- This is a Sources Sought notice for the General Services Administration's (GSA's) expected requirement for support services under the Telecommunications Regulatory Intervention Program (TRIP). This program is currently awarded as Rate Intervention Program. GSA -- on behalf of the of Federal Executive Agencies (FEAs) and in cooperation with the Department of Defense (DOD) -- represents the government in judicial and administration proceedings conducted by the Federal Communications Commission (FCC), State Public Utility Commissions (PUCs) and similar programs. Furthermore, GSA develops and manages telecommunications' acquisition programs on behalf of the federal government. Policy, regulation, and other market trends can affect these acquisitions. The anticipated requirement is for technical expertise and advice pertaining to telecommunications' services regulation and policy. The effort is for the preparation of periodic regulatory monitoring reports setting forth the status and potential impact of current regulatory activities and proceedings. Additional services and deliverables may be requested as required. These may include written and oral reports and presentations related to legal, contractual, financial, economic, and regulatory matters falling within the parameters of the scope of work set forth below: 1.IMPACT ANALYSIS: Evaluating, analyzing, and assessing the strategic impact of FCC/PUC activities including tariff filings, investigations, rate/oversight proceedings, bankruptcies, mergers, Special Construction, IP, Broadband issues, migration away from legacy networks, licensing, and rule-making. 2.LITIGATION/NEGOTIATION ASSISTANCE & DEVELOPMENT: Developing position documents and presentation materials to support on-going negotiations, defend established policies, or examine specific matters at issue before regulatory or standards' bodies including, but not limited to, the FCC, PUCs, and other entities with missions tied to telecommunications. Assisting litigating counsel and delivering expert testimony before telecommunications' regulatory bodies. 3.PRICING & MARKET ANALYSIS: Analyzing the telecommunications' marketplace with respect to rate development, surcharges, tariffs, taxes, and pricing structures, including but not limited to, emerging special issues, e.g., Special Construction, migration away from legacy networks, telecom requirements' definition, IP, and Broadband. 4.REGULATORY FILINGS: Preparing filings on telecommunications' matters to boards, commissions, and other regulatory or judicial entities. 5.REGULATORY ENVIRONMENT & TRENDS: Assessing the impact and identifying the relevance of significant industry activities, investments, events, trends, rules, and rulings. Examples of specific services within these five areas may include, but are not limited to the following: a)Review the written material associated with the FCC, State PUCs, judicial and administrative forums telecommunications' tariff filings or rate proceedings; b)Identify the FCC, State PUCs, judicial and administrative forums telecommunications' tariff filings, rate proceedings, and specific issues that have an impact on the Federal Executive Agency's (FEA's )procurement of telecommunications' services; c)Review the prior orders of the FCC, State PUCs, judicial and administrative forums which have a bearing on the given telecommunications proceeding; d)Meet with FEA personnel to develop an overall strategy and specific work plan for the given FCC, State PUCs, judicial and administrative forums telecommunications' proceeding or study; e)Meet with FEA personnel to become familiar with FEA's current and planned telecommunications requirements; f)Prepare in a timely fashion the written material needed to present FEA's positions for pricing telecommunications services to the FCC, State PUCs, judicial and administrative forums. The work will be prepared in suitable form, proper format and with sufficient copies for filing with the FCC, State PUCs, judicial and administrative forums and service all parties, as necessary; g)Prepare written cross examination questions, exhibits and other materials for use by FEA attorneys in the cross examination of the other parties to FCC, State PUCs, judicial and administrative forums telecommunications proceedings; h)Prepare and/or present telecommunications' testimony, exhibits, and other materials to FCC, State PUCs, judicial and administrative forums and appear for cross-examination, if necessary; i)Attend selected telecommunications hearings called by the FCC, State PUCs, judicial and administrative forums, settlement conferences and meetings of the parties to provide technical assistance to FEA attorneys and participants; j)Prepare the FCC's, State PUCs', judicial and administrative forums' pre-hearing, hearing and post hearing materials on pricing telecommunications needed by the FEAs; k)Provide assistance in the preparation of FCC's, State PUCs', judicial and administrative forums' pre-hearing, hearing, and post hearing telecommunications' materials needed by the FEAs; l)Review final telecommunications orders or opinions of the FCC, State PUCs, judicial and administrative forums and prepare reports that include: a summary of the proceeding; an analysis of the FCC's, State PUCs', judicial and administrative forums' decisions and new rates and their effect on FEAs' current and planned telecommunications' procurements; and recommendations for future telecommunications' strategies and operations; m)Gather data about the price and/or value of telecommunications' services; n)Investigate, study and prepare reports on the prices and/or value of telecommunications and services, and other aspects of such services important to GSA's network and telecommunications' responsibilities including Broadband, Special Construction, and other emerging issues; o)Investigate, study, and prepare reports on telecommunications-related fees, surcharges and taxes, and the accuracy of such items appearing on invoiced prices submitted by carriers under contract. p)Investigate, study, and prepare reports on the impact of FCC's and State PUCs' rules and rulings on GSA's telecommunications contracts. q)Targeted research studies as needed, e.g., tariff rates per state for the most commonly used services; Government pricing in relation to pricing and pricing structures for large customers in the commercial marketplace. r)Research and prepare other studies and analyses requested to assist GSA's broad network and telecommunications' responsibilities. s)Prepare regulatory and price impact studies related to Special Construction including installation projects for telecommunications' access arrangements. Interested parties are requested to provide a written response including documentation, literature, brochures, and references addressing capability in telecommunications' regulatory matters necessary to meet or exceed the stated requirements. Please limit your responses to five (5) pages and include the following information: (1) Name, address, point of contact, phone number, email address; (2) Business size and socioeconomic classification, (3) Whether interested in working as a prime contractor or subcontractor (3) Narrative addressing expertise in telecommunications regulatory matters (4) Experience in the field of telecommunication regulatory matters (5) Experience writing testimony for telecom proceedings before the FCC and/or PUCs (6) Experience providing expert testimony for telecom proceedings before the FCC and/or PUCs This notice is not a statement of intention to issue a solicitation or form a contract.
