Accordingly, any contract resulting from this solicitation will include this clause. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) retained by VA to assist in assessing the contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an "Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement" to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the contractor to protect proprietary information as required by FAR 9.505-4, obtaining access to proprietary information, paragraph (b). (End of Clause) B.3 SUBCONTRACTING COMMITMENTS--MONITORING AND COMPLIANCE (JUN 2011) This solicitation includes VAAR 852.215-70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors, and VAAR 852.215-71, Evaluation Factor Commitments. Accordingly, any contract resulting from this solicitation will include these clauses. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) to assist in assessing contractor compliance with the subcontracting commitments incorporated into the contract. To that end, the support contractor(s) may require access to the contractor's business records or other proprietary data to review such business records regarding contract compliance with this requirement. (End of Clause) St. Cloud VA HCS Water Testing Contractor to provide water testing at, VA Medical Center, 4801 Veterans Drive, St. Cloud, MN. The water sampling will take place in Buildings 2, 9, 28, 48, 49, 50 and 51 on VHASTC campus. Overview of service includes: "For each sampling period, 20 representative samples per building will be collected. 10 samples from the cold water system and 10 from the hot water system in each building for a total of 140 water samples per sampling period. The first sampling period will be completed prior to 3/31/15. The second sampling period will be completed prior to 6/30/2015. A total of 280 samples will be provided for analysis over two sampling periods. "For each sampling period, 140 water samples are to be submitted to an accredited lab and tested for the presence of Legionella. The Contractor shall: "Have all 140 water samples per sampling period analyzed for the presence of Legionella utilizing a laboratory accredited to analyze water for Legionella. "Provide the St. Cloud VA HCS with all sampling results along with supporting laboratory documentation. "The testing laboratory processing the water samples for Legionella must be certified by the Centers for Disease Control and Prevention (CDC) Environmental Legionella Isolation Techniques Evaluation (ELITE) program as proficient at performing the culture of Legionella from environmental samples. (Information about ELITE certified laboratories can be found at https://wwwn.cdc.gov/elite/Public/MemberList.aspx The testing laboratory must also be able to determine if the Legionella detected in environmental samples is the species Legionella pneumophila and whether it is serogroup 1. Laboratory testing shall be performed at the contractor's ELITE certified facility and be performed accordingly. "The testing laboratory shall complete testing within 12 days and send a report to the St. Cloud point of contact by email within 2 days of test completion. Positive results will be emailed as soon as obtained/verified. A regularly mailed report will follow within 4 days of all tests completion. "The testing laboratory shall have qualified technical support staff for consultation relative to water collection, testing, interpretation of results and recommendations for remediation in a hospital environment. (d) Comptroller General Examination of Record.
