor shall provide the following services during the option periods, if exercised, for post-warranty maintenance: - One (1) preventative maintenance visit per contract year inclusive of all labor, travel, and parts, components, subassemblies, etc. necessary to provide the service. - Unlimited on-site corrective/remedial maintenance/repairs to be scheduled within ten (10) calendar days from service call. On-site repair service shall be inclusive of all labor, travel, shipping, certified replacement parts, components, subassemblies, etc. needed to return the system to operational capacity. - Unlimited technical application/support and trouble-shooting expert assistance (e.g., telephone-based, email-based, website-based, etc.), Mondays - Fridays (excluding Federal Holidays) between the hours of 8:00 AM - 5:00 PM Central Time. - Formally trained (including Bio-Safety Level II qualified as needed) and certified technicians/engineers for all maintenance and repair activities performed, following Original Equipment Manufacturer (OEM) specifications, manuals, and service bulletins, using new OEM replacement parts, components, subassemblies, etc. - Unlimited software and firmware updates. - The Contractor shall, commensurate with the completion of each service call (inclusive of warranty service), provide the end-user of the equipment with a copy of a field service report/ticket by email identifying the equipment name, manufacturer, model number, and serial number of the equipment being serviced/repaired and detailing the reason for the service call, a detailed description of the work performed, the test instruments or other equipment used to affect the repair or otherwise perform the service, the name(s) and contact information of the technician who performed the repair/service, and for information purposes, the on-site hours expended and parts/components replaced. In addition, the Contractor shall provide a written report to the FDA Contracting Officer's Representative and Contract Specialist by email, summarizing all maintenance and repair activities (including warranty work) each time service and/or repair is performed. Failure to inspect the installation location will not relieve the successful Offeror from fully meeting the requirements of the resulting contract at the price offered. Offer Submission Instructions The government is not responsible for locating or securing any information, which is not identified in the offer. To ensure information is available, offerors shall furnish as part of their quote all descriptive material necessary for the government to unequivocally determine the equipment offered meets or exceeds the technical requirements, and the system will absolutely support FDA's stated need. The quote shall provide information on any turn-key solutions to meet the intended application, inclusive of all necessary components, accessories, software, components, hardware, drivers, adapters, tubes, monitors/workstations, plates, objectives, filters, cameras, condensers, stages, modules, slides, control and display panels, lenses, eye/nose pieces, clamps and holders, etc. All proprietary information shall be clearly marked. Offeror shall include a price breakout for all components within Item No. 0001's e extended total, to include detailed description, catalog/part number, quantity, and unit price of each accessory or ancillary item to the system. Any items offered on GSA Contract shall be indicated on offer as such. The post-warranty maintenance periods will not be funded at point of equipment purchase. If exercised, funding will be obligated individually each year for the option period exercised via contract modification; the option periods shall be priced accordingly. The period of performance for the option periods in any resultant award will be estimated based on the date of award, estimated ultimate delivery of Item No. 0001, and applicable warranty period. If/when Option Period 1 is exercised, the periods of performance for all options will be firmed via modification. Prices provided shall be valid through September 30, 2015. Award subject to availability of funds. Price quotes shall be F.O.B. destination inclusive of shipping & handling expenses. Evaluation Approach The Government will award an order resulting from this solicitation to the lowest priced technically acceptable responsible offeror. Offers will be evaluated on their ability to meet the minimum technical requirements. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options does not obligate the Government to exercise the option(s). The lowest priced quote will be evaluated first. If the lowest priced quote is not technically acceptable, the next lowest priced quote will be evaluated and so on until a technically acceptable quote is determined. Service Contract Act Exemption This solicitation is being issued under the premise that the Contractor will certify that the post-warranty maintenance services are exempt from the Service Contract Act per the conditions set forth in FAR 52.222-48 & FAR 22.1003-4(c). If this is the case and the Contractor certifies that is exempt under the terms and conditions of 52.222-48, then clause 52.222-51 will flow per usual from this solicitation to the resulting order. In the event that a Contractor does not make this certification, traditional Service Contract Act clauses 52.222-41, and 52.222-43 shall be included in the resulting order award as well as Wage Determination WD 2035 (Rev.16): http://www.wdol.gov/wdol/scafiles/std/05-2035.txt?v=14 FAR 52.222-48 - Exemption From Application Of The Service Contract to Contracts For Maintenance, Calibration, Or Repair Of Certain Equipment - Certification (May 2014) (a) The offeror shall check the following certification: CERTIFICATION The offeror [ ] does [ ] does not certify that- (1) The items of equipment to be serviced under this contract are used regularly for other than Government purposes, and are sold or traded by the offeror (or subcontractor in the case of an exempt subcontractor) in substantial quantities to the general public in the course of normal business operations; (2) The services will be furnished at prices which are, or are based on, established catalog or market prices for the maintenance, calibration, or repair of equipment. (i) An "established catalog price" is a price included in a catalog, price list, schedule, or other form that is regularly maintained by the manufacturer or the offeror, is either published or otherwise available for inspection by customers, and states prices at which sales currently, or were last, made to a significant number of buyers constituting the general public. (ii) An "established market price" is a current price, established in the usual course of trade between buyers and sellers free to bargain, which can be substantiated from sources independent of the manufacturer or offeror; and (3) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract are the same as that used for these employees and equivalent employees servicing the same equipment of commercial customers. (b) Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services. If the offeror certifies to the conditions in paragraph (a) of this provision, and the Contracting Officer determines in accordance with FAR 22.1003-4(c)(3) that the Service Contract Act- (1) Will not apply to this offeror, then the Service Contract Act of 1965 clause in this solicitation will not be included in any resultant contract to this offeror; or (2) Will apply to this offeror, then the clause at 52.222-51, Exemption from Application of the Service Contract Act to Contracts for Maintenance, Calibration, or Repair of Certain Equipment--Requirements, in this solicitation will not be included in any resultant contract awarded to this offeror, and the offeror may be provided an opportunity to submit a new offer on that basis.
