Description
THIS IS A PRE-SOLICITATION ONLY. THIS PRE-SOLICITATION IS FOR PLANNING PURPOSES, AND DOES NOT CONSTITUTE AN INVITATION FOR BIDS, REQUEST FOR PROPOSAL, OR REQUEST FOR QUOTES. THE GOVERNMENT WILL NOT REIMBURSE RESPONDENTS FOR ANY COST ASSOCIATED WITH THE SUBMISSION OF INFORMATION BEING REQUESTED OR REIMBURSE EXPENSES INCURRED TO THE INTERESTED PARTIES FOR RESPONSES. The U.S. Army Contracting Command Aberdeen Proving Ground (ACC-APG), Aberdeen Proving Ground, MD, is issuing this pre-solicitation to release the Duke Technical Data Package (TDP) and draft Request For Proposal (RFP) documents to allow interested vendors the opportunity to view its contents and prepare questions, to be addressed by the Government, before the official RFP is released. This pre-solicitation is on behalf of Program Executive Officer (PEO) Intelligence & Electronic Warfare & Surveillance (IEW&S), Program Manager (PM) Electronic Warfare (EW), PdM (CREW). Description: The Duke system provides force protection against RCIED threats for occupants in wheeled and tracked vehicle platforms and within vicinity of fixed site positions. Requirements have been identified to provide continued system growth and conduct research, development, testing and evaluation (RDT&E) of new capabilities for enhanced force protection against emerging RCIED threats. The capabilities will address future RDT&E requirements for increased threat coverage, system networking, interoperability/compatibility, and system relevancy needs as required. This RDT&E effort is intended to also include integration of the Duke system with other electronic warfare systems (e.g., direction finding, HMS radios, TACSAT 117G radios, etc.). Currently, an RDT&E effort is being conducted with the Army Duke system under contract W15P7T-09-D-M615 with SRCTec Inc, 5801 East Taft Road, North Syracuse, NY. To continue this effort, the Government intends to solicit for a competitive RDT&E contract. The following documents are being provided to industry ahead of the official Request for Proposal (RFP) in an effort to give industry enough time to understand and ask questions. 1. Performance Based Specification (PBS) - Detailed system threshold and objective level performance parameters (Classified) 2. Performance Work Statements (PWS) for the Base Contract and Task Order 01 - The capability performance requirements 3. The current Duke Technical Data Package (TDP), as well as associated documents (Classified) 4. Additional DRAFT Request For Proposal (RFP) documents (CDRLs and Sections L&M) The classified documents can be provided to interested industry parties at a classified level upon successful validation of classified materials storage requirements. Unclassified documents do not require a facility security clearance. NOTE THE GOVERNMENT IS UNDER NO OBLIGATION TO ANSWER QUESTIONS, NOR IS IT LIABLE FOR ANY COSTS OR EXPENSES INCURRED IN RESPONDING TO THIS PRE-SOLICIATION. RESPONSE Deadline and Submissions: In order to receive the GFI associated with this pre-solicitation, offerors shall follow the instructions below labeled quote mark Security Handling & Dispoistion Requirements. quote mark Requests not following these instructions will be considered invalid. Parties may begin submitting requests for the above documents immediately. Questions regarding the actual RFP WILL NOT be answered. All questions shall be submitted no later than 15 January 2015. The Government will compile all questions and provide answers to all vendors NLT 30 January 2015. Vendors shall be aware that their questions and answers will be provided to all interested parties. Contracting Office Address: 6001 Combat Drive APG, MD 21009 1.Point of contact for this action is Abigail Jordan, abigail.g.jordan3.civ@mail.mil *********************************************************************** Security Handling & Disposition Requirements for Classified and Controlled Unclassified/For Official Use Only (CUI/FOUO) Government Furnished Information (GFI) Purpose: The purpose of these provisions is to levy the applicable Product Manager Counter Radio Controlled Improvised Explosive Device Electronic Warfare (PdM CREW) security requirements associated with this Presolicitation. The purpose of this Presolicitation is for planning purposes only. This is not an Invitation for Bids (IFB), Request for Quotations (RFQ), or Request for Proposals (RFP). The objective is to provide the contractor with classified and CUI/FOUO GFI applicable to the Duke System Technical Data Package and threshold and objective level performance parameters. The contractor is to use this GFI to get better acquainted with the Government's requirements. Security Requirements: The contractor shall have a SECRET facility clearance with SECRET safeguarding capability. The contractor facility shall have a valid accreditation from the DoD Security Service (DSS) for the acquiring of Classified GFI. The Contractor is authorized to receive and generate classified information and authorized the use of the Defense Technical Information Center (DTIC). Upon the contractor's request, the contractor will have access only to Secret Collateral, CUI/FOUO GFI- specifically the Technical Data Package, Performance Based Specification, and draft RFP documents. No other GFI or material is authorized. The Contractor shall adhere to the following security guidelines as indicated in The Department of Defense Contract Security Classification Specification (DD Form 254), and The Joint CREW Program Security Classification Guide (SCG) (OPNAVINST S5513.8B-88.1), dated 02 April 2007; these are the governing documents with which the contractor must comply with regards to information security. The contractor shall ensure proper classification markings and transit of documentation in response to this Presolicitation in accordance with AR 380-5 and this SCG. The contractor may be provided the following Classified GFI: 19 Compact Discs containing the Duke Technical Data Package (individual CDs are U//FOUO but are considered SECRET when compiled) Hardcopy of Performance Based Specification for the Counter RCIED Duke Technology Insertion RDT&E Effort, Version 1.9, 24 October 2014 (SECRET) The contractor is provided the following FOUO/UNCLASS GFI on a CD: JCREW SCG Standard Form (SF) 312, Classified Information Nondisclosure Agreement (NDA) DD Form 1540, Registration for Scientific and Technical Information Services DD Form 2345, Military Critical Technical Data Agreement DoD 5200.01, Vol. 2, DoD Information Security Program-Marking of Classified Information, 24 February 2012 AR 25-55, Department of the Army Freedom of Information Act Program, 1 November 1997 AR 380-5, Department of the Army Information Security Program, 29 September 2000 Base Contract Performance Work Statement (PWS) for CREW Duke RDTE, 27 October 2014 (and 49 associated Contract Data Requirements Lists (CDRLs)) Task Order 1 PWS for CREW Duke RDTE, 27 October 2014 (and 46 associated CDRLs) SECTION L - CREW Duke RDTE - Instructions, Conditions and Notices to Offeror or Respondents SECTION M - CREW Duke RDTE - Solicitation Provisions No other accesses are authorized. Contractor shall comply with the following OPSEC requirements: The contractor shall take measures to eliminate from their websites certain technological/technical data, when combined with other unclassified information that may reveal an additional association or relationship that meets the standards for classification. The contractor shall not publicly release information about the program without prior approval by the Government. The fact that certain details of information are shown to be unclassified does not authorize automatic public release. Foreign Disclosure in strictly prohibited. This GFI shall NOT be released to any other persons outside of the vendor's organization, nor shall it be replicated, manipulated, or printed. In the interest of National Security, Block 14 of the enclosed DD Form 254 imposes adherence to Additional Security Requirements as a prerequisite to attaining the classified and CUI/FOUO GFI applicable to this Presolicitation. IAW the FAR Section 5.102 (a) (5) Availability of Solicitations- the contracting officer need not make information contained within the solicitation available through the Government Point of Entry (GPE) such as, at http://www.fedbizopps.gov when: The nature of the files (e.g., size, format) does not make it cost-effective or practicable for contracting officers to provide access to the solicitation through the GPE. Thus the sensitive GFI is packaged and made available on CD(s) via classified transport. When the government agency determines that the solicitation contains information that requires additional controls to monitor access and distribution (i.e., technical data, specifications, designs, etc.) When unauthorized disclosure of the information would compromise the national security (e.g., would result in disclosure of classified information, or information subject to export controls) or create other security risks. The information within the GFI contains classified and control unclassified military critical technologies, and technical data in which Distribution Statement F applies-further dissemination only directed by Project Manager Electronic Warfare. The GFI contains technical data whose export is restricted by the Arms Export Control Act. The GFI contains information Exempt from Mandatory Disclosure under the Freedom of Information Act (FOIA) Exceptions 1, 2 and 5 apply. Requests for unclassified and classified GFI will be granted pursuant to compliance with the following controls: Contractor (company) completion of and submission of DD Form 2345, Military Critical Technical Data Agreement to attain certification for eligibility to obtain access to unclassified technical data disclosing military critical technology with military or space application that is under the control of, or in the possession of the U.S. DoD. Per the instructions provided on the form, please submit the application to U.S./Canada Joint Certification Office Defense Logistics Information Service (DLIS) Federal Center, 74 Washington Ave., North Battle Creek, MI USA 49037-3084. Please also provide a copy of the submitted form to the Government PM EW Security Manager Alison Powell via Fax# 443-395-4703. If the contractor has previously obtained certification, please provide copy of previous submitted form with certification # to the government security manager at the fax# above. Note: The Government has no control over the DLIS approval process. The processing time to obtain DD Form 2345 approval by DLIS will not delay the contractor from obtaining the requested GFI. In the meantime, receipt of a copy of the submitted form by the Government is sufficient for release of GFI. Contact DLIS at 800-352-3572 to check the status of your DD Form 2345 request. See enclosed DD Form 2345 Frequently Asked Questions for further guidance. The Contractor must ensure a SF 312 NDA is signed by each contractor employee designated as requiring a need for access to this GFI, along with verification of each person's security clearance as a prerequisite for access. The contractor is to submit each NDA with personnel security information to the Government PM EW Security Manager Alison Powell via Fax# 443-395-4703. Contractor compliance with security requirements outlined in the Security Handling & Disposition Requirements and within the DD Form 254. The Contractor will assure daily control and accountability of the GFI IAW with prescribed distribution statement and export control restrictions. Proper control and accountability is at the discretion of the contractor's security department. Request for only unclassified GFI would require the same prerequisites with the exception of the SF 312 and the DD Form 254. Contractor is still required to comply with those security requirements within the Security Handling & Disposition Requirements that pertain to handling and control of unclassified GFI. Requests for GFI: Procedures for request for GFI are as follows: Requests for the GFI should be sent to both: Trevor Brown at trevor.brown3.civ@mail.mil and Emily Boerum at emily.a.boerum.ctr@mail.mil. Required with the request is the Company Name, Address, Phone#, Cage Code, Project Manager's Name and Contact Information and name of the Facility Security Officer (FSO), address, Phone#, Fax#, and email. The contractor shall also specify if they are requesting just the UNCLASSIFIED GFI or both UNCLASSIFIED and CLASSIFIED. Requests for GFI are the Contractor's acknowledgement and compliance to the security previsions herein and/or in the DD Form 254. The Contractor's FSO will process and submit DD Form 2345 and/or SF 312, as instructed, to Alison Powell, Government PM EW Security Manager, at Fax# 443-395-4703. Upon acceptance of the application per DD Form 2345, and/or SF 312, confirmation of contractor's facility clearance and personnel clearances, the Government will release to the Contractor the requested classified/FOUO GFI as identified on an enclosed DA Form 3964. The contractor will confirm receipt of the classified shipment by faxing the DA Form 3964 within 24 hours of receipt to Alison Powell, Government PM EW Security Manager, at Fax# 443-395-4703. Received classified/FOUO GFI shall be appropriately handled and stored IAW AR-380-5 and the NISPOM. Presolicitation Disposition Instructions: Those Contractors who do NOT intend to participate in the subsequent solicitation shall return all GFI NLT 5 business days after release of the RFP for this effort. Those Contractors who WILL participate in the subsequent solicitation shall return all GFI with their proposal NLT 45 days after release of the RFP. The Recipient shall return all GFI (hardcopy and CDs) by the applicable deadline as properly classified packages to: US Army, PM EW, 5100 Magazine Road, Aberdeen Proving Ground, MD, 21005, ATTN: SFAE-IEW-EW, Security Office The inner wrapper of the classified mailing shall be addressed to: US Army, PM EW, 5100 Magazine Road, Aberdeen Proving Ground, MD, 21005, ATTN: SFAE-IEW-EW, Alison Powell If applicable, the Non-Disclosure Agreement shall be effective immediately upon receipt of classified GFI and/or the signing of this Agreement. All conditions and obligations imposed by the Agreement apply during the time of granting access to classified information, and at all times thereafter. Execution: The Contractor's FSO shall ensure the executions of all provisions within these Government security requirements. Coordination and implementation of all security activities will be between Contractor's FSO and the Government Security Manager. All security related questions should be referred to: Alison T.
