Description
The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform aerial fertilization services as defined in this Performance Work Statement (PWS). Purpose of aerial fertilization is to help establish a healthy, vigorous ground cover to protect the embankments from erosion. The contractor shall perform to the standards in this contract. Aerial Fertilization of identified grassed slopes of Lake O the Pines (approx 81 acres), Wright Patman (approx 145 acres and and Jim Chapman/Cooper Dam (approx 168 acres); Marion, Cass, Bowie, Hopkins and Delta Counties; Piney Woods Regional Office. The identified areas (attachment 1, 2 and 3) will be fertilized and seeded with a blended 13-13-13 fertilizer at 300 pounds per acre, common hulled bermuda at 10 pounds per acre and brown top millet at 20 pounds per acre. The fertilizer and seeds shall be blended to assure a good mixture of seeds and fertilizer. 1.2.1Application Requirements The blended mixture of fertilizer and seeds shall be applied at the rate specified in the Scope. The COR will provide the contractor a shape file of the areas to be treated so the contractor can assure proper coverage. The contractor shall provide the COR a copy of the flight path showing the applied areas when complete. 1.2.2 Site Visit: A site visit is recommended but not necessary to clarify expectations and answer any questions concerning the requirements of the specified work. A formal site visit can be scheduled with the COR if needed. The Government Point of Contact (POC) and COR for this action is Shane Braley. (903) 665-2336 ext 15 or michael.s.braley@usace.army.mil. 1.3 Period of Performance: Work shall commence within 20 calendar days of receiving Notice to Proceed (NTP) and be complete within 15 calendar days upon receiving NTP for the Base. If one of the three Options is exercised, the Base and that Option must be completed within 25 days of the NTP. If the Base and two Options are exercised, all work must be completed within 30 calendar days of the NTP. These time frames include anticipated 'Weather Days'. Weather conditions will dictate when work will be authorized to start. The Contractor shall honor all bid prices for 60 days from submittal. 1.4 General Information 1.4.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor's Quality Control (QC) program is the means by which he assures himself that his work complies with the requirement of the contract. The Quality Control Plan (QCP) will be submitted to the COR at the pre-work conference for review. After acceptance of the QCP the Contractor shall receive the Contracting Officer's acceptance in writing for any proposed change to his QC system. A 'Contractor Quality Control Report' form (Attachment 3) shall be completed by the Contractor daily and submitted to the COR each Monday for the previous week's work. 1.4.2 Quality Assurance: The Government shall evaluate the contractor's performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s). 1.4.3 Government Holidays: Contractor will not perform work on the following holidays: New Year's DayLabor Day Martin Luther King Jr.'s Birthday (observed)Columbus Day President's DayVeteran's Day Memorial DayThanksgiving Day Independence DayChristmas Day 1.4.4 Hours of Operation: Work hours shall be 8:00 AM to 6:30 PM; Monday through Friday, unless specifically approved in writing a minimum of five (5) working days in advance by the COR. 1.4.5 Place of Performance: The work to be performed under this contract will be performed at Lake O the Pines (Marion County, Texas), Wright Patman (Cass and Bowie Counties, Texas) and Jim Chapman / Cooper Dam (Hopkins and Delta Counties, Texas) 1.4.6 Type of Contract: IFB Low Price 1.4.7 Security Requirements: 1.4.7.1 Physical Security: At the close of each work period, any government areas opened for access shall be secured by the Contractor. 1.4.7.2 Key Control: The Contractor shall establish and implement methods of making sure all keys issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report any occurrences of lost or duplicate keys to the Contracting Officer. 1.4.7.2.1. The Contractor shall prohibit the use of Government issued keys by any persons other than the Contractor's employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer. All Government keys provided to Contractors will be issued and controlled IAW Army Regulation 190-51. 1.4.7.2.2 All contractor and all associated sub contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes. 1.4.7.2.3 The contractor and all associated sub contractors shall brief all employees on the local I-WATCH, Corps Watch, or See Something, Say Something program training standards provided by the requiring activity ATO). This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after contract award. 1.4.7.2.4 The Contractor must pre screen Candidates using the E verify Program (http://www.dhs.gov/E Verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to ensure the correct information is entered into the E verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I 9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file. 1.4.8 Special Qualifications: N.A. 1.4.9 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the Contracting Officer will apprise the contractor of how the Government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government. 1.4.10 Contracting Officer Representative (COR): The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions; assure that the contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor contractor's performance and notifies both the Contracting Officer and contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the contract. 1.4.11 Contractor Key Personnel: The following personnel are considered key personnel by the Government: Contractor, field supervisor and QC personnel. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the Contracting Officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. 1.4.12 Identification of Contractor Employees: quote mark Identification of Contractor Employees in the Federal Workplace quote mark (Aug 2008): (a) The contractor shall provide each of its employees who will be involved in the performance of the contract, on a Government facility, an identification (ID) badge and a standardized uniform that displays the company's name/logo and the employee's name. The ID badge shall clearly display the contractor's name and the employee's name and color photograph. It is the contractor's responsibility to ensure that all contractor personnel wear the ID badge and uniform at all times when performing work under this contract. Unless otherwise specified in the contract, each contractor employee shall wear the ID badge in a conspicuous place on the front of their clothing and above their waist, except when safety or health reasons prohibit such placement. This requirement is in addition to any Government facility security provisions that require that a Government-issued security badge also be worn. (b) Contractor personnel shall clearly identify themselves to all attendees as a contractor employee before the commencement of meetings with Government or other contractor personnel. Contractor personnel shall clearly and immediately identify themselves as a contractor employee when placing, answering or participating in telephone/VTC conversations with Government or other contractor personnel. (c) When contractor personnel send e-mail messages to a Government-owned computer, they shall include a signature block that includes their employer's name and the employee's full name and e-mail address. (d) Each of the requirements set forth in paragraphs a-c above, must be included in all subcontracts at any tier. quote mark 1.4.13 Contractor Travel: N.A. 1.4.14 Data Rights: N.A. 1.4.15 Organizational Conflict of Interest: N.A. 1.5. GOVERNMENT FURNISHED ITEMS AND SERVICES: 1.5.1 Facilities: N.A. 1.5.2 Equipment: N.A. 1.5.3 Materials: N.A. 1.6 CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES: 1.6.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this PWS. 1.6.2 Equipment: The Contractor shall furnish all equipment necessary to accomplish the requirements under this PWS. 1.6.3. Materials: The Contractor shall all materials necessary to accomplish the requirements under this PWS. 1.7 Contractor Management Reporting (CMR) N.A. 1.8 Applicable Publications (current editions) 1.8.1 The Contractor shall abide by all applicable local, state, and federal regulations, publications, manuals, policies and procedures to include the Safety and Health Requirements Manual (EM385-1-1). 1.8.2 Submittals: Government approval is required for submittals with a quote mark G quote mark designation; submittals not having a quote mark G quote mark designation are provided for information only. When used, a designation following the quote mark G quote mark designation identifies the office that will review the submittal for the Government. 1.8.2.1 Safety Plan quote mark G quote mark - The contractor shall provide a Safety Plan in accordance with requirements of EM-385-1-1 Appendix quote mark A quote mark. When developing the Safety Plan, the contractor shall follow Appendix quote mark A quote mark and reference each item in the plan back to Appendix quote mark A quote mark. Safety Plans that are not outlined as shown in the EM-385-1-1 Appendix quote mark A quote mark will be rejected. 1.8.2.2 Activity Hazard Analysis 'G' - The contractor shall provide an activity hazard analysis (AHA) for each feature of work involved in this contract. AHAs shall be in accordance with EM385-1-1 paragraph 01.A.13 and utilizing the AHA form or similar shown at the end of this SOW. 1.8.2.3 Work Plan 'G' - The contractor shall provide a work plan that describes his planned approach to accomplishing the work described herein.
